deceased. The Administratrix is Ann Golembiewski and the attorn1 y

MR. COSTA: If the Court please. I have here the necessary
papers in this eatate. There appears to be a, pvoblem for adjudicatic n
in this respect: one of the heirs, an Agnes Fleming, has paid the
funeral bill in the amount of $938 to Thompson Funeral Home. And
this claim was submitted to the Adn inistratrix for payment. The

Administratrix has refused payment of that claim, stating to the
effect that there was insurance to pay the funeral bill in the amount
of $1, 000 or approximately that.
THE COURT: Well, what insurance and who was the beneficiar ?
MR. COSTA: To the best of my knowledge, the heir here, Agm s
Fleming, I understand is not in Court here. But her husband is
here. Your Honor, from what I can gather, and I don't want this to be
binding, that Agnes Fleming wm named beneficiary in the policy.
However, the other children claim that it was the understanding that
the proceeds of this insurance policy was to be used to pay the funer iil
expenses of Susan Petrick, the decedent. Now I mean I have botbr.
the AdministratriX here and the husband of Agnes Fleming.
THE COURT: Does counsel wish to take time this morning to
develop . this matter and take testimony?

Kenneth V. Thompson Funeral Home in Bentleyville. Shall I read
it, Your Honor, or would you. rather look at it? Merely to the effect
that his ledger shows payment by a cashier's check and that it was
Joseph that gave me the check."My receipt book shows that a receipt
was issued to Mrs. Cramer Fleming for Joseph Petrick."
