KNOW ALL MEN BY THESE PRESENTS: Whereas, at Washington, in the County aforesaid
on the 17th day of March A. D. 19 67, before me,
Josephine M. Douglas , Register for the Probate of Wills and Granting
Letters of AdministratiQn in and for the County of Washington, in rhe Common wealth of Pennsylvania,
the last Will and Testament of
Anna s. Makula
late of Borough of Donora in the County aforesaid, deceased,
(a true copy whereof is to these presents annexed), was duly admitted to probate; and
Ann Bagay
the Executor m said Will and Testament named, having appeared before me and taken and subscribed
the oath of office prescribed by law;
NOW, THEREFORE, I, Josephine M. Douglas , Register as aforesaid; do
grant these LETTERS TESTAMENTARY, unto the said
Ann Bagay
committing unto her the administration of all and singular the goods and
chattels, rights and credits, which were of said deceased, and requiring her
to exhibit a true and perfect inventory thereof into the Register's Office, a~ Wa,shington, within ninety
days from the date hereof, and to render a just and true account of said administration at the expiration
of six months from the date hereof, and to regard and comply with the provisions of the laws of this
Commonwealth relating to inheritance taxes.

LAST WILL AND TESTAMENT
I, ANNA s. MAKULA, of the Borough of Donora, washington
County, Pennsylvania, being of sound and disposing mind and memory·, do
hereby make, publish and declare this to be my Last Will and Testament,
hereby revoking any and all former Wills or testamentary writings
heretofore made by me.
FIRST. I appoin·t Ann Bagay as Executrix of this, my Last
\!Jill and Testament. In tl1e event that for any reason Ann Bagay shall
not assume or continue in her office as Executrix, I appoint in }Jer
place or stead Hellon National Bank and Trust Company. I direct that
no bond shall be required of either of the appointees name·d in this
paragraph. I direct that my Executrix or Executor shall· employ the
services of Arnold W. Hirsch, 1\ttorney at Law, as attorney for my
estate. My Executrix or Executor·, in addition to the powers conferred
by law, shall have the power to sell at public or private sale, to
exchange or to lease, for any period of time, any real or personal
property, and t~ give options for sales, exchanges or leases, for such
prices and upon such terms or conditions as sl1e or it deems proper.
SECOND. I direct that all my just debts and funeral expenses
be fully paid and satisfied as soon as conveniently may be after my
death.
THIRD. I direct that I shall be buried by Rudolph R. Schwerha
funeral director, Donora, Pennsylvania, or his successor in business.

FOURTH. I give, devise and bequeath all my property, real,
personal and· mixed, wheresoever located and whetl1er acquired before or
after execution of this, my Last Will and Testament, to Vincent Makula,
my beloved grandson, and Ann. Bagay, whom I have raised since cl1ildhood.,
in equal shares, absolutely, and in fee simple.
FIFTH. If any minor shall be entitled to receive any property
by reason of my deatl1, whether under this Will or by the terms of any
insurance contract or otherwise, I appoint Mellon National Bank and
Trust Company guardian of the estate of said minor as to such property,
giving and granting to such guardian, in addition to and not in
limi·tation of all powers conferred by law, the following specific
powers, to be exercised in its sole discretion and without order of
court: to retain in kind any such property, real or personal, received
by it from any source; to sell any such property upon such terms and
conditions as it believes advisable, giving good title to any real
estate thus sold; to invest and reinvest in such stocks, bonds and o·ther
investments as it. deems advisable, without being limited to those
investments in which guardians are py law required to invest a minor's
funds;· and to disburse to or for the benefit ofsuch minor so much of
the income from and the principal of tl1e minor's said property as it
deems advisable for the minor's comfort, welfare, main·tenance, support
and complete education, including preparatory, college and post-graduate
or professional training.
SIXTH. I direct that all taxes that may be assessed in
consequence of my death, of whatever nature and by \vhatever jurisdiction
imposed, shall be paid from my residuary estate as a.part of the expense
of the administration of my estate.
SEVENTH. In construing the provisions of this, my Last Will
and Testament, use of the masculine, feminine and neuter genders shall
include the others; the singular shall include the plural and the plural

