'IO FIX BooD IN RE SALE OF REAL ESTATE UNDER THE PRO-
VISIONS OF SECTION 541 OF THE FIDUCIARIES ACT OF 1949.
TO THE HONORABLE P..V,.MARINO,PRESIDENT JUDGE OF SAID COURT:
The Petition of EmaleFaye Behanna respectfully represents:
1.That Leonard D.Behanna,a/kia,L.D.Behanna,late 0
City of Was~ington,Washington County,Pennsylvania,died intest-
ate on January 9,1970,and Letters of Administration on his
estate were granted to your Petitioner on January 30th,1970,and
Surety Bond filed in the amount of $8,000.00.
2.That Leonard D.Behanna died seised of personalty
appraised at $7,076.04,and the following described real estate,
appraised at Fifteen Hundred ($1500.00)dollars,to-wit:
ALL that certain lot of ground situate in the
Third Ward of the City of Washington,Washington County,Penna.,
and being more particularly bounded and described as follows:
BOUNDED on the East by lot now or formerly of Sel
W.Thomas et we.,on the South by lot now or formerly of Andrew
S.Wil.liams et ux.,;on the West by lot now or formerly of James
W.Brown and Ada I.Curran,and on the North by Gibson Avenue,
said lot fronting 30 feet on Gibson Avenue and extending back
therefrom of equal width 78 feet,more or less,to lot now or
formerly of Andrew S.Williams et ux.,.
Upon which lot of ground there is erected a one
story frame dwelling covered with inselbric.
BEING the same lot conveyed by Edward J.Protin,.
Sheriff,to First Federal Savings and Loan Association of
Washington,by deed dated January 10,1969,and of record in the
Recorder's Office in and for Washington County,Penna.,in Deed
Book 1292,page 767,and subsequently conveyed by First Federal'
Savings and Loan Association to William D.Scott and Marian Scott
his wife,by Article of Agreement dated March 20,1969,and re-
corded in the Recorder's Office aforesaid in Deed Book 1295,page
536.The said William D.Scott et we.,sold said real estate to
Leonard D.Behanna,who paid for it in October,1969,but no deed
was delivered during his lifetime.By deed dated 7/3170,and re-
corded in Deed Book 1323,page 1043,the said William D.Scott
et we.,and First Federal Savings &Loan of Washington,Penna.,
conveyed said real estate to Ema1e Faye Behanna,Administratrix
or the Estate or Leonard Do Behanna.
3.That the Estate or deceased is clearly solvent.
4.That on or about October 1,1970,Burnell T.Hammond,
orally agreed to purchase subject real estate for Twelve Hundred
($1200.00)dollars,and your Petitioner agreed to sell same,sub.
ject to approval of your Honorable Court.That said'house is
vacant,is in very bad condition and said offer is the only one
made for said real estate in ten months time.
5.That attached hereto and made a part hereof is the
afridavit of two responsible persons familiar with the value or,
real estate in the vicinity of the real estate proposed to be
SOld,giving the rair value of the real estate herein described.
6.That your Petitioner has received no higher offers
ror said real estate,and she will be the sole heir or deceased
who died intestate without issue.Said real estate is assessed
at $"6,~,ror 1970 COunty Tax purposes.
7.That your Petitioner desires to complete the proposed
sale and deliver a proper deed to the purchaser named in the sa1ec
WHEREFORE,your Petitioner prays your Honorable Court to
make an Order relative to Additional Bond in this matter (your
Petitioner being already under Surety Bond in the amount or Eight
Thousand ($8,000.00)dollars,in accordance with the act of
Assembly in such case made and provided.

Faye Behanna,and Surety Bond in the amount o£$8,000.00,was
filed by her.
3.That an Inventory and Appraisement of the personal
property and real estate of the decedent was filed March 24,1970,
showing $7,076.04,personalty,and $1500.00,worth of realty.A
copy is hereto attached and marked Exhibit A.
4.That a First and Final Account was filed by said
Administratrix to No.85 of 1970,which shows all known debts of
decedent,his funeral bill,as well as Administration costs to
date have been paid,as well as inheritance tax in the amount of
$250.80.The real estate of deceased was also sold and converted
into cash.As shown by the account,the balance for Distribution
consists of a 1960 Dodge Dart automobile appraised at $50.00,a
1949 Pickup Truck appraised at $125.00,;81.777 shares of Mutual
Investing Foundation stock appraised at $676.30,and cash in the
amount of $4,631.63,total balance for Distribution being $5482.9 •
5.That your Petitioner has chosen the following describe
personal property of the deceased on account of her $10,000.00
(now $20,000.00)Spouse's Allowance under Section 10 of the
Intestate Act of 1947,p.L.80,20 p.S.1.10,As amended,more
fully described as follows:
One 1960 Dodge Dart automobile,1949 Ford Pickup
Truck,81.777 shares ,"(pIus 1970 accumulation)of Mutual Investing
Foundation stock,and the balance of cash remaining in said estat
after audit,estimated at $4,600.00.
6.That your Petitioner will pay the audit costs,balanc
of inheritance tax and any other necessary costs to properly
close out said estate.
WHEREFORE,your Petitioner prays your Honorable Court to
appoint two appraisers for the purpose of appraising said propert ,
directing said appraisers to make and file an Affidavit of App-
raisement with your Honorable Court.

MR.SANDERS:If the Court please,I have the nec:essary papers
in this estate.Just preceding the audit,the widow and petitioner,
also Administratrix,claimed the entire balance in the estate unde
the Spouse's Allowance Act and the Court made an appropriate
decree.All of the other heirs in the estate have notice of that
proceeding.Most of the Inheritance Tax has been paid.There are

no known claims except the audit costs and the balance of Inherita ce
Tax.The balance in the estate consists of an old car,an old true,
a few shares of stock and cash.The widow claims the widow's
exemption in the Audit Petition.The decree of Court imdler the
