PETITION FOR APPOINTMENT OF GUARDIAN
TO THE HONORABLE, P. V. MARINO, President Judge of said Court:
The petition of ANNA E. SHEPPARD, parent of ch.arles
Sheppard, a minor, respectfully represents:
1. That your petitioner is the parent of CHARLES
SHEPPARID, a minor si,x years of age who resides with your
petitioner at 308 Jones Avenue, Canonsburg, Pennsylvania.
2. That the said CHARLES SHEPPARD was born on
April 2, 1963.
3. That CHARLES SHEPPARD was injured as a result of
an explosion which occurred on March 11, 1967, from that occur-
renee your petitioner filed suit in the Court of Common Pleas
of washington County, Pennsylvania, Civil Action-Law at
Number 290 September Term 1968 A.D.
4. That prior to the trial the suit was settled and
after bills, costs and fees are paid the above named minor will
receive the sum of $10,450.00.
5. That the settlement referred to hereinabove was .
approved by the Court of common Pleas and by order dated
November 13, 1969.
6. Your petitioner desires that your Honorable court
make the necessary Order to appoint Pittsburgh National Bank
as guardian of the estate of Charles Sheppard and ·to allow
the guardian to receive the sum set forth above.
7. That the said Charles Sheppard has no other estat
or property in his name except the above mentioned money.
8. That the proposed guardian has no interest advers
to the said minor and is not the fiduciary, or an officer, or
employee, or the corporate fiduciary of any estate in which
the said minor has an interest.
WHEREFORE, your petitioner prays your Honorable Court
that Pittsburgh National Bank be appointed as guardian of the
estate of charles Sheppard, a minor, so that it may have and
receive the aforesaid money to be held for the said minor until
his majority.

Sheppard, a minor, to receive monies due him from the settlement
of a suit at Number 290 September Term 1968 A.D. in the Court
of Common Pleas of washington County, and any monies due him
during his minority.

To the Honorable P. v. Marino, Presiding Judge of the said court:
The Petition of PITTSBURGH NATIONAL BANK respectfully
represents:
1. That your petitioner was appointed guardian of the
above named minor on November 26, 1969.
2. That the said minor was born April 2, 1963 and is
now 7 years of age.
3. That the guardian account held by your petitioner
is made up of proceeds from a recovery made on behalf of the said
minor from injuries received by him arising out of a civil claim.
4. That your petitioner has in its guardian account
investments at a cost of $10,418.52 and uninvested cash in the
amount of $387.68.
5. That your petitioner has received a statement from
The Western Pennsylvania Hospital in the amount of $713.95, which
represents a bill for services rendered the above named minor.
A copy of the said statement is attached hereto and made a part

6. 'fuat Ann Sheppard, mother of the above named minor
is not able to make payment of the said bill and requests it to
be paid from this account.
WHEREFORE your petitioner prays your Honorable court to
authorize and direct it to pay the sum of $713.95 to The Western
Pennsylvania Hospital for services rendered by that hospital
to the said minor, Charles Sheppard.

received a request made by the mother of the minor, Charles
Sheppard for a special allowance for winter clothing in
the amount of $100.00, for the minor Chales Sheppard and
it further being represented to the Cour~ that the mother
is unable to financially provide for this item of expense;
and whereas the Guardian Bank has in the guardian account
investments at a cost of $9,625.95 and uninvested cash
in the sum of $183.68;
IT IS HEREBY ORDERED, ADJUDGED AND DECREED, that
Pittsburgh National Bank, Guardian of the within estate, be
and is hereby authorized and directed to pay over to The
Western Pennsyilivania Hospital the sum of $908.95 and
Western Pennsylvania Anesthesia Associate's Ltd., the sum
of $56.00 for the services rendered to the said minor,
Charles Sheppard .and further the said Guardian Bank is
authorized and directed to pay the sum of $100.00 to Anna
E. Sheppard, mother of the said minor, Charles Sheppard,
for clothing allowance.

