SECOND: That in such capacity your petitioner became interested in the case of' one Roxie Clark, a colored woman.., of Donora, Pa .. , ' against whom an information had been made for disturbance of a chu~ch meeting, at which hearing it appeared that the said Roxie ~ Clark was mentally deficient, and was, through the instrumentality ~ of your petitioner's association, remanded to the Washington County ~ jail by authority of the investigation of two physicians of Donoral ~~ ~ Pa. under the Mental Health Act, and she.is~ to the best of' your ~ petitioner's knowledge, now an inmate of the Washington County jail. il THIRD: That the only 11 ving relatives and next of kin of' the li said Roxie Clark w1 thin the State of Pennsylvania, who are known fl ,j I' ' il ! I ' 11 •· 'I t ij ~ to your pet1 tioner, are her husband, Ja.mes Clark, who re- sides at Donora, Pa.~d a son by a prior marriage, who also re- sides at Donora, Pa. and whose name i.e Trevellyn Slade, both of whom are of age and otherwise sui juris. FOURTH: That neither the said husband nor the eon are willing or !' r able to present this petit ion to the Court. I : FIFTH: That. at the time of the arrest of the said Roxie Clark on the charge of disturbing the church worship at Donora, Pa., she ,, II had in her possession a pocketbook. in which there was in cash the ~~ sum of $ 1,151. 6g , which money was exchanged at the Union :: National Bank· of Donora, Pa. for a Cashier 1 s check, which is now l! in the possession of your petitioner. ' 11 SIXTH: That the said Roxie Clark is of such mental condition that ,I II I I' I' ~ She is unable to care for her property, is liable to dissipate and lose the same or become the victim of designing persons, and, be- cause of such condition, your petitioner believes that it is necessary that a guardian be appointed to properly care for and handle the personal estate above recited. SEVENTH: That, so far as your petitioner is able to learn, the personal estate above recited is the only estate possessed by the said Roxie Clark1 although it is possible tha.t she may have an interest in a piece of real estate in which she has been residing at Donora, Pa., but, from the information which your petitioner has been able to procure, it is doubtful whether she has any inter- est in such property. Risbeck, being duly s~rorn according to law, deposes and says that he is the Constable of the Borough of Donora, Pa., and that on December 24,1945, at g:45 A.M., he personally served on Trevellyn Sla.de, son of Roxie Clark, at Fourth Street & Thompso Avenue, Donora, Pn., a copy of the petition filed in the above ceedings, together with a formal notice of hearing in the form hereto attached, marked exhibit 11A11 and made n part hereof. Barry Anderson, and respectfully represents: 1. That your Petitioner is the Western Pennsylvania National Bank, a national banking corporation duly incorporated and authorized to transact business as a national bank under the acts of Congress, with its principal place of business located at 236 Fifth Avenue, McKeesport, Pennsylvania. 2. That your Petitioner is the Guardian of the Estate of Roxie Clark, an incompetent person. 3. That your Petitioner is the successor to the First National Bank of Monongahela, Pennsylvania, and is the successor Guardian of the Estate of Roxie Clark, incompetent, under appointment of the Court of Common Pleas of Washington County, Pennsylvania, at No. 4459 In Equity, made and entered the 14th day of January, 1946. 4. That upon qualifying, as required by law, the Petitioner entered upon its duties as such Guardian and, thereafter, has been and is now acting as such fiduciary. 5. That the said Roxie Clark, incompetent, has for many years been confined in the Torrance State Hospital, located at Torrance, Pennsylvania, and is now residing therein and is likely to be confined to Torrance State Hospital the remainder of her life. 6. That your Petitioner, at the present time, has in its possession, investments of Six Hundred Fifty Dollars ($650. 00) consisting of a savings account in the Dollar Savings Bank of Pittsburgh; uninvested principal cash of Two Thousand, Six Hundred Eighty-four and 51/100 Dollars {$2, 684. 51), and accumulated income of Sixty-six and 33/100 Dollars ($66. 33) 7. That your Petitioner is receiving, on behalf of the said Roxie Clark, incompetent, Social Security benefits in the amount of Fifty-four Dollars ($54. 00) per month and Veteran's Administration Benefits in the amount of Seventy-five Dollars {$75. 00} per month. Notice of the request for allowance by this Petition has been given to the United States Veterans Administration by United States Mail; a copy of same is marked "Exhibit A", is attached hereto and made a part hereof. 