1.Your petitionerJ Paul A.EasseYJ is the Administrator
C~T.A.of the Estate of Agnes E.SadYJ a/k/a Agnes Eassey,deceased,
who died on February 18,1969.
2.The decedent died testate and her Will appears of
record in the Register of Wills Office of Washington County,Pennsylvani ,
in Will Book 108,page 458.Your petitioner was appointed Administrato
C.T.A.of the estate on September 9J 1969.
3.The decedent.Agnes E.Sady,a/k/a Agnes Eassey.
died seized of the following described real estate:
ALL that certain tract of land situate in North
Franklin Township,Washington County,Pennsylvania"
bounded and des cribed as follows:
BEGINNING at a point in the center of the Plank
Road known as Traffic Route No.18 and as Legislative
Route No.109,thence South 0°16'West along the line of
the Nokomis ParkPlan of Lots as recorded in the Recorder's
Office of Washington County,Pennsylvania,in Plan Book
No.6.pages 86 and 87,a distance of 514.38 feet,more or
less.to a stake;thence North 88°58'East along the line
of the same plan of lots a distance of 256 feet,more or less,
to a stake;thence North 0°05'30"East along the property
now or formerly of William McK.Smith,a distance of 431.58
feet.more or less.to the center of said Plank Road;thence
North 72°55'30"West along the center of said road a
distance of 266 feet to the place of beginning.containing
.2.7713 acres.more or less,upon which is erected a two-
story frame dwelling house known as No.210 Park Avenue
and a garage and other outbuildings.

4.Your petitioner proposes to sell the above described
property which formerly included a two story frame dwelling house and
a small tenant house in the rear.As a result of a fire in 1966,the
tenant house was completely destroyed and the other two story residence
was substantially damaged and consequently the dwelling itself is of
little or no value.Your Administrator C.T.A.desires to sell at
private sale the instant real estate to Joseph E.Sady for the total sum
of $5.000.00 upon the follOWing terms:$200.00 down,payment of
which has been received,and the balance of $4,800.00 in thirty (30)
days.An agreement of sale was executed by the petitioner and the
proposed buyer on the 7th day of October.1971,subject to the
approval of the Court.A copy of said agreement of sale is attached
hereto and marked Exhibit "A".

8.If Buyer defaults in payment or performance for 10 days,Seller may,at Seller's election
use one or more of the following remedies in addition to or instead of any other rem~dies provided by law:
(a)rescind this agreement and retain all sums paid on account hereof as liquidated damages,in
which case Seller shall retain title to the real estate free and clear of any obligation or duty to Buyer and Buyer .
shall surrender this Agreement for cancellation;
(b)eject Buyer from said real estate,for which purpose Buyer hereby authorizes any attorney'

I.iPursuant,to the provisions of Section 1001 (1)of the Inheritance
and Estate Tax Act of 1961,a PROTEST is filed against the appraisement
and Statement of Debts and Deductions filed in the estate of Agnes E.Sady
on October 20,1971 in Washington County.
Mr.Paul A.Eassey,Administrator of his mother1s estate,filed a
"resident"inheritance tax return reporting real estate having a situs
in Pennsylvania valued at $5000.00.No disclosure was made of assets
owned by the decedent'outside the Commonwealth.Debts and Deductions
totalling $3432.34 were ~laimed and approved by the Register of Wills on
October 21,1971.Among them is the $1000.00 family exemption which is
'claimable in resident estates only.
Protestant contends both the Register of Wills and Appraiser erred
.in accepting the Estate1s "resident"return.The inventory filed by
Mr.Eassey states that his ,mother,Agnes E.Sady,was a resident of
.p:"lexandria,·Virginia.
It is the Protestant's position that the "resident"file created
