N the discharge of the guardian;in this case, a Petition foJ an adjudication of regaining of competency was presented ui ffi by an attorney on behalf of some of the family and the .... Your Honor, I would like to report to the Court in this case that a complaint was r ade about the amoun·t of my fees charged in handling of this matter. And Mr. Stegenga had represented some of the fami y of this ward and had wri ttw me a letter about same. We talkm a little bit about i.tr::at first and then it wasn't until actually Monday that we had a chance to sit down and discuss it in depth. Ill 0: ... 0: :I 0 u .' .J -~ u ii: II. 0 3 that day from Miss Evelyn Myrgo, and -I believe some of the Myrgo family is in Court this morning, a~-lett~r requesting an itemized and notarized statement concerning---it says ' doctor and professional services, so I didn 1't quite under- stand the letter in that respect. So I ga~e Mr. Stegenga a copy of that letter and wrote Miss Myrgo backthat I had met with Mr. Stegenga and he would be in touch with them. Then I'received a letter that was hand- . : delivered to my office yesterday_ from Mi~s Myrgo, which I ·will give to the Court. Due to the threatened bus striffi here in town, I was tied up all afternoon .and delivered a ' p~otocopy of this letter to Mr. Stegenga this'morning. .. He informed me this morning, close. to'lO':OO o'clock, that he had been discharged as counsel for the Myrgo's, and thEt 'hew ould not be here at the audit. ·The letter which I will give the Court refers;·to ce!rtain monies,"the Court will recall as the subject of some dispute a couple years ago, was ID. another account, not a guardian's account. The bankpetitioned for Citation, which was issued against Evelyn Myrgo and M s. Mary Myrgo, a sister and mother of the war~, to turn thes~ funds over to the guardian. This was in 1965, was re.turna~le . in August of 1965 and then Mr. Stegenga wasri 1 t well at th t time, so to maffi a long story short, in August of 166, th Court, after conference with counsel, decreed that the monies be turned over to the guardian bank, which was .J < u 4 finally done on or about February 20, 1967 • .. THE COURT: That is part of the incompetent's estate, is it ·not? MR. HAHN: .That's right, Your Hnnor. So in short, I believe that the audit could be closed except subject to a~y objections that the Myrgo' s may lave. Number one,' as far as . Why didn't they invest it in a sure thing, li~ 5% guaranteed investments? THE> COURT: Well, your investments of your trustees is done under the Act of. Assembly that is applicable .. thereto. And they do it under the direction of the Court ·when· that is nece.ssary. If there is any improper investmer t . .• . When they irivest a person's money that they're s:upposed to be guardian, make sure that it's safe._They 1rE .not supposed to be taking such risks and gambling with it THE COURT: If you feel th~t there is anything im- proper about their investment~-- EVELYN MYRGO : I think so. Now that was the same outfit as this Washington Mellon Bank. why was it necessary to have it transferred from Canonsburg Meilon to Washington Mellon? But you were never appointed guardian, as I recall it, by the Court. You were just acting as suet. ~ EVELYN MYRGO: Yes. 1&. 1&. 0 THE COURT: The Court decided that you had to-~officia~ ly turn that money over to the guardian of the incompetent. That-is why we made the order that we did. ~VELYN MYRGO: Why couldn't it have remained at C~nonsburg Mellon? Was it necessary to have it brought up to Washington Mellon? THE COURT: It would make no difference. But the accolnt ~ had to be changed. The account couldn't be left in your name. So whether it was in the Canonsburg Office or the Washington Office wouldn't make any difference at all.
