I, ELIZABETH P. SWART, of Allegany County, Maryland,
being of sound and disposing mind, memory and understanding, and capable
of executing a valid deed or contract, and being mindful of the uncertainty of
human life, do hereby make, publish ana declare this to be my Last Will and
Testament, hereby expressly revoking any other wills or Codicils by me
heretofore made.
After the payment of all my just debts and funeral expenses,
I give, devise and bequeath my estate as follows:
All the rest, r~sidtle, and remainder of my estate, including
all of my property, real, personal, or mixed, wheresoever situated, and of
whatsoever kind, I may own, I give, devise and bequeath unto my daughters,
Clara Louise Sowers, and Glenneta E. Mosier, absolutely, to be divided
equally between them, share and share alike.
I hereby constitute and appoint The Second National Bank of
Cumberland, as the executor of my estate, and I hereby empower and
authorize my Executor to sell and dispose of any real estate I may own at
my death, for such price as it may determine to be advantageous, and to do
any and all things necessary for the expeditious closing of my estate, and the
dispensing of the money as hereinbefore directed to the parties entitled
thereto, and to execute such papers, deeds, or other instruments as may be
necessary to vest title to the real estate in any purchaser, without the
previous order of any Court, unless required by law, and in all ways to do
all things as may be recessary as provided by law. And I further authorize
my said Executor to make public or private sale if in its judgment the
same would be to the best interest of my estate; and I further request that

Honorable Court as follows:
1. Decedent, Elizabeth P. Swart, resided in
Amity, Washington County, Pennsylvania, and died on August 26,
1969.
2. A copy of the local Registrar's certification
o f .d eat h i s a t t ached , made a p a r t here t o , and m a r k e d Ex h i b i t "A" .
3. The petitioners are the daughters of the
decedent and are her only heirs.
4. The said Elizabeth P. Swart died possessed of
personal property valued at approximately $518.62 and enumerated
as follows:
(a) Automobile -1960 Vauxhall, Registration
No. Dl3959138, $25.00;
(b) Christmas Club Account at Pittsburgh
National Bank, $127.50;
(c) Checking Account No. 83-4-203462 at
Pittsburgh National Bank, $315.52;
(d) Credit due from State Farm Mutual Insu-
ranee Company for prepaid automobile insurance, Policy No. 1671-
178 All 38, $50.60.
5. The only expense due and owing at the time
of decedent's death·was a bill from the Washington Hospital,
Washington, Pennsylvania, in the amb~nt of $4~:~0.

6. The following expenses have been incurred as
the result of the death of Elizabeth P. Swart:
(a) Funeral and burial expenses, $1116.50
(b) Administration expenses:
1. Attorneys' fees:
i. Settlement of small estate; $75.00
ii. Settlement of tax account, 60.00
2. Register of Wills, petition for
settlement of small estate, 7.50
3. Angeline Sorice, Notary Public,
affidavit on petition to settle
small estate, 1. 00
7. The funeral and burial expenses in the amount
of $1116.50 have been paid by petitioner, Glennetta E. M6sier.
8. The Washington Hospital bill, in the amount of
$45.20 has been paid by your petitioner, Clara Louise Sowers.
9. The following expenses remaind due and owing:
(a) Attorney's fees, $135.00
(b) Court costs, petition for 8.50
settlement of small ·estate and
notary fees thereof.
10. The said decedent executed a will dated June
1, 1961, which is attached and marked Exhibit "B".
11. The decedent constituted and appointed the
Second National Bank of Cumberland Maryland as the Executor of her
estate.
12'. The Second National Bank of Cumberland Mary-
~-~ land has ceased to exist as a~ institution and all rights and priv'-
leges adherent thereto have been assigned to the First National
Bank and Trust Company of Western Maryland, its successor.
13. The First National Bank of Western Maryland
renounced its~right to administer the decedent's estate, and a cop
of the renunciation is hereby attached and marked Exhibit "C".

14. The First National Bank and Trust Company of
Western Maryland has requested that letters of administration be
issued to Mrs. Glennet~a:E. Mosier, one of the said petitioners.
1~. Because of the insolvency of the estate,
petitioners request that any obligations to probate the will, take
out letters of administration, and give notice thereof be relieve~
WHEREFORE, your petitioners pray your Honorable Court to
grant them power and authority to liquidate the assets of the
estate, and to decree distribution of the proceeds after payment
