ELEANOR MAE ZAN OVER ,ELVA JEAN DARULLA,WILMA GAIL
DARULLA,and PRUDENCE LORRAINE PETRUCCI,in equal shares,
my two properties'(in the Borough of California,
Washington County,Pennsylvania,one ,situate on Park
Street,being a two-story dwelling.house and lot,and the
other situate on Fifth Street,being a tW'o-story frame
dwelling house and lot),or the proceeds from the sale

This matter involves a claim against decedent's estate in the
amount of $5250.The claimant is Donna Riskey,a young lady 28 years of
age.The decedent is William C.,Wilson,who died September 11,1969,at
the age of 79.He lived on his farm near Coal Center with his son Braden
Wilson,aged 44.
William C.Wilson was a retired coal miner and was doing some
farm work to supplement his pension income.But his health was failit:J.g for
several years and it was difficult to maintain his home and farm,as his four..
daughters were all married and living elsewhere.He had been a widower for
almost two decades.
Early in 1966,his son,Braden Wilson,encountered a young lady
who was looking for work in a nearby village.She agreed to go to the Wilson
home and keep house for them.The lady was,Donna Riskey,mother of two
children,and separated from her husband.She left her two children with her
mother and went to keep house lor Braden Wilson and his father.There was

work there on or about January 4,1966.~he described the work she did,

cleaning,cooking,washinq-and all the other household duties pertaining to
,.keepi~g a weU-ordered house for three adult individuals.
Donna Riskey worked there steadily for the whole year 1966 and
part of 1967 without any agreem'ent as to compensation.Of course she had
her keep and her board also,but there was never any understanding or
agreement as to any wages.
She testified that both William Wilson and Braden Wilson bought
food for the ,tab Ie,and she had her room and board but there was no definite
arrangement as to pay.It was just whatever they felt that tney wished to do.
She testified (p.74):"They both give tome.They bought me a few things
like cigarettes.I didn't need many clothes.But they bought me at times
clothes,both of them.When I went to the store he would buy me,Braden..
woul,d buy,they both bought me things.II

This situation continued throughout 1966 and into 1967.William C.
Wilson grew weaker and required almost constant attention.He was not bed-
fast when out of the hospital or nursing home,but his condition of health was
deteriorating and he had many complaints.He was afflicted with heart
disease,miners I asthma,hardening of the arteries and a number of diseases
of the elderly.He was getting hard to handle.
On August 17,1967,he and Braden went to see a lawyer in
California;Donna did not go with them.It transpired that on said date a deed
was drawn (and thereafter recorded)which deed transferred ownership of the
home and farm from father to son,permitting,however,the father to retain
a life estate in the property.When they got home,they explained what had
been done.Then Braden brought up the subject of care which was being
rendered the father by.Donna Riskey.It was agreed that if Donna continued to

care for him as she had in the past,she would be paid at the rate of $50 per
week by William C.Wilson so long as she remained there.Donna agreed she
would stay on this basis,but Mr.Wilson e~lained he would not pay her until
his properties in California were sold.She agreed.They were trying to
negotiate a sale of the two pieces of real estate in California but had not yet
succeeded.
All claims against the estate of a decedent must be proved by
evidence which is clear and convincing.Hence,in order to recover,this
claimant must prove the making of a contract,either oral or written.When
one claims on an express contract he or she cannot,on failure to prove the
contract by sufficient evidence,recover on a quantum meruit for the fair
value of the services rendered:Witten v.Stout,284 Pa.410 (1925);Cramer
v.McKinney,355 Pa.292,204 (1946).Recovery on a quantum ~meruit is

,In Lach v.Fleth,361 Pa.340, 348,(1949),Chief Justice Maxey

said:"Th~s is not .an'ac~ion for breach of an,express contract.Such an action
and an action on a quantum meruit are utterly distinct.Their respective

measures of damages are not the same.In one action the measure of damages
is fixed by the parties;in the other action it is fixed by law.n
Donna Riskey is limited to proving an express contract;if she
cannot do so,her claim must fail.
The conversation held in the farm home on August 17,1967,is the
only evidence of an express contract.Only three were present--the decedent,
Donna Riskey and Braden Wilson.The conversation was not an extended one;
it covered,at most,but a few minutes.But the import of said conversation
was clearly an express contract which bound two individuals to the terms.

thereof.It was never repudiated at any time by the decedent.He had many
opportunities for so doing if he thought it unfair or obtained by undue pressure
on the part of his son.Other members of the family often visited him.None
reported that he was not satisfied with Donna's work or her care of the home
and of him as an elderly,sick individual.
But most persuasive of all in the circumstances,is bhe testimony
of Braden Wilson concerning the express contract.He is the sine qua non of
the en~orcement thereof.His testimony was an absolute requirement.How
can it be disregarded or watered down?He is the beneficiary under the will
of the entire residuary estate.Only he stands to lose by payment of this
claim.The four daughters are devised the real estate;Braden the farm,
which was deeded to him after the will was executed.There is sufficient
personalty for payment of all debts,expaJ&6B and costs of administration.

claim.His testimony is almost tantamount to a command:"Pay her;it is,

~We hold that -an enforceable contract was made on August 17,1967,

and that Donna Riskey;the claimant;has proved her entitlement to the
stipulated sum,that of $50 per week for her services to the decedent;a
total sum of $5250 is due her,and it is ordered to be paid by the executrix
of the estate.

