all individually,being thirteen of the fourteen named residuary
legatees of the said Anna E.Carson.
WITNESSETH:
'WHEREAS,Anna E~Carson died on December 19,1969,having
first made and published her last Will,a holographic writing,
dated January 5,1966.A true and correct copy of said Will i~
attached hereto,made a part hereof and marked Exhibit "A";ana
WHEREAS,on January 6,1970,said Will was duly probated
by the Register of Wills of Washington County,Pennsylvania,and
jLetters of Administration were granted thereon to Edith Carson
Colditz anq Curtis C.Carson,as Administrators,C.T.A.;and
M,EREAS,we,the undersigned,being the persons named in
said Wi:l as "nieces &nephews"are of the opinion that it was the
intention of our Aunt,Anna E.Carson,to specifically give her
200 shares of stock in the Allegheny Power Company to Blanche
Kuharic:by reason of the manner in which the last portion of the
Will was written.We do not believe that it was our Aunt's inten-
tion to have her great-:-niece,Blanche Kuharic,treated as a resi-
duary legatee;and
WHEREAS,we have been informed that in order for our be-
lief of the intention of Anna E.Carson to be carried,out,it is
necessary,subject to the approval of the Court,for all of us to

The petition of Edith Carson Colditz and Curtis Carson,
Co-Administrators of the above captioned Estate,respectfully
represents:
1.That Anna E.Carson,died December 19,1969,residing
at Fallowfield Township,Washington County,Pennsylvania,testate.
Letters of Administration C.T.A.were granted to your petitioners
,ion January 6,1970.
u~2.That the property which your petitioners propose toIi
'sell is a tract of land situate in Fallowfield Township,Washington
ounty,containing two lots,with a two-story frame house situate
hereon,which is more particularly bounded and described as
ollows:
TRACT I -ALL that certain tract of land situate in Fallow-
ield T.:)wnship,Washington County,Pennsylvania,being part of Lot
o.3 of the Snyder Place Plan of Lots and bounded and described as
rOllOWS:
BEGINNING at a point on the State Road at the corner
of Lot No.4 of said Plan;thence along the latter
North 1°30'West crossing Stephens Way a distance
of 220 feet to a point of the northern side of said
Way;thence at right angles along said Way,South
87°44'West,for a distance of 70.89 feet to the
southeastern corner of Lot No.8 of the Sub-Division
of Lots Nos.2 and 3 of'the Snyder Place Plan of Lots;
thence across said Stephens Way South 1-30'East,a
distance of 220 feet,which course is also the eastern
boundary line of Lot No.4 of the said Sub-Division
and which course terminates on the aforesaid Northern
side of the State Road;thence along the latter North
87°44'East,for a distance of 70.89 feet to the
Place of Beginning.
BEING part of the sa~e premises as were conveyed to
John S.Carson,Anna E.Carson and Della Carson,by
deed of Charles R.Harris and Lydia E.Harris,his
wife,dated October 10,1940,and recorded in the
Recorder's Office in and for Washington County,Penn-
~lvania,on October 14,1940,in Deed Book Volume
638,Page 534.The said John S.Carson died October
19,1957,and the said Della Carson died October 4,
1964,and title thereby vested solely in Anna E.Car-
son as the surviving joint tenant.
This conveyance is made expressly subject to the build-
ing restriction and the several exceptions and reserva-
tions contained in the deed from J.K.Smith,et al.,
to William H.Zellers,dated Dece~ber 6,1922,and
recorded in the Recorder's Office of Washington County,
Pennsylvania,in Deed Book Volume 504,Page 258,and
also expressly subject to the all~y or Way twenty £eet
wide,referred to as Stephens Way,and as shown on the
revised Snyder Place Plan,now known as the Smithdale
Plan of Kerfoot W.Daly and Dr.J.K.Smith.
TRACT II -ALL that certain tract of land situate in
Fallowfield Township,Washington County,Pennsylvania,being Lot
No.4,,in the Sub-Division of Lots Nos.2 and 3 of the Smithdale
or Snyder Place Plan of Lots in said Township,which Sub-Division
is of record in the Recorder's Office of Washington County,in
Plan Bo~k ~,Page 32,said Plan having been laid out by S.L.Wood-
ward anj Joseph Prise;and which Lot is bounded and described as
:follows:
BEGINNING at a point on the State Road at the south-
western corner of the Lot,described in the above
Tract I;thence North 1°30'West,for a distance of
200 feet to a point on the southern side of Stephens
Way;thence along said Stephens Way,South'87°44'
West,for a distance of 50 feet to the northeastern
corner of Lot No.3 of said Sub-Division;thence along
the latter,South 1"30'East,for a distance of 200

