be drafted at this time a suggested group of guidelines,whict
a settlement could fit into,if and when all the figures are
available.Further,let it be known that all of the attorney~
are not presently able to speak for their clients at this
moment and after a suggested settlement guideline has been se1
forth here,the attorneys would like very much to have a

respect to the real estate shall be apportioned among the
beneficiaries of the-real estate :in .accordance with the
inventory value of the real estate received by them.
The agreement is to be signed by all
parties to the dispute and by their respective spouses.

inheritanoe taxes and estate taxes and interest thereon,so
that.the real ••tate devised to Edward J.~ania and that to
be purchased by him will be free and clear of any expense,
tax,or obligation arising-from the administration of the
Estate of Mary Kania.
(c)Pay to each "of Carl Kania,Ann Ohs,
Rose Doak,and Jennie Jubas one-fourth (1/4)of the rent.

(b)At such "time as the personal repre-
sentatives of the Estate of Mary Kania have complied with the
decree of distribution made by tho Orphans'Court Division of
the Court of Common Pleas ot Washinqton County,Pennsylvania,
and distributed the net rentals from the real estate mentioned
in paragraph FOURTB of the decedent's will in compliance with
the undertaking set forth in paragraph 2(0)execute and deliver
to the said personal representatives good and sufficient releases
of all liability arising from the administration of the Estate
of Mary Kania by the said personal representatives.

the purchase of real estate by Edward J.Kania and his wife

(a)Local real estate taxes shall be
prorated,as of 1:I1e date on which the transaction between Edward
J.Kania,of the one part,and the personal representatives of the
Estate of Mary Kania,of the other part is closed.For the
purpose of this subparagraph real Gstate taxes shall mean 28'
of tho levies made by the several taanq authorities for city,
county,and school taxes for 1975 on Lot No.5,Wallace Plan
of LOt.s,Canton Township,Washington Counq,Pennsylvania,on
which are located a tvo-story frame house and a one-story trame
house.
(b)Realty transfer taxes shall be paid
equally by Bdward J.Kania,on the one part,and the per.onal
rep~e.entatives of the Estate of Mary Kania,on the other part.
S.The following procedure shall occur:
(a)Within ten (10)days after this
family agreement has been executed by all of the children of
the decedent Edward J.Kania ahall pay the sum of ONE TBOUSAND
NINB HUNDRED FIFTY-BIGHT and 40/100 ($1,958.40)Dollars mentioned
above in paragraph l(b)to ~le personal representatives of the
Estate of Mary Kania.
(b)The said personal representatives
shall,within five (5)daye after the said payment by Edward J.

liquidated,due,and payable,inoluding all inheritance taxes,

representatives shall pay to the said Charles Kania,also known
as Carl Kania,and Jennie Juhas their shares of the purchase
price paid for the said real estate and of the said net of the

6.All parties agree that the Orphans t Court
Division of the Court of Common Pleas of Washington County,
p$nnGylvania,may,if it electes so to do,make an order approving
and confirming this family agreement in lieu of a final decree
of distribution;but agree to request the President JUdge of the
said division to make an appropriate order certifying that·Bdward
J.Kania has title to the sourtherly half ot Lot No.5,Wallace
Plan,Canton Township,Washington County,Pennsylvania,by devise
and that Edward J.Kania and his wife have title to the .outherly
