MARINO, PRESIDENT JUDGE: The Petition of GEORGE EVANS respectfully represents: 1. Ada Belle Evans, also known as Ada B. Evans, also known as Adabelle Evans a former resident of 642 Boone Avenue, Houston, Washington County, Pennsylvania, died intestate on October 2, 1969 at the Canonsburg General Hospital, Canonsburg, Washington County, Pennsylvania, being at the time 85 years of age. 2. The decedent left surviving her the following children: Dorothy Evans, 64 Latimer Avenue, Strabane, Pa. (daughter) Vola Evans, !I:537.Sheffield,~d,~.B'altimore, Md 21218 (daughter) Lyle Evans, 234 East Hallam Avenue, Washington, Pa. (son) George Evans, 604 McGovern Avenue, Houston, Pa. 15342 (son) 3. The said decedent did not die seized of any real estate. The sole estate of the decedent, now in the custody of the petitioner, consisted of personal property of the appr_oximate gross value not exceeding $1,000. 00, to wit: of the gross value of $ 6'33. 10 being a checking account at the Mellon National Bank and Trust.G6rripany, Canonsburg Office, Canonsburg, Pennsylvania, Account No. 329-5721 in the amount of $27.10; proceeds of life insurance policy of Prudential Insurance Company of America, Policy No. 63 626 348 issued on June 8, 1925 in the amount of $306.00 and proceeds of life insurance policy of Prudential Insurance Company of America, Policy No. 52 764 445 issued on October 17, 1921 in the amount of $300.00, as appears on the Inventory and Appraisement hereto attached and made a part hereof. There were no wages paid direct to members of decedent1s family under Section 201 of the Fiduciaries Act of 1949. 4. Letters of Administration or Letters Testamentary have not been issued upon the estate of the decedent, and a Will has not been probated. 5. That your petitioner has paid all funeral, church, burial lot, and other outstanding bills owing and due against the estate of said Ada Belle Evans, also known as Ada B. Evans, also known as Adabelle Evans.,J 6. The debts of the decedent exceed the assets of the decedent, and there is, accordingly no inheritance tax due the Commonwealth of Pennsylvania, nor any other tax due or payable. 7. That this petition for settlement is made pursuant to Provisions of Article 2, Section 202 of the Fiduciaries Act of 1949, its amendments and supplements, as Ada Belle Evans, also known as Ada B. Evans, also known as Adabelle Evans, having died domiciled in the Commonwealth of Pennsylvania, in the County of Washington , and owing property of a gross value not exceeding $1,000. 00. 8. And there is attached to this Petition, a Joinder of all the children of Ada Belle Evans, also known as Ada B. Evans, also known as Adabelle Evans, acknow- !edging the fact that they have received notice of the intended presentation of this Petition, and join the prayer thereof. WHEREFORE, showing as above, Petitioner respectfully prays that your HonorablE ,- Court make a decree ofdistribution of the assets of the said ~qcedent, pursuant to Section . 202 of the Fiduciaries Act, approved April 18, 1949, its amendments and supplements, and suggests such distribution as follows, to-wit: (a) Delivery of all assets mentioned in Exhibit 11A", to-wit: Checking account at the Mellon National Bank and Trust Company, Canonsburg, Pennsylvania, Account No. 329 5721 in the amount of$ 27~ 10. Proceeds of life insurance policy of Prudential Insurance Company of America, Policy No. 63 626 348 issued on June 8, 1925 in the amount of$ 306.00; and Proceeds of life insurance policy of Prudential Insurance Company of America, Policy No. 52 764 445 issued on October 17, 1921 in the amount of $300.00, to your petitioner, George Evans, on account of the money advanced by him for church, funeral, burial lot and other outstanding expenses. KUSTURISS, ESQUIRE, Attorney for the petitioner, it is ORDERED, ADJUDGED AND DECREED that the personal property as described in the foregoing Petition be and the same is hereby av.-arded in kind to George Evans, the petitioner herein consisting of (a) Checking account at the Mellon National Bank and Trust Company, Canonsburg, Pennsylvania, Account No. 329 5721 in the amount of $27. 1 0; (b) Proceeds of life insurance policy of Prudential Insurance Company of America, Pol icy No. 63 626 348 issued on June 8, 1925 in the amount of $306.00; and (c) Proceeds of life insurance policy of Prudential Insurance Company of America, Policy No. 52 764 445':;issued on October 17, 1921 in the amount of $300. 00.