feet to a point on the aforesaid State Road;thence
along said State Road,North 87°44 1 East,for a
distance of 50 feet to the Place of Beginning.
BEING the same premises as were conveyed to John S.
Carson,Anna E.Carson and Della CarpoD,by deed of
Joseph Prise,et ux.,et al.,dated April 14,1941,
and recorded in the Recorder's Office in and for
Washington County,Pennsylvania,on April 15,1941,
in Deed Book Volume 642,Page 319.The said John S.
Carson died October 19,1957 and the said Della Car-
son died October 4,1964,and title thereby vested
solely in Anna E.Carson as the surviving joint tenant.
Subject to the exceptions,reservations and conditions
(insofar as the same may be applillcable)mentioned and
referred to in the deed from J.K.Smith,et al.,to
W.H.Zellers,Sr.,dated December 6,1922,and re-
corded in Washington County,in Deed Book Volume 504,
Page 2581
Since the abovementioned Smithdale Plan was recorded,
the right-of-way of Stephens Way has been widened from
20 feet to 33 feet with the result that TRACT I is now
subject to an easement of 26 1/2 £eet and TRACT II is
subject to an easement of 6 1/2 feet.This difference
in widths results from TRACT I extending to the north-
ern side of Stephens Way as it was originally laid out,
and TRACT II extending to the southern side of said
Stephens Way.
3.The deceased owned no other real estate at the time of-
her dea.th.
4.That as of this date your petitioners have not filed
an InvEntory and Appraisement,but they have marshalled the assets
of the Estate,and the personal estate has a value of approximate-
ly $30,683.07,consisting of an automobile,stocks,bonds,cash
and bank accounts;the real estate has been appraised at $11,200.
5.At the time of granting the letters of administration
bond in the amount of $35,000.00 was filed by your petitioners,
with U.S.Fidelity &Guaranty Company as corporate surety.
6.That your petitioners propose to sell the premises
describ2d hereinabove,to Donald Carson and Shelvie J.Carson,his
wife,f~r the sum of $9,000.00 and that your petitioners believe
such price is greater than can be obtained at a public sale.

7.That the affidavits of two responsible persons,fami-
liar with real estate values,giving their opinions of the fair
market value of the property proposed to be sold are attached
hereto and are marked "Exhibit A"and "Exhibit B".
WHEREFORE,your petitioners pray your Honorable Court
under Section 541 of the Fiduciaries Act of 1949,as amended,to
make a final decree requiring the entry of additional security,
in such amount as the Court may determine,and upon such entry of
such additional security your petitioners to have the authority
to receive the proceeds of same of the premises aforesaid.

TAKE NOTICE that I hereby elect to take in kind and as an advance-
ment on my eventual distributive share of the estate of Anna E.
Carson,the 1967 Dodge Automobile owned by h~r at the time of her
death on December 19,1969.
Should any now known or unknown claims or creditors successfully
prosecute their claims or actions against the estate to the point
that my eventual sham in the estate decreases below the appraised
value of the said automobile of $700.00,I hereby promise and obli-
gate myself both to the estate and to said co-administrators,in
their fiduciary capacities and in their individual capacities,to
pay back or reimburse the estate or them the difference between
said appraised value and my eventual share in the estate,thereby
guaranteeing to hold them,the said Curtis Carson and Edith Cars6n
Colditz,harmless and not responsible for their having given me
said automobile in advance of the normal time for distributing the
assessed assets of the estate.