Washington, Washington County, Pennsylvania.
4. A settlement was made in the above-suit in the
amount of Ten thousand four hundred fifty ($10,450) Dollars,
said amount being deposited in Pittsburgh National Bank, with
instructions not to be distributed until the minor reaches 18
years of age or unless a Court Order is p~esented.
5. At the present time, the petitioner herein is
under doctor's care in Canonsburg, Washington County,
Pennsylvania, and the minor herein, Charles Sheppard, is em-
ployed in Washington, Washington County, Pennsylvania. As no
transportation is available to either the petitioner or the
minor herein, the petitioner respectfully requests that the
amount of Five hundred fifty' ($·550): Dollars be g.ranted to her for
the purpose of allowing the minor herein, Charles Sheppard, to
purchase an automobile to be used by said minor to provide
transportation for your petitioner to go to and from the doctor,
to obtain groceries and other necessities needed for their
liv~lihood, ~nd to pr6vide the minor herein with transpdrtation
to and from his place of employment.
WHEREFORE, your Petitioner prays that your Honorable
Court allow Five hundred fifty ($550) Dollars to be ·withdrawn fro'

5. A Petition for Allowance was granted to this
Court and an Order thereon was entered on January 15, 1980,
ordering that the sum of Five hundred fifty ($550) Dollars be
withdrawn from Pittsburgh National Bank to be delivered to the
Petitioner, Anna Sheppard, for the benefit of Charles Sheppard,
a copy of said Order being attached hereto and marked as
"Exhibit A".
6. Said check was issued to the Petitioner herein
pursuant to said Order on January 25, 1980, a copy of said
check being attached hereto and marked as "Exhibit B".
7. Due to the fact that the minor named herein,
Charles Sheppard, has been unable to obtain motorvehicle lia-
bility insurance, the Petitioner herein respectfully requests
that Pittsburgh National Bank be ordered to redeposit the Five
hundred fifty ($550) Dollars in the minor's trust account for
future use of the minor, Charles Sheppard.
8. The Petitioner herein further requests that said
guardian, Pittsburgh National Bank, issue unto Rosenberg, Sewak
& Pizzi, the amount of One hundred fifty ($150) Dollars for fees
and costs for preparation of the prior and present Petitions.
WHEREFORE, your Petitioner prays that your Honorable
Court allow Five hundred fifty ($550) Dollars to be redeposited
in Pittsburgh National Bank to be used for the future use of the
minor, Charles Sheppard, and that said Pittsburgh National Bank
issue to Rosenberg, Sewak & Pizzi the sum of One hundred fifty
($150) Dollars for fees and costs for preparation of prior and

dated November 14, 1969, appointed Pittsburgh National Bank as
the guardian of the estate of Charles Sheppard, a minor.
5. At the present time, the petitioner herein is under
doctor's care in Canonsburg, washington County, Pennsylvania,
and the minor herein, Charles Sheppard, is employed in
washington, washington County, Pennsylvania. As no transportatior
is available to either the petitioner or to the minor herein,
the petitioner respectfully requests that the amount of ti~e
hundred ($500.00) Dollars be granted to her for the purpose of
allowing the minor herein, Charles Sheppard, to purchase an
automobile to be used by said minor to provide transportation
for your petitioner to go to and from the doctor, to obtain
groceries and other necessities needed for their livelihood and
to provide the minor herein with transportation to and from his

6. That your petitioner had previously caused to be
presented to this Court a Petition for Allowance for the said
sum of $550.00 and an Order of this Court was entered on
January 15, 1980, permitting payment of the sum of $550.00 to
be paid and delivered to your petitioner for the benefit of
Charles Sheppard. That a check was issued to the petitioner,
pursuant to an Order of this Court dated January 25, 1980, howeve~,
due to the fact the minor, Charles Sheppard, has been unable to
obtain motor vehicle liability insurance, your petitioner re-
quested that the sum of $550.00 be redeposited in said Charles
Sheppard's trust account. This Honorable Court, upon consideratiJn
of the petition for redeposit, entered an Order dated February 6,

1980, directing that the sum of $550.00 be redeposited with the
Pittsburgh National Bank, the guardian of the said Charles
Sheppard.
7. That your petitioner avers that the said Charles Sheppard
is able to obtain motor vehicle liability insurance for the
vehicle he intends to purchase and there is attached hereto as
"Exhibit A", a letter of Mr. John N. Dugan reflecting that a motor
vehicle liability policy can be obtained.
8. There is attached hereto a letter request of your
petitioner and minor, Charles Sheppard, and marked "Exhibit B",
requesting the sum of $500.00.
9. The Petitioner herein further requests that the guardian
bank make payment to Rosenberg, Sewak & Pizzi in the sum of
One hundred ($100.00) Dollars as attorney fees and costs for
preparation and presentation of the Petition for allowance.
WHEREFORE, your Petitioner prays your Honorable Court to
direct Pittsburgh National Bank, Guardian of the Estate of Charles

