WITHOUT THE POSTING OF BOND
To the Honorable Judges of said Court:
AND now comes James H.Barton,Executor of the Estate
of his late father,John Barton,deceased,by his attorney,Larry P.
Gaitens and respectfully represents that:
1.On August 4,1961,the Register of Wills of Washington
County duly probated the will of the said decedent and issued letters
testamentary to your petitioner,James H.Barton.
2.That at the time letters testamentary were granted to
your petitioner,he was not a resident of the Commonwealth of Pennsylvania,
but rather resided at 144 Virginia Avenue,Jersey City,New Jersey.
3.That as a res ult of being a nonresident of the
Commonwealth of Pennsylvania,your petitioner was requir,ed to post a
nonresidence bond in the amount of $2,000.00 with the United States
Fidelity and Guaranty Company acting as surety.
4.That on November 21,1969,your petitioner filed an
inventory in the above captioned estate listing assets.as follows:

5.That the inheritance tax bureau of the Commonwealth
of Pennsylvania has appraised the aforesaid property in the amount of
$3,500.00.

Commonwealth of Pennsylvania residing at 355 Grace Avenue I
Canonsburg I Washington County I Pennsylvania I and further that he has
resided at this address since October I 1962 and that he plans to remain
a resident of Washington County I Pennsylvania.
7.That the said property is described as being Lots
Nos.23 and 24 in a plan of Lots laid out by James Wallace and recorded
in the Recorder's Office of Allegheny County I in Plan Book Volume 111
page 193 and having erected thereon a frame dwelling.
WHEREFO RE I we ask this Honorable Court to grant leave
to your petitioner to sell the within descti-bed property without the
posting of bond.
