PETITION FOR FAMILY EXEMPTION
UNDER SECTION 211 OF THE FIDUCIARY'S ACT
OF APRIL 18 1 1949 1 P.L. 512
TO THE HONORABLE P. V. MARINO, PRESIDENT JUDGE OF SAID COURT:
The Petition of GOLDIE E. JENKINS respectfully
represents:
1. Your Petitioner is the wife of ELMER s. JENKINS,
decedent.
2. The said ELMER s. JENKINS died June 15, 1969,
intestate, survived by your Petitioner, his widow, and one adult
son, who is married and living apart from the family domicile.
3. The only item in the estate of said ELMER s. JENKINS
is a two-thirds interest in a one-eighth royalty interest on two
oil and gas leases, as follows:
a. The Elliott Brothers farm, situate in North
Fayette Township, Allegheny County, Pennsylvania, consisting of
90 acres; said lease being recorded in the Recorder's Office of
Allegheny County, Pennsylvania in Deed Book Volume 1372, page 556,
and,
b. The Sam Sturgeon Heirs farm, situate in North
Fayette Township, Allegheny County, Pennsylvania, consisti.Dg_:of
110 acres; said lease being recorded in the Recorder's Office of
Allegheny County, Pennsylvania in Deed look Volume 1995, page 102.

The total royalty received on both of said leases for
the entire year of 1968 was $71.40. Attached hereto and made a
part hereof is an appraisal by B. E. Bell, Associated Producer,
Manager and Advisor, for and with Pennzoil United and Waverly Oil
Works Company, in which the said B. E. Bell appraises the entire
one-eighth royalty for $1,000.00 and on which a two-thirds
interest would be approximately $666.67.
4. The marital relationship was maintained between your
Petitioner and the decedent, ELMER s. JENKINS, until the day of
his death.
5. All the bills pertaining to the last illness and
death of the said ELMER s. JENKINS have been paid by your
Petitioner, ·including the decedent's funeral bill.
6. Your Petitioner is advised that under the above-
named family exemption provision of the Fiduciary's Act of 1949
as amended, she will be entitled to a family exemption up to and
including the sum of $1,000.00, and does hereby make claim for the
said iaterest in oil and gas leases in the appraised amount of
$666.67.
Your Petitioner therefore prays your Honorable Court
pursuant to said Section 211 of the Fiduciary's Act of April 18,
1949, P.L. 512, as amended, to make an order awarding said interes
in oil and gas leases to her as above described.

To whom it may concern:
Re: to the value of the one eighth (1/8) royalty of the Oil
and Gas under two farms in North Fayette Township, Allegheny
County, State of Pennsylvania containing two hundred (200)
acres more or less, Farms being known as Elliott Bros. and
Sam Sturgeon Heirs.
The said one eighth (1/8) royalty is not subject to any lease
but is owned outright, even if the present leases were to be
surrendered.
Therefore in appraising, the value of the said royalty is higher
than the current production warrants.
MY suggested Value of the full one eighth (1/8) royalty under
the two farms mentioned is one-thousand dollars ($1,000.00).
As the royalty under the two farms mentj_oned is owned by three
parties, therefore the Value of each interest would be what
portion of the one eighth (1/8) they owned.

within Petition for Family Exemption having been presented in
open Court, the same is hereby ordered filed, and upon motion of
JOSEPH c. RALSTON, ESQ., Attorney for the Petitioner, the two-
thirds interest in a one-eighth royalty of the oil and gas under
two farms situate in North Fayette Township, Allegheny County,
Pennsylvania, designated as follows:
1. The Elliott Brothers farm, situate in North
Fayette Township, Allegheny County, Pennsylvania, consisting of
90 acres; said lease being recorded in the Recorder's Office of
Allegheny County, Pennsylvania in Deed Book Volume 1372, page 556,
and,
2. The Sam Sturgeon Heirs farm, situate in Borth
Fayette Township, Allegheny County, Pennsylvania, coneisting of
110 acres; said lease being recorded in the Recorder's Office of
Allegheny County, Pennsylvania in Deed Book Volume 1995, page 102.
are hereby awarded to GOLDIE E. JENKINS, on account of her Family
Exemption; and this Order of Court is hereby directed to be filed
in the Recorder's Office of Allegheny County, Pennsylvania to
evidence an assignment of the interest of said ELMER s. JENKINS,
Deceased, to GOLDIE E. JERKIRS.
