MEMORANDUM OF LAW
History of Case
The Commonwealth of Pennsylvania, Department of Public Welfare
has petitioned this honorable court that its claim against the Estate
of Margaret Elizabeth Smith, a minor, for public assistance payments
' .,
in the amount of Two Thousand Seven Hundred Fifty and 04/100 ($2, 750. 04)
Dollars be adjudicated. Accordingly, Pittsburgh National Bank, guardia
of the estate of this minor, was directed to file an interim accounting.
The guardian's first and partial account shows a net balance in
this estate as of October 24, 1969 of Eleven Thousand Two Hundred
Seventy-six and 87/100 ($11, 276. 87) Dollars. When this account was
prerented for audit on March 16, 1970, Melvin B. Bc:ssi, Esquire,
appeared on behalf of Margaret Elizabeth Smith and contested the
validity of the Commonwealth's claim against this fund.
Essentially, the record shows that this fund in the guardian's ace-·
ount is the product of a settlement obtained in a personal injury law
suit. Margaret Elizabeth Smith was injured on September 6, 1958
in a motor boat accident. On February 29_. 1960 this court approved
the settlement of her claims arising from this accident; this proceeding
is indexed at .~:-.!7 May Term, 1959 A.~ The Commonwealth
has provided public assistance· in the form of aid to dependent children
for the benefit of this minor to her parents., Alfred E. Smith and
Yola G. Smith. Th~ periods of this assistance are August 6., 1959.,
to December 12., 1964 and September 24., 1968 to date. The total
amount of the Commonwealth's claim., as shown by the certified pro-
bate of account as of March 16., 1970., was Two Thousand Seven Hund-
red Fifty and 04/100 ($2., 750. 04) Dollars.
Argument
I. THE BASIS FOR THE COMMONWEALTH'S CLAIM
FOR REIMBURSEMENT IS THE PENNSYLVANIA
SUPPORT LAW.
The Commonwealth grounds its claim that it is entitled to reim-
bursement out of this fund in the guardian's account on the S,upport
law., Act of June 24., 1937., P. L. 2045., as amended., 62 P. S. Section
1971-77. Section 4 of this law provides the substantive basis of the
Commonwealth's right of reimbursement from property of persons
liable for expenses incurred for support and assistance. It states:
(T) he real and personal property of any person shall
be liable for the expenses of his support., maintenance 1 assi-
stance and burial., and for the expenses of the suppport.,
maintenance., assistance and burial of the spouse and un-
emancipated minor children of such property owner., in-
curred by any public body or public agency., if such pro-
perty was owned during the time such expenses were in-
curred., or if a right or cause of action existed during tlE
time suGh expenses were incurred from which the ownership
of such property resulted .....
62 P. S. Section 1974 (1). Thus., the two requirements for subjectin
either real or personal property to such liability are that (1) That the
expenses of the support or maintenance were incurred by public body
or public agency and (2) that such property was owned furing the time
such expenses were incurred or that a right or cause of action existed
during the time such expenses were incurred., from which the owner-
ship of such property resulted. The Commonwealth asserts that both

requirements are satisfied in the instant case.
II. PROPER JURISDICTION OF THIS PROCEEDING
IS IN THE ORPHANS' COURT DIVISION OF THE
COURT OF COMMON PLEAS OF WASHINGTON
COUNTY.

It is well settled that the jurisdiction of the Orphans' Court Divisio
of the Court of Common Pleas en:com,pa's:s:e:-s the Commonwealth's claim
in this case. Moreover, since 1832 it has been the law that the Or-
phans' Court has exclusive jurisdiction of the estates of minors, of
the settlement of the accounts of their guardians and of all questions
of allowances for maintenance. Johnstone v. Fritz, 159 Pa. 378
(1893); accord EBtate of Evelyn Rosemary~ers, a minor, 45 Wash-
ington County Reports 94, 35 D. & C. 2d 476 (1964). Even when a