Mr.Yuhas had his men go out on the farm,three men in all.They
accomplished their work and their "field timen amounted to $200.The office'
work,on the plan,was done by Mr.Yuhas;the office time amounted to $50,
or a total of $250.
It is undisputed that the work was done.No testimony was given to
the effect that the charges are not fair and reasonable.
The court awards John Yuhas the sum of $250 in full payment of
his arid his merits services to William C.Wilson,the decedent.

the will of the decedent.Now this paragraph provided that Braden
Wilson would receive the farm and all livestock,poultry,machineJ y
and soforth.The farm was transferred to Braden Wilson by his

father by a deed.Tprior to the death of the decedent and recorded.
And at that same time all personal prope rty was transferred to the
son.So that part of the will is adeemed.And he already has what
the Will provided for him.
Paragraph four requires some attention to the
Court.The Will of this man provided that the other real estate tha
he had would go to his four children,Eleanor Mae Zanover,Elva
Jean Darulla,Wilma Gail Darulla and Prudence Lorraine Petrucci
in equal shares.And then went on to say that Prudence Lorraine
Petrucci would ha ve the sole right in her discretion to convert the
property into cash.This property,Your Honor,was located in
the redevelopment area recently completed in California ..,And we
successfully negotiated with the general state authority a settle-
ment of the rna tter and conveyed the property to them.This resultea
in a substantial increase on the Inventoried value of the prope:r;ty.Eut
at the present time all that now remains for distribution is in cash,.
I believe.
The automobile that is mentioned in the Will
has also been transferred to the son who was to receive it.And I
have in here a receipt from him for that.The re has been paid on apcount
some $1500.00 in Inheritance Taxes;from the sale of the real estatE,
as I was mentioning toyou before,Your Honor,there was a net,
profit that is an amount in excess of the inventoried value of $8,8711-64.
Now,Your Honor,the problems arise here by virtue of two claims.

One of them made by McClelland-Yuhas and Associates in the
amount of $250.00.This is a clwrn that was made for work done,Sl rvey
work done on the farm after the farm had been transferred to the
son as I have just indicated.The Executrix has taken the position
that this is denied,it's not the obligation of the estate;it's the obli-
gation of iBl$den Wilson,the son.

The second claim is in the amount of $6,600.00~
from a Miss Donna Riskey.'I bel ieve appearances have been filed w th
the Cour:t on both of these mat1rers.I am not sure about the $250.O(,
but Mr.Gladden filed an appearance for the$~p600.00.And the Co rt .'
will note this is a claim for services which 'were renderea to the
decedent from January 4,1966 until September 11,1969 at the rate
,of $50.00 a week.That claim is also denied'.
In addition,there is presented to the Court the
appearance of Mr.Gladden,claiming oa family exemption for Brad"'n
W.Wilson.Braden Wilson,in our opinion,meets all of the'requ'ir€-
m ents for family exemption,living with his father at the time of th€
death and meeting all the other requirements and the'estate will .
have no oQj ection to that.

the $6600.00 and the $250.00 from present dis tribution,pending a

In the case of securities of close or family corporations,the values reported are as far as
possible substantiated by financial statements of the corporations,showing the assets and liabili ties
thereof as of the'date of death.The schedule also sets forth the interest of decedent at the time of
death in any co-partnership or business,and in support of the value of such interest there is annexed to
said schedule,financial statements showing the assets and liabilities of said co-partnership or business.
A copy of the co-partnership agreement,(if oral,a statement setting forth the nature of the agreement)
together with a statement setting forth the character of the business,its location,and such other facts
pertaining to the business as may be pertinent to a fair and just appraisal of the decedent's interest
therein must be submitted.It should also set forth in itemized form,together with the 'fair market value
thereof,any other property owned or bequeathed by the decedent at the time of death.
The Schedule C attached hereto and made part hereof sets forth a true answer to each inquiry
contained therein and in the case of transfers ofproperty,real or personal,within two years of decedent's
death,in contemplation of decedent's death,or intended to t~ke effect in possession or enjoyment at or
after death,said schedule sets forth the nature and value of such property,to whom transferred,the
relationship of the transferees to the decedent,the proportionate share received by each transferee and
all other facts of a pertinent nature regarding said transfers.In the case of transfers intended to
take effect in possession or enjoyment at or after death,there is also attached to the schedule a copy

pective interests,their relationship,if any,to the decedent,together with the ages at the time of
decedent's death of all minors,annuitants and beneficiaries for life under decedent's Will.It also
contains a statement shOWing which of the beneficiaries named in the decedent's will,if any,died prior
to decedent,the dates of their death,their issue,and the relationship of such issue to the beneficiary.
That Schedule E attached hereto and made a part hereof sets forth all property,real and per-
sonal,owned by the decedent jointly with another or others,including intangible,standing in the name
of the decedent and others,plus the date and place of record of instruments effecting the vestiture of
real estate and the date of acquisition of personalty,plus the name,address and relationship,if any,
of co-owners to the decedent.
That Schedule F attached hereto and made a part hereof sets forth fully and in detail all debts
and deductions claimed for and on behalf of this decedent's estate,including funeral expenses paid;
family exemption,where applicable;costs of administration of this estate;counsel fees and fudiciary's
commissions paid or to be paid;cost expended for burial trusts,tombstones or gravemarkers,and reli-
gious services,in consequence of the death of the decedent;debts and claims owing and unpaid at time of,.death;taxes accrued charge.able for period prior to decedent's death (except.those allowed under Section
651 of the Inheritance and Estate Tax Act);together with a statement of collateral pledged for Obliga-
tions,if any.It is agreed that the fiduciary will present proof of said claimed obligations.upon re-
quest,that if the amount actually paid in settlement of any fee,commission or debt is less than the
