Dray to Edwin E.Dray,dated July 11,1969,a copy of which is attached hereto and is designated Exhibit "A".The said Samuel C.Dray is incapacitated and is presently a resident of the Manor Nursing Home,Washington,Pennsylvania,and is unable to atten4 to his business affairs.He was,however,in a family relation- ship with the said decedent at the time of decedent's death. WHEREFORE,your petitioner prays that your Honorable Court award and set aside the balance payable to Nannie Dray from the Estate of Lulu Eisiminger,deceased,at No.63-68-1515,in equal one-half shares to Samuel C.Dray and Edwin E.Dray,and that the share of the said Samuel C.Dray be made payable to Edwin E.Dray,attorney-in-fact for Samuel C.Dray,for use on account of the Samuel C.Dray,after deduction of the cost of preparation,presentation and filing of this petition,without notice and without issuance of Letters of Administration,on account of the family exemption,all in accordance with provisions of Sections 202 and 211 of the Fiduciaries Act of April 18,1949, P.L.512,as amended,and the rules of your Honorable Court.
