All of the other beneficiaries are !residents of Czechoslovakia, as is the decedent's widow.In his will the decedent stated tha t the widow abandoned him some 20 years ago.and went back to Czechoslovakia.An attorney named David Cobb from Washingtor, D.C.had been in communication with me and provided a Power of Attorney executed by the beneficiaries in Czechoslovakia and also executed by the widow.And he was to represent all of these people in this es tate.The Power of Attorney is ineluded with the papers Th'am filing:;today,as is a translation of that Power of Attorney. Also,I am filing a letter from this Attorney Copb which indicates that the widow does not elect to take against the Will and I believe can be considered to indicat e that she doesnIt want to ~ontest the averment of desertion,which is contained in the Will. THE COURT: MR.HIRSCH: Well,that's what the attorney says in his letter. Well,he does have a Power of Attorney signed by her,executed by the cWidow. THE COURT:Well,it's a quest ion of how far that Power of 3 Attorney would go. MR.IDRSCH:I imagine the Court will have to examine it.No" also,there is a claim against the estate by the DeRienzo Funeral Home in ttJe amount of $285.00,which is a balance on a funeral bill totalling $1,080.00.Now the funeral bill was incurred immediately after the decedent's death.At that time,I,who had c copy of the decedent's will in ;,my safe deposit box,was unaware the decedent had died.I think I was out of town and Letters of Administration were taken ou t by Mr.DeRienzo and he buried the decedent before I even became aware that the decedent had passed away.The amount of,the total amount of the funeral bill, including the vault and cemetery charges,came to $1,080.00. I paid the director $540.00 out of the es tate monies.Social Security paid him $255.00.The estate does not deny that the usual charge for the services rendered is $1,080'.)00.However, we would like the Court to include it in the Decree of Distribution unless the Court objects to it for some other reason than the correct valuation.
