PETITION FOR GUARDIAN
To the Honorable, the Judges of said Court:
The petition of Cora Vernon) Secretary of the Donora
' Welfe.re Board, respectfully represents:
t FIRST: That your petitioner is the duly employed and acting Secre-
ll
1! tary of an unincorporated association of Donora, Pa. known as the ,,
~ Donora Welfare Board, which is~ inter alia, engaged in looking
' art er the welfare of the Citizens of Donora and particularly those
Who are neglected by persons legally obligated to care for them.
SECOND: That in such capacity your petitioner became interested
in the case of' one Roxie Clark, a colored woman.., of Donora, Pa .. ,

against whom an information had been made for disturbance of a
chu~ch meeting, at which hearing it appeared that the said Roxie
~ Clark was mentally deficient, and was, through the instrumentality
~ of your petitioner's association, remanded to the Washington County
~ jail by authority of the investigation of two physicians of Donoral
~~ ~ Pa. under the Mental Health Act, and she.is~ to the best of' your
~ petitioner's knowledge, now an inmate of the Washington County jail.

FOURTH: That neither the said husband nor the eon are willing or

r able to present this petit ion to the Court.

: FIFTH: That. at the time of the arrest of the said Roxie Clark on
the charge of disturbing the church worship at Donora, Pa., she

II had in her possession a pocketbook. in which there was in cash the
~~ sum of $ 1,151. 6g , which money was exchanged at the Union
:: National Bank· of Donora, Pa. for a Cashier 1 s check, which is now
l! in the possession of your petitioner.
' 11 SIXTH: That the said Roxie Clark is of such mental condition that

She is unable to care for her property, is liable to dissipate and
lose the same or become the victim of designing persons, and, be-
cause of such condition, your petitioner believes that it is
necessary that a guardian be appointed to properly care for and
handle the personal estate above recited.
SEVENTH: That, so far as your petitioner is able to learn, the
personal estate above recited is the only estate possessed by the
said Roxie Clark1 although it is possible tha.t she may have an
interest in a piece of real estate in which she has been residing
at Donora, Pa., but, from the information which your petitioner
has been able to procure, it is doubtful whether she has any inter-
est in such property.
Your petitioner, therefore, respectfUlly prays your
Honorable Court, under and by virtue of the authority of the Acts

and says that he is the Constable of the Borough of Donora, Pa.,
and that on December 24,1945, at g:45 A.M., he personally served
on Trevellyn Sla.de, son of Roxie Clark, at Fourth Street & Thompso
Avenue, Donora, Pn., a copy of the petition filed in the above
ceedings, together with a formal notice of hearing in the form
hereto attached, marked exhibit 11A11 and made n part hereof.
Deponent further avers that at 12:00 noon on December 27,
' 1945, he also served a copy of such notice, together with a copy
1 of the petition filed in such ma.tter, upon James Clark, husband of
the sa.id Roxie Clark, at the resid.ence of his brother, Golden F.

DECREE
AND NOW, April ;t~~ 19ll-6, the foregoing petition
having been presented to the Cour·t, and it appeBring that the said
Roxie Clark will in all probabilities be confined at Torrance Stat
Hospital for the remainder of her life, and thBt the charges made
by such institution for her maintenance are reasonable and should
be paid at intervals as bills are presented to her guardian; there
fore, it is ORDERED AND DECREED that the guardian at this time pay
to the State Hospital at Torrance the amount due and owing for
maintenance of its ward for January and February, 1946, to wit, the
sum of $54 .. 90, and. that it continue to pay for the future mainten-
ance of its ward as bills are presented to it, 'lr'ithout further
order of this Court, until the funds in its hands have been reduc·e
to .the sum of $300.00, which amount sruul be reserved by tbe
guardian to defray the burial and funeral expenses of its said
ward and the settling of her estate.
It is further ordered that the guardian be allowed
credit in any future accounting for the sums here authorized to be
disbursed, together with reasonable costs of the filing of this
petition and an a.ttested copy of this decree,and counsel fees for
the preparation and presentation of this petition in the sum of

