attorneys are McCreight, Marriner and McCreight.· Mr. John
McCreight?
MR. McCREIGHT: May it please the Court, I have the necessary
papers. This estate is insolvent. There are no outstanding unpaid
claims. The widow has volunteered her own funds to the relief of
any claims that exceeded the balance in the estate.

was acting as successor trustee under the trust created by the will
of Mrs. Booth, and Mrs. Sargent, in behalf of the decedent has file
an account which is presently in the hands of the Court. The proble
is the appointment of a successor trustee to Mr. Sargent. Mr. Kell
represents the bonding company who bonded Mr. Sargent in his
lifetime in his position as trustee, and: is, of course, concerned
that this matter be finally determined and the bonding company
r~lieved of its responsibilities. We have been in touch with the life
tenant, the son of Mrs. Booth, and have asked him to send us the
ages of his children, who are the apparent remaindermen under the
terms of the trust. He has thus far failed to do this, although by
phone he promised that he would do it about two weeks ago. Perhaps
it would be well to keep this estate open, pending a final determinat ·
of the settlement of the Mary E. Booth trust that is presently in the
hands of the Court. . . •,
THE COURT: All right. We will agree to do that. We don't
know how long that would take though, do ,we? " · ·
MR. KELLER:· · Hopefully, riot very lon~; Your Honor. We have
been a long time on this trail, and .we feel that Mr. McCreight is
·now at the point where this account pretty well balances out and
that it is in shape to---that the trust account is in shape to be con-
firmed and a new trustee appointed and t~e old one relieved and
the bo.nd dissolved. But until that's done, we would riot wahf:Lthe
.estate of the trustee to be completteJyciosed out.

of a substitued trustee. But we hadn't closed out the matter.
MR. McCREIGHT: I might call the attention to the Court to the
fact that the assetsc; of that trust estate are such that it would ,rbe"ve
very difficult to persuade anyone to accept it. as atb·ustee. We have
a ~ituation where the cash and negotiable assets would probably not
exceed about $1200. OO;the balance of the trust estate is in real estate
And. perhaps some method of depositing it in a savings account for the
lir'e of the life tenant, with some provision against withdrawal might
be the possible solution, rather than having a trustee attem.pting to
operate it.
~ THE COURT: Well, if you have real estate in the trust it would

that I think at the present time the life tenant is actually opea7ating
~ it. And' he undoubtedly would be quite willing to do so and he can't ,

premiums, there's not too· much that he could do to harm the trust
estate.
THE COURT: Well, we will give that problem our consideration
Presently, we will continue .. vie won't close this audit and we will
