dated August 22, 1969. And then unfortunately, the ward
passed away August 27, .1969. Your Honor, I would like
to report to the Court in this case that a complaint was r ade
about the amoun·t of my fees charged in handling of this
matter. And Mr. Stegenga had represented some of the fami y
of this ward and had wri ttw me a letter about same. We
talkm a little bit about i.tr::at first and then it wasn't
until actually Monday that we had a chance to sit down
and discuss it in depth. And then I had received a letter

that day from Miss Evelyn Myrgo, and -I believe some of the Myrgo
family is in Court this morning, a~-lett~r requesting an
itemized and notarized statement concerning---it says
' doctor and professional services, so I didn 1't quite under-
stand the letter in that respect. So I ga~e Mr. Stegenga
a copy of that letter and wrote Miss Myrgo backthat I had
met with Mr. Stegenga and he would be in touch with them.
Then I'received a letter that was hand-
. :
delivered to my office yesterday_ from Mi~s Myrgo, which I
·will give to the Court. Due to the threatened bus striffi
here in town, I was tied up all afternoon .and delivered a
' p~otocopy of this letter to Mr. Stegenga this'morning.
..
He informed me this morning, close. to'lO':OO o'clock, that
he had been discharged as counsel for the Myrgo's, and thEt
'hew ould not be here at the audit.
·The letter which I will give the Court
refers;·to ce!rtain monies,"the Court will recall as the
subject of some dispute a couple years ago, was ID. another
account, not a guardian's account. The bankpetitioned
for Citation, which was issued against Evelyn Myrgo and M s.
Mary Myrgo, a sister and mother of the war~, to turn thes~
funds over to the guardian. This was in 1965, was re.turna~le
. in August of 1965 and then Mr. Stegenga wasri 1 t well at th t
time, so to maffi a long story short, in August of 166, th
Court, after conference with counsel, decreed that the
monies be turned over to the guardian bank, which was

finally done on or about February 20, 1967 •

THE COURT: That is part of the incompetent's estate, is it
·not?
MR. HAHN: .That's right, Your Hnnor. So in short, I
believe that the audit could be closed except subject to a~y
objections that the Myrgo' s may lave. Number one,' as far as . ' '
my fees are concerned, r wa:s in the proce ~;:;. or talking

with Mr. Stegenga about it.-'And ·I am 'still willing to discuss
it with their representative if they have one or with therr,
if they dontt have an attorney or don'f.get one, with:the
view to trying to amicably settle it. ·,If it ca~'t b~ amicably . ' .

a hearing on it.
COURT: The Court will call for a hearing if it i~
necessary. But the matter of fees i.s within· the determinc:tion
of this Court, unless there is some'part{cular reason for

pay a doctor bill made at Sewickley when Harry was·en-
titled to go to the Veterans and get his services there?

Why didn't they invest it in a sure thing, li~ 5%
guaranteed investments?

is done under the Act of. Assembly that is applicable ..
thereto. And they do it under the direction of the Court

Harry's that was in Ca~onsburg Mellon Bank. Now that
was the same outfit as this Washington Mellon Bank. why
was it necessary to have it transferred from Canonsburg
Meilon to Washington Mellon? I could see if it was in the
Union Bank or Nationar Bank, but if it's the same ~utfit,
couldn't that, bank 'guardian have be Em. lifted ·.without. the·

transfer of that account? They knew it was down in Canons-
burg and I was guarding it. Not a pennywas taken out.

stances of that case, that the money should be given over
. to the guardian of the incompetent. You say that you were
a guardian of his. But you were never appointed guardian,
as I recall it, by the Court. You were just acting as suet.
~ EVELYN MYRGO: Yes. 1&. 1&.
0 THE COURT: The Court decided that you had to-~officia~ ly
turn that money over to the guardian of the incompetent.
That-is why we made the order that we did.
~VELYN MYRGO: Why couldn't it have remained at C~nonsburg
Mellon? Was it necessary to have it brought up to Washington
Mellon?
THE COURT: It would make no difference. But the accolnt
~
had to be changed. The account couldn't be left in your
name. So whether it was in the Canonsburg Office or the
Washington Office wouldn't make any difference at all.
EVELYNMYRGO: That was the whole fight·about from '65
and itr:dragged on and on and on and that's one reason
. why George Stegenga is not here.

May, 1966, at that time he was competent and had no objections
to his choice of living quarters. After that change of
residence he visited this. office several times on different
matters and made no complaints of loneliness or dissatis-
faction with the Sewickley Home.11 I was asking him a
. question and this is what he ·answered me •. This is wrong in
this letter. He was not competent. And Mr·.· Parent says he
was competent.

TO THE HONORABLE, THE JUDGES OF SAID COURT:
I, EVELYN M. MYRGO, having been appointed on September 15, 1969,
Administratrix for the Estate of Harry W. Myrgo, who died August 27, 1969, as
evidenced by short certificate filed with you, do hereby acknowledge to have received
from Mellon National Bank and Trust Company, Guardian of the Estate of Harry W.
Myrgo, the sum of Two Thousand ($2, 000. 00) Dollars as an advance distribution of
assets being administered by you as guardian, and request Your Honorable Court to
charge the same to me in the Decree of Distribution to be entered in said Estate.
In consideration of this advancement being made prior to the filing and
audit of a Final Account, I hereby agree to refund on demand, all or any part of the
value thereof of this advancement which may be determined to have been improperly
made.
