Willie Belle Kitchens Martin is the claimant in this matter;she claimsifor personal services against the estate of the decedent for services rendered as an assistant nurse and a light housekeeper.Her claim covers a perioc.of eleven years. She was not represented by counsel at the hearing and the Court attempted to bring out the pertinent facts by questioning her at said hearing. Although,as stated,she claims to have rendered her services for a period of eleven years,her son Marcellus B.Kitchens,who lives in Wilkinsburg, testified that her services commenced in 1952 and continued until the death of the decedent.Mr.Kitchens testified that he lived in Donora only one-half block away from decedent's residence and that he saw his mother go to decedent's home and perform services there at least once a week during the period mentioned.He also testified that his mother worked for a Mrs.Duff before she died about five years ago.Mrs•.Duff lived at the home of the decedent but the relationship,if any,is not made clear in the testimony. and on several occasions washing the porches of said home.These were the t' The claimant presented one other witness,a Mr.Samuel H. Taylor,of Donora,who saw claimant working about the home of the decedent, i ,only two witnesses called by the claimant. lJIrs.Martin claims that she worked for the decedent since 1958 and had performed her services more or less regularly.She said she ran errands for the decedent,did banking for him,and performed various other services about the house,including nursing and light housekeeping.However, Mrs.Martin testified that late in the year 1965,she needed some money and asked the decedent,Vincent Malinoski,to pay her some money on account of the work that she did.The decedent replied that he would make a loan of money to her.He had her go to the bank and cash his check for $300,bringirli'J the money back to the decedent.The decedent then counted out the moneyto I· her and said that he was loaning her the sum of $300.Mrs.Martin had receipts,signed by Vincent Malinoski,shoWing that she had repaid said loan on three separate occasions,paying $100 each time.The receipts,signed by the decedent,were in proper order and showed the payment of$100 on each of three occasions,thus repaying the entire loan by March 2,1966. Mrs.Martin testified that the last payment was not actually made by her but that the decedent stated:"Well,I won1t tell you to pay me the other hundred do lIars,because you been pretty good around here,"and he says,"and the thing you do,you keep that other hundred do lIars."It would appear to the Court that this,in all probability,squared the accounts of the two,since it would hardly be accepted by the claimant in the manner that she! did,if there had been money owed to her for prior services. -2- ---------------------------------r~ ,. .., Claimant continued to serve in the same manner the decedent from March,1966,to the time of decedent's death.It does not appear that she was paid in any manner for this work.It is difficult to evaluate the worth of . I asked him to lend me $300.00 to pay a note to the bank and he , I I sign my name."Now this receipt book was in my charge in '65 I when I borrowed the money.I paid him $100.00 each month.My did and he says,"You get a receipt book,you write the receipt arXl boy was in the service,he sent me $100.00.And I paid him each month.I paid $200.00 and he says to me,"Well,Iwon't tell you to pay me the other hundred dollars,"he said,"Because you been pretty good around here,"and he says,"And the thing you do,you keep that other hundred dollars.Owe me only a litt~e bill I should have paid you."I said,"What bill is that?"He sa , "Just a little bill when you went for your Social Security,fl.he sai "I should have paid that and I didn't,"he says."So I'll 'pay you that."I could have signed Mr.Malinowski's name but I'm not that way.I wouldn't fool you.That's the way he writes.And Mr. Frazier knows his writing.I think he could verify that's his hand writing.I wouldn't forge nothing on the dead.I brought it here, pleading to you all that I may get something because I'm behind in everything on account of this debt on me. 10 THE COURT:Mrs.Martin,now we are going to let you testify to some things.You can't testify to everything,but I think you may be able to testify to some matters. Now you have had written up certain matters here that you put on eight sheets of paper,and each of those sheets of paper are signed by you.Is that your signature? Yes.. When did you have these sheets of paper written up,do you know, what year it might have been? After Mr.Malinowski died. After Mr.Malinowski died? Yes,but here is what I had before.I gave Mr.Frazier my hand- writing,when this contract was made,and I gave him the print Mrs.Martin too.Now this old tablet was an old tablet I did the writing up. This is it here,what I wrote up,started March 10,1958,right here in this old tablet from his house. As I understand it,Mrs.Martin,these papers were written up after Mr.Malinowski died. That copy from those papers,that's 1958 there,was in pencil writing.And I was afraid that they couldn't understand it and I took it to the Commerce Building and had the girl to type it for me so it would be clearly understood. You.have on the pencil writing paper here,at least on one sheet, sheet number six,you have got,this amount to 1958.What did you mean by that? 1958,that's the time that I started there to work. Then these pencil notations that you have,·that was copied over' and made into this typewritten paper. That's right. And then you signed these typewritten papers? Yes. But Mr.Malinowski did not sign it? No.He wouldn't sign these because he had a copy of these and he wouldn't sign them.He didn't have no copy of this because this was made after he died. Q He wouldn't sign the pencil-written paper because he had a copy? A Yes,he had a copy;he wouldn't sign it.Because I said,"If you'll 12 sign,let's have it printed then signed."He said,"No,I won't sig: Q thO "ao mg. He says,"I gotta .bank my money.,"And I said,"Well,Mr. Malinowski,I'm in a tight.I'll have to have some money to clea this debt up at the banle"And I was crying.And he said,"Mayb I'll loan you some money if you can pay me back."I said,"Well 1\J1'v>C _.in my grandson is in the service."I said,"He'll give me $100.00 a month.But this note is due now.It's behind and I have to clear t 14 "up.And he had me write a check for $300.00 and he signed th~ check and I went to the bank and brought him the money back. And he handed me the money out of his hands.He saidJ "NowJ you get a receipt book and let me see it."I bought the receipt book artlcarried it to him and he said,"Now you write the receipt in this bookJ Mrs.,II and he said,"Don't you tear:it out.You lea v that receipt in that book and when you get through writing the receipt in the book you give me the book.11 I saidJ "Will you sign a page?"And he said,"Yeah."That's his handwriting there whe e he signed.I couldn't sign'all these papers. That's right.Because I told her she shouldn't work for him for nothing.He should have paid her and he should have agreed to pay 22 her.But his story was this,that he needed his money,he was an old man,and he_did notwant to p~rt with his money..And that since she got so much money out of hIm for his son that his son would be obligated to pay her whatever he owed her when he died. , Now what type of work was your mother doing for Mr.Malin:owskJ ? She was doing nursing him when he got sick;she was cleaning up for him;she even went out in the back yard sometimes and pruned and cut his trees and stuff like this in the back yard.