PETITION FOR AUTHORITY TO PAY COSTS RE: APPOINTMENT
To the Honorable) the Judges of said Court:
The petition of The First National Bank of Monongahela,
Pa., by its undersigned Trust Officer, respectfully represents:
FIRST: That your petitioner is the duly appointed and acting
guardian of the estate of Roxie Clark, a weak minded person.
SECOND: That the assets of such estate in the hands of your peti-
tioner consist of the sum of $1,151.6g in cash.
THIRD: That in the appointment of your petitioner as guardian the
firm of Anderson & Anderson, of Donora, Pa., acted as counsel at
the request of the Donora Welfare Board, and such firm has requested
your petitioner to pay to it from the funds in its hands a counsel
fee of $75.00; record costs of $31. 75; the sum of $20.00 which it
paid to w. B. Risbeck, Constable, for serving copies of the pro-
ceedings and notice of hearing upon the husband and. son of Roxie
Clark, at Dpnora, Pa., upon the said Roxie Clark and the Superin-
tendent of the Torra.nce State Hospital, at Torrance, Pa., and upon
the Revenue Agent of the Commonwealth of Pennsylvania at Torrance,
Pa.; and that your petitioner also pay to the persons named the
following additional amounts:

PETITION UNDER SECTION 644 OF THE
INCOMPETENTS ESTATES ACT OF 1955
To the Honorable Judge of said Court:
AND NOW comes your Petitioner, by its Attorney, S. Barry
Anderson, and respectfully represents:
1. That your Petitioner is the Western Pennsylvania National
Bank, a national banking corporation duly incorporated and authorized to
transact business as a national bank under the acts of Congress, with its
principal place of business located at 236 Fifth Avenue, McKeesport,
Pennsylvania.
2. That your Petitioner is the Guardian of the Estate of
Roxie Clark, an incompetent person.
3. That your Petitioner is the successor to the First
National Bank of Monongahela, Pennsylvania, and is the successor Guardian
of the Estate of Roxie Clark, incompetent, under appointment of the Court
of Common Pleas of Washington County, Pennsylvania, at No. 4459 In
Equity, made and entered the 14th day of January, 1946.
4. That upon qualifying, as required by law, the Petitioner
entered upon its duties as such Guardian and, thereafter, has been and is
now acting as such fiduciary.
5. That the said Roxie Clark, incompetent, has for many
years been confined in the Torrance State Hospital, located at Torrance,
Pennsylvania, and is now residing therein and is likely to be confined to
Torrance State Hospital the remainder of her life.
6. That your Petitioner, at the present time, has in its
possession, investments of Six Hundred Fifty Dollars ($650. 00) consisting
of a savings account in the Dollar Savings Bank of Pittsburgh; uninvested
principal cash of Two Thousand, Six Hundred Eighty-four and 51/100 Dollars
{$2, 684. 51), and accumulated income of Sixty-six and 33/100 Dollars ($66. 33)
7. That your Petitioner is receiving, on behalf of the said
Roxie Clark, incompetent, Social Security benefits in the amount of
Fifty-four Dollars ($54. 00) per month and Veteran's Administration Benefits
in the amount of Seventy-five Dollars {$75. 00} per month. Notice of the
request for allowance by this Petition has been given to the United States
Veterans Administration by United States Mail; a copy of same is marked
"Exhibit A", is attached hereto and made a part hereof.
8. That the Commonwealth of Pennsylvania claims, as a
creditor, the amount of Fourteen Thousand, Eight Hundred Seventy-four and
38/100 Dollars ($14 874. 38) for the care of Roxie Clark, incompetent, at
Torrance State Hospital. A certified statement, marked "Exhibit B" is
attached hereto and made a part hereof.
9. That your Petitioner is desirous of paying from the
funds in its control, the sum of Two Thousand Dollars ($2, 000. 00) to the
Torrance State Hospital on account of the present indebte~ness, and the
sum of One Hundred Dollars ($100. 00) per month thereafter for the current
maintenance and care of the said incompetent.
10. That your Petitioner also offers to set aside the sum of
Six Hundred Dollars ($600. 00) to establish a burial fund for Roxie Clark,
incompetent, and a further sum for the incompetent's Patient's Fund Account
so as to provide the incompetent with incidental items of expense while a
resident of the institution, such sums to be added to from time to time as
the hospital may request.
11. That upon information and belief, the only next of kin of
said incompetent, who is or might be interested in this application, is one
Trevellyn Slade, a son by a previous marriage, whose whereabouts is
unknown.
12. That no previous application has been made for the
relief herein sought.
WHEREFORE, your Petitioner requests the Court, pursuant
to Sec. 644 of the Act of February 28, 1956, P. L. (1955) 1154, as amended
by the Act of July 11, 1957, P. L. 794, Sec. 1, 50 P. S., Sec. 3644, to . .
allow the payment of the claim of the Torrance State Hospital, upon the
terms and conditions above set forth', and that notice .'of this application be
given to such persons as the Court may direct.