PETITION FOR PRIVATE SALE OF REAL EStATE UNDER
SECTION 5'+3 OF THE FIDUCIARIES ACT OF 1949

The Petition of Ann Baga.y respectfully represents that:
1. Anna s. Makula died testate March 9th, 1967. Letters
Testamentary were granted to Petitioner and the Will was probated
by the Register of Wills of Washington County in Will Book /t2~ ,
page~' on March 17th, 1967. A copy of said Will is
attached hereto, marked Exhibit A.
2. Decedent's Will devises all her estate in equal shares
to Ann (Mrs. John) Bagay, a foster daughter, who resides at 212
W~aver Avenue, Orchard Plan, Donora, Pennsylvania, and to Vincent
Anthony Makula, a minor grandson, who is presently in the United
States Air Force stationed in the Philippines. Mellon National
Bank and Trust Company, Washington Office, Washington, Pennsyl-
vania, had been appointed Guardian of the Estate of Vincent
Anthony Makula, a minor, by Order of the Orphans' Court of Wash-
ington County, Pen:nsylvania, at !ITo. 314 of 1960, O.C.
3. Your Petitioner files this Petition for Private Sale of
Real Estate in order to accomplish a judicial sale under Section
543 of the Fiduciaries Act of 19~9 in which the interest of the
minor beneficiary, the ~nterest of his Guardian, and the interests
of all other persons concerned will be. considered and dealt with.
4. Deceden~ owned the following two parcels of real estate
at the time of her death:
-(a). Lot No. 41, Block No. 52 of the Union Improve-
ment Company Plan of the Borough ot Donora, Washington
County, Pennsylvania, lying between Lots Nos. 40 and 42 in
Block No. 52 1 fronting on McKean Avenue 22 feet and running
back 100 feeti• having erected thereon a two story brick
apartment bui ding known as 938 McKean Avenue.
BEING the same premises conveyed to Anna Makula
by Deed of Andrew 1~kula, et ux.1 dated June 12th, 1947,
and recorded in Deed Book, Vol. y25, at page 383.
These premises, withg~age, have a monthly rental value of $96.00.
·· (b). Part Lot 64, Block No. 24, of the Union Improve-
ment Company Plan of the Borough of Donora, Washington
County, Pennsylvania, fronting 40.23 feet on Sixth Street,
lying between Allen Avenue and Wood Street, and running
back 89.07 feet on the easterly side and 93.39 feet on the
westerly side, and having a rear of ~0 feet;, having erected
thereon a two story frame dwelling known as ~67 Sixth Stree~.
BEING the same premises conveyed to Andrew Makula~
and Anna Makula1 his wife, by Deed of Joseph Wojcik, et ux.~
dated January l~th, 1924, and recorded in Washington County
Deed Book, Vol. 517, at page 200. The said Andrew Makula
died February 19th, 1956, and title to the premises vested
in his wife? the said Anna Makula, as surviving tenant by the entiret~es.
These premises have no rental value, having been
in a state of disrepair and vacant since decedent's death.
This is the parcel of real estate which Petitioner desires to sell.
5. No real estate of the decedent has been sold without
petition to the Court.
6. There is attached hereto, marked Exhibit B, an official
certificate of assessed valuation of the property proposed to be
sold. Also attached is a copy of the Inventory, as officially
filed, marked Exhibit c.
7. Petitioner knows of no outstanding debts of decedent
or liens of record.
8. Petitioner has entered into an Agreement of Sale with
John Marconyak and Amelia Marconyak, his wife, of the Borough of
Donora, Washington County, Pennsylvania, for the private sale of
the real estate hereinbefore described in paragraph 4 (b), for the
sum of One Thousand One Hundred ($1,100.00) Dollars in cash,
subject to the approval of your Honorable Court; the original of
said Agreement of Sale containing the detailed terms is attached
hereto, marked Exhibit D.
9. Petitioner believes that One Thousand One Hundred
($1,100.00) Dollars is a full and fair price for said premises,
and a better price than can be obtained at a:public sale. The
affidavits by two competent persons required by law and the Rules
of Court are attached hereto as Exhibits E and F.
WHEREFORE, your Petitioner prays your Honorable Court,
under Section 5~3 of the Fiduciaries Act of 19~9, for authority
to make private sale of the aforesaid premises.

