PETITION BY NATURAL GUARDIAN FOR CONVEYANCE
OF INTERESTS IN MINORS' ESTATES UNDER SECTION
1001 ET SEQ. OF THE FIDUCIARIES ACT OF 1949.
TO THE HONORABLE P. V. MARINO, PRESIDENT JUDGE OF SAID COURT:
The petition of HENRY H. DHAYER, JR., respectfully
represents:
1. That he is the father and natural guardian of
DANIEL H. DHAYER and CYNTHIA L. DHAYER, minors, both of whom
reside with your petitioner and Mary Ann Dhayer, his wife, and
mother of said minors, at Box 295, Avella, Pennsylvania, 15312.
2. That said Daniel H. Dhayer is under the age of 14
years, having been born on October 31, 1959, and Cynthia L.
Dhayer is under the age of 14 years having been born on November
14, 1956, and that neither of said minors has a guardian for
his estate.
3. That the estates of the said minors consist of
two lots of ground in Cross Creek Township, Washington County,
Pennsylvania, conveyed to the said minors, respectively, as
follows:
(a) Deed of Ernest Brazier, et ux., to Daniel H.
Dhayer, dated April 27, 1965~ recorded in Deed Book 1203, page
354, conveying the following tract:
ALL that certain tract of ground situate in Cross
Creek Township, Washington County, Pennsylvania,
being more particularly bounded and described as
follows:
BEGINNING at a point at the southwesterly corner
of Lot No. 23 in a Plan of Lots known as the
Cross Creek Valley Plan No. 1, recorded in Plan
Book 6, pages 72 and 73 of the Recorder's Office
of Washington County, Pennsylvania; thence South
25° 45' East 273.6 feet to a point; thence North
64° 15' East 50 feet through lands of Ernest
Brozier, et ux., to a point; thence North 25°
45' West 279.5 feet to a point at the southeaster-
ly corner of Lot No. 23 in said plan; thence along
Lot No. 23 in said plan, South 65° 50' 50" West
50.50 feet to a point, the place of beginning.
: (b) Deed from Ernest ;Brozier, e.t ux., to Cynthia
L. Dhayer, dated April 27, 1965, recorded in Deed Book 1203, page
357, conveying.the fol~owing tract:
'
ALL that certain tract of ground situate in Cross
Creek Township~ Washington County, Pennsylvania,
being more-particularly bounded and described as
follows:
BEGINNING at a point at the southwesterly corner
of Lot No. 24 in a Plan of Lots known as the Cross
Creek Valley Plan No. 1, recorded in Plan Book 6,
pages 72 and 73 of the Recorder's Office of Wash-
ington County, Pennsylvania; thence South 25° 45'
East 279.5 feet to a point; thence North 64° 15'
East 50 feet through lands of Ernest Brozier, et ux.,
to a point; thence North 25° 45' West 283.2 feet
to a point at the southeasterly corner of Lot No.
24 in said plan; thence along Lot No. 24 in said
plan, South 65° 50' 50" West 50.40 feet to a point,
the place of beginning.
4. That the actual consideration paid for each said
lots was $200.00 and that each lot is assessed at $25.00.
5. That West Penn Power Company, in construction of
what is designated as Harrison-Wylie Ridge Electric Line, desires
an easement across each of said lots as shown on plots attached
hereto and made a part hereof, and is willing to pay $100.00
for the easement across the lot owned by Cynthia L. Dhayer, and
$25.00 for the easement crossing the lot of Daniel H. Dhayer.
6. That your petitioner believes the said sums to be
fair and reasonable considerations for the respective easements.
7. The said Mary Ann Dhayer, wife of petitioner and
mother of said minors, joins in this petition and consents to the
prayer thereof.
WHEREFORE, your petitioner prays for an Order of Court
authorizing and directing him as natural guardian to execute
the necessary instruments granting said easements, upon the
receipt of the said sums of $100.00 and $25.00, on behalf of
the said minors.