consideration of the annexed Petition of the Western Pennsylvania Nat10nal
Bank, Guardian of the Estate of Roxie Clark, it is hereby directed and
decreed that the Guardian shall pay, from the assets of the incompetent's
estate, the sum of Two Thousand Dollars ($2, 000. 00) to the Torrance
State Hospital on account of the indebtedness of the incompetent to the said
hospital; to pay the sum of One Hundred Dollars ($100. 00) per month from
said assets presently being held and from the assets periodically being paid
as Social Security benefits and Veterans Administration .benefits, and to pay
into the Patient's Fund Account such funds as may from time to time be
necessary.
It is further ordered that the Guardian be allowed credit in
any future accounting for the sums here authorized to be disbursed, to-
gether with reasonable costs of the filing of the Petition and an attested
copy of this Decree, and counsel fees for the preparation and presentation

PETITION FOR DISTRIBUTION
TO THE HONORABLE, THE JUDGES OF SAID COURT:
The Petition of Western Pennsylvania National Bank, Guardian
of the Estate of Roxie Clark, an incompetent respectfully represents:
1. The First National Bank of Monongahela was appointed
Guardian of the Estate of Roxie Clark in the court of Common Pleas
of Washington County on January 14, 1946 at No. 4459 in Equity.
Western Pennsylvania National Bank by virtue of a merger became
successor guardian. This account was transferred to the Orphans'
Court of Washington County, October 15, 1969, No. 1160 of 1969.
2. Roxie Clark died June 29, 1969 at Torrance State
Hospital. She had been admitted to Torrance State Hospital on
December 5, 1945.
3. There is due and owing Torrance State Hospital
a balance of $17,656.23 per certified statement attached and
marked Exhibit "A".
4. Petitioner filed its First and Final Account with
the Clerk of your Honorable Court on March 10, 1970 and notice
of the filing of the account and of the time and place of audit
has been given to the Revenue Agent, Torrance State Hospital,
Mrs. Emma Stewart, sister, 2306 Center Ave., Pittsburgh, Pa. 15219
and Mr. Carl DeCoursey, brother through his attorney Arnold W.
Hirsch, P. 0. Box 341, Donora, Pa. 15033.
5. Your petitioner is not acting in a dual fiduciary
capacity.
6. The incompetent was not and never was a member of the
Armed Forces of the United States of America, nor entitled to benefits
from the Veterans Administration of the United States of America and
there are no parties in interest in the military service of the
United States of America.
WHEREFORE, your petitioner requests that your Honorable
Court confirm the account as filed and that the sum of $135.00
be paid to Mr. W. P~ Murray, 49 East Market St., Blairsville,
Pa. 15717 for the erection of a grave marker, the foundation
and labor costs. Mr. Murray will furnish Western Pennsylvania
National Bank a receipted invoice and a photograph of the erected
marker properly engraved. Your petitioner further requests that
the balance remaining $3,847.50 less any additional legal costs
be awarded Torrance State Hospital for past care and maintenance
payments.

