The executrix advises me that about a'month after the decedent's death,she received a letter from the decedent's brother in Czechoslovakia thanking her and her family for taking care of the decedent and advising her that he received word of his brother's death from the brother's wife,Anna. This person claims that she lived with her husband in Donora,Pennsylvania,in 1937 and 1938 and that because of her health,she had to move to Europe. I am in receipt of a copy of a letter sent to Anna Jakubova.I understand that August 3,1971 has been set for a deadline for notification as to whether or not she intends to take against the Will.She does intend to take against the Will but it will be impossible to have a Power of Attorney drawn up by August 3,1971.We have written to her and requested that she appear before the American Consul at Prague and sign the Power of Attorney, also an Affidavit saying that she is the Widow of John Jacub. They came again for the second time in 1937.They lived on Eighth Street in Donora,Pennsylvania.They lived in Donora for about seven months.Mrs. Jakub did not like Donora and she went back to Europe in 1937.Her husband, the decedent,did not wish her to go.She never came back,living in Europe ever since.Now she files an election to take against the Will of her husband. She had no complaint about the way she was treated;she never complained about anything except that she did not like to live in America.She simply deserted her husband and the desertion was malicious and was not justified. The decedent died November 16,1969,and Anna Pazej was appointed executrix of his estate. The election to take against the will was not timely as it was not filed in one year of the appointment of the executrix.The Court extended the said time because of the residence of the wife in Europe.At the hearing,it t·'".... was conclusively proved that she had deserted her husband unjustifiably and maliciously in 1937 and that the said election should be stricken for said reasons.