Between the ESTATE OF ANNA S. MAKULA, by Ann Bagay, Executrix,
(hereinafter called "Seller") and
JOHN MARCONYAK and AMELIA MAR<;:ONYAK, his wife, (hereinafter called "Buyer") ,
WITNESSETH, that for the consideratio~ herein'a.fter s~t forth and intending to be legally bound the Seller and
Buyer mutually agree as follows:
1. Seller agrees to sell and convey to buyer on or before 60 days from date of these presents
by special warranty deed in fee simple absolute, clear of all mortgages, judgment liens
and tax liens and other encumberances affecting its marketability (except as hereinafter set forth) all the real property
described in Paragraph 7 hereof.
2. Buyer agrees to purchase said real property and to pay Seller therefor the sl.).m of One Thousand .
One Hundred and No/100 - - - - -($ 1 ,100. 00 ) Dollars as follows: One Hundr~d ($100. 00)
Dollars on the date of execution of these presents, the receipt whereof is hereby
acknowledged,_and'the balance, or the sum of One Thousand ($1,000.00) Dollars,
on the date of settlement.
3. Possession shall be given on settlement date ~ ·,·and settlement shall be made
at the office of Seller's attorney on or before 60 days ~ from the date of
these presents.
4. At settlement Seller shall pay for or be charged with the cost of all federal documentary taxes and
state and local realty transfer taxes payable upon this transaction, but real estate taxes for year of settlement, sewer
charges and rents and royalties shall be prorated on a calendar year basis between Seller and Buyer as of date of
delivery of possession of the premises; except as hereinafter set forth: Buyer shall pay local realty
transfer taxes.
5. From and after the date of. this agreement, insurance shall be provided and paid for as follows:
Buyer shall obtain insurance to protect interests of seller and buyer.
6. Time is not of the essence of this Agreement.
7. The real property which is the subject of this Agreement is described as follows:
ALL that certain piece or parcel of land, lying in the town of Donora, washington
County, State of Pennsylvania, and described as follows:
Part of Lot number Sixty-four (64) in Block number Twenty-four (24) lying between
Allen Avenue and Wood Street, fronting on Sixth Street, 40.23 feet, .and running
.back 89.07 feet on the easterly side and 93.39 feet on the westerly side, and
having a rear of forty (40) feet. ·
Excepting and reserving all the natural gas and oil underlying said land, but
nd wells shall be drilled on the same for either.
BEING the same piece .or parcel of land conveyed to Andrew Makula and Anna Makula,
his wife, by deed of Joseph Wojcik and Maryanna Wojcik, his wife, dated the 19th
day of January, 1924, and recorded in the Recorder's Office of Washington County,
on January 23rd., 1924, in Deed Book Volume 517, page 200. The said Andrew Makula
died on February.l9th, 1956, and title to the premises vested in Anna Makula, his
wife, by reason of sur.vivorship. The said Anna Makula died on March 9th, 1967,
and by her Last Will and Testament,'.recorded in Washington·County Will Book
page · · , devised all of her property to Vincent Makula an9. Ann Bagay, ~

Arnold W. Hirsch, Attorney for Ann Bagay, Executrix of the Estate
of Anna S. Makula, Deceased, respectfully represents:
1. That under date of October 20th, 1969, he presented to your
Honorable Court at the above number a Petition for Private Sale of Real
Estate, the said real estate being part of Lot 64, in Block 24, of the
Union Improvement Company·,r:s Plan of the Borough of Donora, Washington
County, Pennsylvania.
2. Your Honorable Court, on said date, fixed Monday, Npvember
17th, 1969, at 10:00 o'clock, A.M., in the Orphans 1 Court Room at the
Washington County Court House as the time and place for hearing on the
Petition and the consideration of the confirmation of the proposed sale
of real estate, and directed that notice of the said hearing be given by
publication in accordance with the requirements of the Rules of Court.
3. Your Petitioner caused notice, in accordance with the Rules
of Court, to be published in The Dail¥ .Republican, a newspaper of genera
circulation, and in the Washington County Reports, the first of said
publications appearing more than twenty-one days prior to the date fixed
for hearing. The proofs of publication are attached hereto and made a
part hereof, marked Exhibit nAn.
4. In accordance with the Rules of Court, your Petitioner caused
written notice to be given by posting five handbills, one of which was
posted in a conspicuous place on the real estate proposed to be sold,
and the others in prominent places in the vicinity of such real estate.
The said handbills were posted by y~ur Petitioner on November lst,l969,
which date was more than ten days prior to the date fixedufor hearing.
There is attached hereto, marked Exhibit nBn, a copy of said handbill.
5. Notice was provided all parties in interest in the following
manner:
Ann Bagay, one of the parties in interest, is the Petitioner
herein and requires no additional notice;
Vincent Anthony Makula, a minor whose Guardian is Mellon
National Bank and Trust Company, received notice by the acceptance of

There areno problems. There is some cash plus a piece of real es ate
in the estate. The two devisees of there al estate have. the two
beneficiaries of the estate have signed elections to take the real
· estate in kind. The only claim against the estate is one by mY,se
for $2. 00. The Prothonotary erroneously charged me a dollar
for a Certificate of Liens and it was really $3. 00, which I paid in
cash today. The Certificates of Liens accompany these papers
since a piece of real estate was sold by the Executor.
