History of the Case
On October 5,1969 Sophie Pabian died,testate,and by
Iherwillinther~siduary clause thereof left the residue of her
estate to eight (8)named children,share and share alike.No
inventory was filed in this estate until May 2,1973.That
inventory showed the proceeds from the sale of property situate
in the Borough of Can~nsburg at a purchase price of $13,500.00
and the,proceeds of sale of furniture to the value of $195.00.

Discussion
The Probate,Estate and Fiduciary Code of 1972,20 P.S.
101 et seq.,provides for an accounting 'by ~he personal represe~ta
tive in Section 3501,wherein it is stated:
"Except as otherwise provided in this
'code,every,persona1 repres~ntative shall file
an account of his administration at the expiration
of six months from the first complete advertisement
of the original gran~of letters or when directed
to do so by the court • •."
Section 3503 provides that notice of said account must
be given to parties in'interest.One of the first duties of an
Executor under the Will of the decedent is to collect the assets
of the estate of the.decedent.~he6bjections in'·this case list,.
certain assets believed to be in the estate of the decedent but
which have not been accounted for by the Executor of the estate.
These objections will be taken up seriatim.,-
With regard to cash,testimony will be presented by the
objectors to the account that a savings account held in the names
of the decedent ot Frank Pabian was,in fact,an account of
convenience so that Frank"Pabian could withdraw on the account
for the benefit only of the -decedent and that this authority to
make withdrawals.:ceased at the time of the death of the decedent.
Testimony will further show that the decedent and her deceased
husband during their lifetimes had other members of the household

whose names were placed on the account for similar convenience.
This in effect amounted to a power of attorney in the pe~son of
.,.Frank Pabian and wa's not a conveyance'"of the account or any portio
thereof to him.
It is po~~ted out in the Pennsylvania Fiduciar~0Guide~
Little,Brown &Company,1962 and supplemented in 1968,at page
63,Section 6.10 that:
"If there is any reasonable doubt as to
whether the property belings in the estate,the
personal representative should,of course,take
the position that it should be included,make
claim for any such property not in his/possession
and'retain possession of,that which he has--unless
.the court directs otherwise'or unless all parties
claiming through the estate agree that the estate's
claim should be abandoned."Citing Fid.Act of 1949

It will be shown by the testimony that as of the date of
death of decedent the balance of savings account #1525 was
$6,676.29 and that.the balance as of April 13,1973 was $2,233.93
and that on that date the bank account was closed.

4.The sale of the real estate which was titled in
the name of the'decedent at her death should be shown in full,
including all the costs of the real estate transaction.Although
the Probate,Estate -and Fiduciary Code does not require the
permission of the Orphans',Court to sell the property.at private
sale,it is believed that ,sound administ~ative practice would be
to obtain such permission and to have a court approved sale in
order to assure the most-advantageous sale price to the estate.

5.Objection has been made to the claim for Family
Exemption by Frank Pabian in,the amount of $1,500.00 Section
3121 of the Probate,Estate'and Fiduciary Code provides:
"That the spouse of a decedent dy:i:ng
domiciled in the Commonwealthcor if,there'be
no spouse • •~then such children as are members
of the same household as the decedent • • •
may retain or claim as exemption either,money
or personal property,or both,not theretofore
sold by the personal representative to the value
of $1,500.00 ••II'
Frank Pabian was not a member of the decedent's househol
and,therefore,is'not permitted to claim the family exemption.
Further,no claim or notice of c'laim was ever given to the heirs
under the will of decedent.

That Schedule A attached hereto and made part hereof sets forth fully and in detail.all the

at the time of death,whether in decedent's immediate possession,standing to decedent's credit i~banks

of which decedent died possessed,of whatsoever nature,with interest thereon,if any,giving the face
value and estimated fair market value thereof,and if such estimated fair market value be less than the
face value,it sets forth briefly the reasons for such depreciation as to each item;all moneys payable
to the estate from life insurance polici"es carried by decedent;all annuity and endowment contracts the
proceeds of which were payable upon the death of the decedent;and all the corporate stocks and dividends
due thereon and unpaid as of the date of death,bonds and accrued interest thereon to the date of dece-
dent's death and other investment securities owned by the decedent at the time of death,with the market
value thereof at such time.

In the case of securities of close or family corporations,the values reported are as far as
possible subs.tantiated by financifll stat:ements of the corporations,showing the assets and liabili ties
th~r~of.asofthe_dateof qea.th.The schedule also sets forth the interest of decedent at the time of
death in any co-partnership or business,and in support of th~value··of such interest th~re is annexed to
said schedllle,financial'statements showing the assets and liabilities of said co-partnership or business.
A copy'ofthe co-parfnership agreement,(if oral,a statement setting forth the nature of the'agreement)
together with astatement.setting forttJ the character of the business,~ts location,and such other facts
pertaining to the ousiness as may be pertinent to a fair and just appraisal of the decedent's interest
therein must be submitted.It should also set'fo'rth in itemized form,together with the fair market value
thereof,any other property owned or bequeathed by the decedent at the time of death.
The Schedule C attached hereto and made part hereof sets forth a true'answer to each inquiry
contained therein and in the case of transfers ofproperty,real or personal,within t~o years of decedent's
death,in contemplation of decedent's death,or intended to take effect in possession or enjoyment at or
after death,said schedule sets forth the nature and value of such property,to whom transferred,the
relationship of the transferees to the decedent,the proporti.onate share received byeach transferee and
all other facts of a pertinent nature regarding said transfers.In the case of transfers intended to
take effect in possession or enjoyment at or after death,there is also attached to the schedule a COllY
of the deed,trust agreement or other instrument creating the trust.Therl~is also set forth in said

That Schedule D attached hereto and made part hereof sets forth the names and addresses of all

That Schedule F attached hereto and made a,part hereof sets forth fully and in detail all debts
and deductions claimed for and on behalf of this decedent's estate,including ftlneral expenses paid;