PETITION FOR ALLmvANCE
TO THE HONORABLE, THE JUDGES OF SAID COURT:
' AND NOW, comes ANNA SHEPPARD, Petitioner, through her
attorneys, ROSENBERG, SEWAK & PIZZI, P.C., and petitions the
Court, as follows:
1. Your Petitioner, Anna Sheppard, is the parent and
natural guardian of the minor, Charles Sheppard.
2. Said minor, Charles Sheppard, was injured as a
result of an accident which occurred on March 11, 1967, and
your petitioner herein filed suit on behalf of said minor in
the Court of Conm1on Pleas of Washington County, Pennsylvania, in
Number 290, September Term, 1968, A.D.
3. The minor child was born on April 2, ~963 and is
now 17 years of age. He resides ·with his mother, the petitioner
herein, Anna Sheppard, 602 Valley View Terrace, Canonsburg,
Washington County, Pennsylvania.
4. A settlement was made in the above suit in the
amount of Ten thousand four hundred fifty ($10,450.00) Dollars,
said amount being deposited in Pittsburgh National Bank, with
instructions not to be distributed until the minor reaches 18
years of age or unless a Court Order is presented. This

Honorable Court by Order dated November 14, 1969, appointed
Pittsburgh National Bank as the guardian of the estate of
Charles Sheppard, a minor.
5. Charles Sheppard, the minor, is requesting
the sum of Three thousand five hundred ($3,500.00) Dollars to
purchase a horse and attempt to go into business for himself.
It is represented to the Court by your Petitioner and Charles
Sheppard, the minor, that Charles has been working at The
Meadows with his brother who is the owner of horses at The
Headows. The information set forth in this paragraph is
substaniated by two letters one addressed to Hrs. Stuedler
of Pittsburgh National Bank and Mr. Sewak, Attorney for the
Petitioner. Those are marked respectively Exhibit A and
Exhibit B.
6. As of s.eptember 10, 1980, the said minor's
estate presently consists of:

The funds are only avail~ble quarterly from the
common fund and no funds will be available until after November
10 in the event the court issues an Order authorizing the payment
of Three thousand five hundred ($3,500.00) Dollars which the minor,
Charles Sheppard, is requesting.
7. Pittsburgh National Bank, Guardian of the Estate
of Charles Sheppard, a minor, will consent to whatever Order the
Court enters in this request.

8. The Petitioner herein further requests that
the Guardian Bank make payment to Rosenberg, Sewak & Pizzi, P.C.
in the sum of One hundred twenty five ($125. 00) Dollars as
attorney fee for legal services rendered in the telephone con-
ferences, preparation and presentation of the Petition for the
Allowance.
~·JHEREFORE, your Petitioner prays your Honorable
Court to direct Pittsburgh National Bank, Guardian of the Estate
of Charles Sheppard, a minor, to pay the sum of Three thousand
five hundred ($3,500.00) Dollars to your Petitioner on behalf
of Charles Sheppard, a minor, and further, that the said Pittsburgh
National Bank make payment of the sum of One Hundred Twenty five ·
($125.00) Dollars to Rosenberg, Sewak & Pizzi, P.C. for attorney
fees.

ORDER
AND NOW, this 24th day of November, 1980, upon hearing
before the Court and testimony offered by Mrs. Anna Sheppard,
the mother, his brother, Rodney Sheppard, and the minor himself,
the Court hereby determines that the purch~se of the horse for
investment purposes due to the minor being unable to secure
a job r~sulting from the disability of his hands and being
unlikely to further his education otherwise, the prayer of the ,.

petition is approved. It is ordered and decreed that the
Pittsburgh National Bank, guardian of the Estate of Charles
Sheppard, a minor, is hereby directed to pay to the petitioner,

Anna Sheppard, the sum of $3500.00. This amount is to be used
solely for the use and benefit of Charles Sheppard, a minor,
