The Petition of John D'Amico,Administrator of the
Estate of Camillo D'Amico,Deceased,respectfully represents:
1.Camillo D'Amico died a resident of the Borough of
Canonsburg,Washington County,Pennsylvania,on December 16,1969,
intestate.
2.Letters of Administration were granted to John
D'Amico on January 30,1970.
3.The said decedent died seized of an interest in the
following described parcel of ground:
ALL that certain lot of ground situate in the
First Ward of the Borough of Canonsburg,(for-
merly Cecil Township),Washington County,
Pennsylvania,known and designated as Lot No.
231 and a part of Lot No.233,as more fully
described below,in Block No.14 in a plan of
lots laid out by the Cecil Improvement Company,
known as Plan No.1 recorded in the Recorder's
Office of said Washington County in Plan Book
2,page 151;said lots of ground being more
particularly bounded and described as follows,
to wit:
LOT NO.231:
BEGINNING at a point on the northerly property line
of Giffin Avenue at the intersection of the divid-
ing line between Lot No.229 and Lot No.231 in
said Block No.14;thence along said dividing line
northwestwardly a distance of 120 feet to Gum
Alley;thence along Gum Alley northeastwardly
a distance of 35 feet to the dividing line be-
tween Lot No.231 and Lot No.233;thence along
said dividing line southeastwardly a distance of
120 feet to Giffin Avenue;thence along Giffin
Avenue southwestwardly a distance of 35 feet to
the place of beginning.
LOT NO.233,a Part:
BEGINNING at a point on the northerly property
line of Giffin Avenue,at the intersection of
the dividing line between Lot No.231 and Lot
No.233 in said Block No.14;thence along said
dividing line northwestwardly a distance of 120
feet to Gum Alley;thence along Gum Alley,north-
eastwardly a distance of 20 feet;thence along a
line parallel to the above mentioned dividing
line southeastwardly a distance of 120 feet to
Giffin Avenue;thence along Giffin Avenue,south-
westwardly a distance of 20 feet to the place of
beginning.
UPON which said lots of ground is constructed a
two-story frame dwelling.
BEING the same premises conveyed by.'James·,'.
D'Amico,Executor of the Estate of Vincenzo
D'Amico,deceased,dated May 29,1957 and re-
corded in the Office of the Recorder of Deeds
in Washington County,Pennsylvania,in Deed Book
995,Page 26.
4.The said property was sold for $9,000.00 to Bernard
Blanco and Jean Blanco,his wife,by the Administrator herei~by
Deed da ted June 18 ,197 0,and recorded in Deed Book 1320 ,
Page 17,Washington County Recorder of Deeds Office.
5.The property for estate purposes was appraised at
$9,000.00 and the Inheritance Tax has been paid in full in Tax
Docket 38,page 40.
6.The said estate has been closed approximately two
(2)years or more (March 25,1971)and all bills have been paid
distribution made to all heirs at law.
WHEREFORE,your Petitioner respectfully prays that your
Honorable Court excuse posting of additional bond under Section
541 of the Fiduciaries Act of 1949 (as amended by the Conso1ida-
tion of Probate;Estate and Fiduciaries Code,Section 3351),and
to affirm the various deeds referred to herein to erase any
question of the validity of the title as a result of the failure
to secure the approval of this Petition prior to the original
sale from the Estate.

Genevieve Easter and Mayo D'Amico,upon the filing by your
Petitioners of an Administration Bond in Bond Book 62,Page 24.
3.The said decedent died seized of an interest in the
following described parcel of ground:
ALL that certain parcel of ground situate in
North Strabane Township,Washington County,
Pennsylvania,more particularly bounded and

the Canonsburg,McMurray Road,which said pin
is located North 83°36'East 955 feet from the
line of lot conveyed to W.L.Rankin;thence
through the larger tract of which the within de-

BEING the same plot of land conveyed to Oriente
D'Amico by deed of William Russell Kendall,et ux,
et a1,dated March 12,1954,recorded in Deed Book
894,Page 11.The said Oriente D'Amico died on
December 15,1966 and Letters of Administration
were issued to John D'Amico,Genevieve Easter,and
Mayo D'Amico,Grantors in Deed to Laura D'Amico,
dated October 27th,1967,and recorded in Deed Book
1271,page 357.
4.The said property was sold for $5,000.00 to Laura
D'Amico on October 27,1967,Deed Book 1271,Page 357,and
eventually said property was sold to Walter V.01minsky,et ux,
along with another parcel,in Deed Book 1336 ,page 686.
Said Walter V.01minsky,et ux,have built a house upon this lot
and another parcel,and sold said property to John P.Colletti
and Noe1ita G.Colletti,his wife,by Deed dated July 6th ,
1973,and recorded in Deed Book 1443 ,page 79
5.The property for estate purposes was appraised for
Inheritance Tax and the tax has been paid in full on this estate
at Inheritance Tax Docket No.36,Page 253.
6.The said estate has been effectively closed approximate1
five (5)years or more,all the bills have been P9id,and distri-
bution of all assets made to Sabia D'Amico,mother of the decedent
the only heir at law.

Dear Sir:
In-reply to your letter to the Inheritance Tax Protest Board,
Harrisburg,Penna.,a copy of which was sent to us as attorneys for
the estate,we believe the sum of $2290 which was allowed by the
Register of Wills for funeral bills is not unreasonable in light of
the decedent's estate for the following reason:
(a)The appraised value thereof,although reported at $9446.60,
does not reflect the fact that the decedent had the following assets
in joint names with his brothers and sister,which were not report-
able at the time of filing the inventory and appraisement:
u.s.Savings Bonds in various series and amounts (Copies of these
assessments being attached hereto)
and on which the brothers and sister paid the individual inheritance
tax;therefore the total assets of this estate were $41,220.60,which
does not seem unreasonable that the sum of $2290 be allowed for
funeral expenses (includes funeral,lot,opening grave and the church
services).
We respectfully submit that $2290 should be permitted to stand
as the reasonable deduction for these funeral expenses.
Now we have filed our Debts and Deductions form showing addition-
al items to the ones which we filed on the RCC-62 Form,which was not
intended to be a complete list of the expenses in the estate,as some
of these expenses were picked up at the time of the Audit.You will

note that on the Debts and Deductions the total shows an additional
$619.18 worth of credits which were left out of the RCC-62 Form,but
which were included in the Audit petition.The items listed on the
RCC-62 Form was not intended to be a complete list at that time.
We trust this clarifies this matter and that the funeral bill
will be allowed at the original ,aRlowed figure.

Gentlemen:
Pursuant to the provlslons of Section 1001(1)of the Inheritance
and Estate Tax Act of 1961,a PROTEST is filed against the action of the
Register of Wills of Washington County on March 22,1971,allowing as
"reasonable"funeral expenses of $2290.00 claimed on the Statement of
Debts and peductions filed in the subject decedent's estate.
A review of our record discloses that the decedent,Camillo
D'Amico,died on December 16,1969,possessed of a parcel of real
estate known as 537 Giffin Avenue,Canonsburg,Pennsylvania,and
savings account #464 in the Mellon National Bank.These assets were
reported to the Commonwealth and,subsequently,on March 22,1971,
apprai~ed by the Commonwealth's appraiser at a total value of $9446.60.
Protestant contends the amount allowed by the Register of Wills
for funeral expenses does not meet the test of reasonableness within
the meaning of the 1961 Act.Whether such an expense is reasonable
or not is primarily dependent upon the decedent's station in life and
the size of her estate.
In the instant case,it is the Protestant's position that the
maximum allowable for funeral expenses should not exceed $1700.00.