support grant is made to the moth~ ignorance of ~he fact that
assistance to the children is unnecessary,,' the Commonwealth may re-
cover out of the property of the children the amount which it has thus
expended. Reiver's Estate, 343 Pa. 137 (1941); See also Stoner Estate,
358 Pa. 252 (1948) (Liability of Estate of Relative for Support of Indi-
gents).
III. THE COMMONWEA.;LTH HAS SUBMITTED PROPER
EVIDENCE TO PROVE ITS CLAIM OF $2, 750. 04.
The Commonwealth submits that the introduction of the notarized
probate of account showing assistance in the form of aid to dependent
children to Margaret Elizabeth Smith, a minor, is sufficient proof
of its claim of +wo Thousand Seven Hundred Fifty and 04/100 ($2, 750.0
Dollars. See Reiver' s Estate Supra. No problem of prorating assistanc
benefits among several children or parents is present in this case.
IV. THE AMOUNTS IN THE ESTATE OF MARGARET
ELIZABETH SMITH ARE SUFFICIENT TO PAY
THE CLAIM OF THE COMMONWEALTH.
The crux of the argument of the attorney for the minor's estate

is that additional operation and medical expenses from plastic surgery
may be required in the future; and that it is therefore inequitable to
deplete this estate to reimburse the Commonwealth1 s claim. Neither
medical testimony nor doctors 1 statements were introduced to show the
likelihood of such rurgery in the m~ar future. The impact of this argu-
ment, moreover, is diminished significantly by the fact that almost
twelve (12) years have elapsed since the date of the injury this minor
received, and no corrective surgery has been initiated in the interim.
The Commonwealth recognizes the inherent power of the Orphans 1
Court Division to preserve and protect a minor's estate so that it will
not become exhausted before the minor reaches her majority. Estate
of Evelyn Rosemary Akers, Supra. at 98. The claimant respectfully
rubmits, however, that both the absence of medical testimony corro-
borating the assertion of the minor's counsel and the amount of money
in this estate militate;~ strongly in favor of the Commonwealth's posi-
tion. Even if the Commonwealth's claim is admitted and paid, there
will still be a balance in this estate of Eight · Thousand Five Hundred
Tw:enty-six and 83/100 ($8, 526. 83) Dollars, which the guardian may
prudently invest for her benefit.
Summary
In conclusion, the Commonwealth respectfully submits that under
the authority of the Support Law it has sufficiently made out its claim
for reimbursement of Two Thousand Seven Hundred Fifty and 04/100
($2, 750. 04) Dollars from the estate of Margaret Elizabeth Smith, a
minor. Secondly, it is submitted that there is insufficient evidence
on the records at this point from which the court may conclude addi-
tional surgery is required for this minor. Finally, it is submitted
that this court should order the Commonwealth's claim to be paid
since there will still be a substantial residue in this fund after the

account.

In response to question No. 1, we can advise the court that
our files show that Margaret Elizabeth Smith was born on September
8, 1953~ thus1 on August 6, 1959, she was almoet six years old.

As to the 1 other questions asked in your letter, we will be glad
to provid~ the equrt with this information as ~oon as the specific
facts are forwarded to us. This information must come from the Pitts-
burgh Claim Settlement Division of the Department of Public Welfare.
We have requested this division to supply us with these facts as
soon as possible.
As soon as we are given answers to question 2 through 9, we
will advise the court of this information.

Department of Public Welfare in this matter. And we had filed the
Petition originally. Mr. ,Keller had. And at this time, Your Honor,

ordinari~y go for the benefit of this child for any additional medical
expenses that she might need in the future. I am thinking now of
plastic surgery that she is go~ng to perhaps require, of any other
heavy medical expenses and more over, that the funds that are
created are not given free to this child in the sense that they are
unencumbered funds, but were really for the basis of future medic:: 1
e~penses which she has not yet incurred.

Know all men by these presents, That I, Margaret Elizabeth
Smith, now by marriage, Margaret Smith Nothey, having attained the age
of eighteenyears, do hereby acknowledge that I have this day received
of and from Pittsburgh Nationa,l Bank, ~y Guardian, duly appointed by the
Orphans' Court of Washington County, Pennsylvania, the sum of Nine Thousand
Nine Hundred Ninety Nine and 48/100 ($9,999.48) Dollars, being the amount
·awarded'me by the Court of Common Pleas of Washington County, Pennsylvania,
Orphans' Court Division, in full satisfaction and payment of all claims
which I have, or might have, against my said Guardian, and of all monies
or property for which it may be accountable, and I do, therefore, by these