8. That the Commonwealth of Pennsylvania claims, as a creditor, the amount of Fourteen Thousand, Eight Hundred Seventy-four and 38/100 Dollars ($14 874. 38) for the care of Roxie Clark, incompetent, at Torrance State Hospital. A certified statement, marked "Exhibit B" is attached hereto and made a part hereof. 9. That your Petitioner is desirous of paying from the funds in its control, the sum of Two Thousand Dollars ($2, 000. 00) to the Torrance State Hospital on account of the present indebte~ness, and the sum of One Hundred Dollars ($100. 00) per month thereafter for the current maintenance and care of the said incompetent. 10. That your Petitioner also offers to set aside the sum of Six Hundred Dollars ($600. 00) to establish a burial fund for Roxie Clark, incompetent, and a further sum for the incompetent's Patient's Fund Account so as to provide the incompetent with incidental items of expense while a resident of the institution, such sums to be added to from time to time as the hospital may request. 11. That upon information and belief, the only next of kin of said incompetent, who is or might be interested in this application, is one Trevellyn Slade, a son by a previous marriage, whose whereabouts is unknown. 12. That no previous application has been made for the relief herein sought. WHEREFORE, your Petitioner requests the Court, pursuant to Sec. 644 of the Act of February 28, 1956, P. L. (1955) 1154, as amended by the Act of July 11, 1957, P. L. 794, Sec. 1, 50 P. S., Sec. 3644, to . . allow the payment of the claim of the Torrance State Hospital, upon the terms and conditions above set forth', and that notice .'of this application be given to such persons as the Court may direct. PETITION FOR DISTRIBUTION TO THE HONORABLE, THE JUDGES OF SAID COURT: The Petition of Western Pennsylvania National Bank, Guardian of the Estate of Roxie Clark, an incompetent respectfully represents: 1. The First National Bank of Monongahela was appointed Guardian of the Estate of Roxie Clark in the court of Common Pleas of Washington County on January 14, 1946 at No. 4459 in Equity. Western Pennsylvania National Bank by virtue of a merger became successor guardian. This account was transferred to the Orphans' Court of Washington County, October 15, 1969, No. 1160 of 1969. 2. Roxie Clark died June 29, 1969 at Torrance State Hospital. She had been admitted to Torrance State Hospital on December 5, 1945. 3. There is due and owing Torrance State Hospital a balance of $17,656.23 per certified statement attached and marked Exhibit "A". 4. Petitioner filed its First and Final Account with the Clerk of your Honorable Court on March 10, 1970 and notice of the filing of the account and of the time and place of audit has been given to the Revenue Agent, Torrance State Hospital, Mrs. Emma Stewart, sister, 2306 Center Ave., Pittsburgh, Pa. 15219 and Mr. Carl DeCoursey, brother through his attorney Arnold W. Hirsch, P. 0. Box 341, Donora, Pa. 15033. 5. Your petitioner is not acting in a dual fiduciary capacity. 6. The incompetent was not and never was a member of the Armed Forces of the United States of America, nor entitled to benefits from the Veterans Administration of the United States of America and there are no parties in interest in the military service of the United States of America. WHEREFORE, your petitioner requests that your Honorable Court confirm the account as filed and that the sum of $135.00 be paid to Mr. W. P~ Murray, 49 East Market St., Blairsville, Pa. 15717 for the erection of a grave marker, the foundation and labor costs. Although Torrance State Hospital received a distribution on account from the Guardian of the incompetent estate, no claim has been made to the Petitionerfur the balance due to the Commonwealth. 7. Petitioner has entered into an Agreement of Sale with Emma L. Stewart of 2306 Center Avenue, Pittsburgh, Pennsylvania, .for the private sale of the share of real estate hereinbefore described in paragraph 3, for the sum of $800.00 in cash, subject to the approval of your Honorable Court; the original of said Agreement of Sale containing the detailed terms is attached hereto, marked Exhibit C. 8. Your Honorable Court, on said date, fixed Monday, July 19th, 1971, at 10:00 o'clock, A.M., in the Orphans' Court Room at the Washingt n County Court House as the time and place for hearing on the Petition and the consideration of the confirmation of the proposed sale of real estat , and directed that notice of the said hearing be given by publication in accordance with the requirements of the Rules of Court. 3. Your Petitioner caused notice, in accordance with the Rules of Court, to be published in The Daily Herald, a newspaper of general circu lation, and in the washington County Reports, the first of said publica- tions appearing more than twenty-one days prior to the date fixed for hearing.