PETITION FOR PRIVATE SALE OF REAL ESTATE UNDER
SECTION 543 OF THE FIDUCIARIES ACT OF 1949
TO THE HONORABLE, PATSY V. MARINO, PRESIDENT JUDGE:
The Petition of Selby Goggins respectfully represents that:
1. Roxie Clark died intestate June 29th, 1969. Letters of
Administration on her Estate were granted to Petitioner by the Register
of Wills of Washington County, Pennsylvania, on October 22nd, 1970.
2. The names and addresses of all parties in interest under the
Intestate Law are:
Carl S. DeCoursey, a brother, who has since died and is also
represented by your Petitioner, having been granted
Letters of Administration, C.T.A., on June 11th, 1971, by
the Register of Wills of Allegheny County,Pennsylvania; a d
Emma L. Stewart, a sister, (formerly known as Mrs.Lorine
DeCoursey Taylor), who resides at 2306 Center Avenue,
Pittsburgh, Pennsylvania, 15219.
3. Decedent owned a One-third (1/3) interest in the following
parcel of real estate at the time of her death:
ALL that certain piece or parcel of land situate in the Borough
of.Donora, Washington County, Pennsylvania, described as follows:
Lot No. 19 in Block No. 36 in the Union Improvement Company's
Plan. of said Borough, said Lot No. 19 lying between Waddell Avenue
and Hickory Alley, fronting on the Northerly side of Fifth Street
40 feet and running back, preserving the same width, a distance of
150 feet to Poplar Alley.
BEING the same premises conveyed by Andy Matta, et ux., to
Adolphus Barrier and Mary M. Barrier, his wife, by Deed dated May
24th, 1924, and recorded in Washington County Deed Book 527,page
34. The said Adolphus Barrier died in 1926 and title vested in
his wife, the said Mary M. Barrier, as surv1v1ng tenant by the
entireties. Mary M. Barrier died February 24th, 1931, and by her
Last Will and Testament, of record in Washington County Will Book
Vol. 47, at page 545, devised said premises to her son, Carl
DeCoursey, her daughter, Mrs. Lorine Taylor (ne) DeCoursey, and
her daughter, Mrs. Roxie Ella Clark, in shares of 1/3 each.
These premises have a monthly rental value of $45.00.
4. No real estate of the decedent has previously been sold.
5. There is attached hereto, marked Exhibit A, an official
Certificate of Assessment Valuation of the property proposed to be sold.
Also attached is a photostat of the Inventory, as officially filed,
marked Exhibit B.
6. Petitioner knows of no outstanding debts of decedent or liens
of record, except that Petitioner is aware that the decedent during her
lifetime, after being adjudicated an incompetent, was confined as a
patient at Torrance State Hospital from about 1945 until the date of her
death. Although Torrance State Hospital received a distribution on
account from the Guardian of the incompetent estate, no claim has been
made to the Petitionerfur the balance due to the Commonwealth.
7. Petitioner has entered into an Agreement of Sale with Emma L.
Stewart of 2306 Center Avenue, Pittsburgh, Pennsylvania, .for the private
sale of the share of real estate hereinbefore described in paragraph 3,
for the sum of $800.00 in cash, subject to the approval of your Honorable
Court; the original of said Agreement of Sale containing the detailed
terms is attached hereto, marked Exhibit C.
8. Petitioner believes that $800.00 is a full and fair price
for the interest in said premises, and a better price than can be ob-
tained at a public sale. The affidavits by two competent persons
required by law and the Rules of Court are attached hereto as Exhibits
D and E.
9. Your Petitioner files this Petition for Private Sale of Real
Estate in order to accomplish a judicial sale under Section 543
of the Fiduciaries Act of 1949 so that the interest sold will be free
of all. liens and claims by creditors.
WHEREFORE, your Petitioner prays your Honorable Court for
authority to make prtvate sale of the aforesaid premises under Section
543 of the Fiduciaries Act of 1949.

DECREE
AND NOW, this 19th day of July, 1971, being the time fixed for
hearing on the Petition presented at the above number, and the considera
tion of the confirmation of the said proposed private sale of real estat
it appearing to the Court that notice of the proposed sale, together wit 1
the time and place fixed for hearing, has been properly given to all
parties in interest as required by the Rules of Court, and it appearing
to the Court that no party in interest has appeared to object to said
sale or to deny any of the allegations of the Petition for Private Sale,
and it further appearing to the Court that no person or persons have
appeared offering a higher price for said real estate, it is ORDERED,
ADJUDGED AND DECREED:
' That the said private sale under the provisions of Section 543 of
the Fiduciaries Act to Emma L. Stewart for $800.00 be confirmed absolute y,
and that Selby Goggins, Administrator of the Estate of Roxie Clark,
Deceased, be authorized and directed to execute and deliver to the said
Emma L. Stewart proper Deed for the fellowing described premises, upon
the receipt of the balance of the purchase price:
One-third (1/3) interest in ALL that certain piece or parcel of
land situate in the Borough of Donora, Washington County, Pennsyl-
vania, described as follows:
Lot No. 19 in Block No. 36 in the Union Improvement Company's
Plan of said Borough, said Lot No. 19 lying between Waddell Avenue
and Hickory Alley, fronting on the Northerly side of Fifth Street
40 feet and running back, preserving the same width, a distance of
150 feet to Poplar Alley.

of her death. In accordance with Sec.6,Rule 7 of the Supreme Court
Orphans' Court Rules, a copy of the Account and a notice of audit was

and by the Prothonotary. This decedent owned a one third interest
in a piece of real estate in Donora. And the estate consisted of
some accrued rent, plus the on~ third interest in the real estate.
It was necessary that we sell that one third interest, which we did.

The decedent died at Torrance State Hospital where she had been

an estate which was in th.e. hands of one of the banks as her guardian
then paid the balance ov.er to Torrance State Hospital. But there wa
still an unpai:d b,alance due the ~ommonwealth in the amount of over
$13,000. And we set out the exact .amount in the Audit Petition.
The Commonwealth has received noti<;:e by letter dated August 11 of
tl_lis y~ar that 'the account would be filed and that the Audit Th tition
would be presented at this time. That was the first actual notice
received by the Commonwealth. AEt:B:"Qugh1they did kmbw th:.:J.t the wo
had died ·and were involved in the distribution of the estate as an
incompetent. There has been no formal claim made by the Common
wealth. However, I will assume they would want their money.
The two' persoris who will be otherwise entitled
are a sister and a brother who survive? the decedent: However, the
brother has since died and Mr. Goggins has qualified as Administ
C'f.A ··in Allegheny County.
THE COURT: Are there any other claims other than the
wealth, Mr.i rH-irsch?
MR. HIRSCH: The only cla:i:m I know is the Comm.onwealth.

Arnold w. Hirsch, Attorney for Selby Goggins, Administrator of the
Estate of Roxie Clark, Deceased, respectfully represents:
1. That under date of June 21st, 1971, he presented to your
Honorable Court at the above number a Petition for Private Sale of Real
Estate, the said real estate being a l/3 interest in Lot No. 19, Block
No. 36, in the Union Improvement Company's Plan of the Borough of Donora
Washington County, Pennsylvania.
2. Your Honorable Court, on said date, fixed Monday, July 19th,
1971, at 10:00 o'clock, A.M., in the Orphans' Court Room at the Washingt n
County Court House as the time and place for hearing on the Petition and
the consideration of the confirmation of the proposed sale of real estat ,
and directed that notice of the said hearing be given by publication in
accordance with the requirements of the Rules of Court.
3. Your Petitioner caused notice, in accordance with the Rules of
Court, to be published in The Daily Herald, a newspaper of general circu
lation, and in the washington County Reports, the first of said publica-
tions appearing more than twenty-one days prior to the date fixed for
hearing. The proofs of publication are attached hereto and made a part
hereof, marked Exhibit A.
4. In accordance with the Rules of Court, your Petitioner caused
written notice to be given by posting five handbills, one of which was
posted in a conspicuous place on the real estate proposed to be sold,
and the others in prominent places in the vicinity of such real estate.
The said handbills were posted on June 22nd, 1971, which date was more .
than ten days prior to the date fixed for hearing. There is attached
hereto, marked Exhibit B, a copy of said handbill.
