grant these LETTERS TESTAMENTARY,unto the'said
Felix L.Boehme,Jr.
committing unto Him the administration of all and singU'lar the goods and
chattels,rights and credits,which were of said deceased,and requiring Him
to exhibit a true and perfect inventory thereof into the Register's Office,at Washington,within ninety
days from the date hereof,and to render a just and true account of said administration at the expiration
of six months from the date hereof,and to regard and comply with the provisions of the laws of this
Commonwealth relating to inheritance taxes.

LAST WILL AND TESTAMENT---

ment,hereby revoking any prior wills or codicils by me made.
FIRST:I direct that my executor hereinafter
named,pay all of my just debts and funeral expenses as soon
after my death as may be convenient.
SECOND:I give and bequeath unto my sons,Felix L.
Boehme,Jr.,and John Paul Boehme,all of my machinery and tools
of all description.
THIRD:All of the rest,residue and remainder of
my estate~whether real,personal or mixed,and wheresoever
situate,I give,d~vise and bequeath unto my children,Bertha
,Bernice Schmidt,Felix L.Boehme,Jr.,and John Paul Boehme,
share and share alike,and if any of them should not be living
at my death,then their share I give,devise and bequeath unto
their children.

The Petition of BERTHA SCHMIDT,respectfully represents:
1.That Sarah Boehme,the decedent,died in April of
1964.
2.At the time of her death,the Decedent maintained
her family or principal residence at Fallowfield Township,Wash-
ington County,Pennsylvania.
3.The Decedent was survived by the following three
(3)children,including your Petitioner,who are the only heirs
and next of kin of the Decedent:

she did give.and devise her real estate to her three (3),children
and appointed her son,Felix Boehem,as the Executor of her estate

of certain real property situate in Fallowfield Township,Wash-
ington County,Pennsylvania,and certain personal property all
located in Fallowfield Township,\va,shington County,Pennsylvania;
and in order to perfect the title of your Petitioner in the real
estate,it is necessary_that said Will be produced for probate
and that Letters Testamentary ·be granted thereon in'this juris-
diction.
6.The Decedent,at the time she executed her Will,
delivered it unto the safe keeping of Felix Boehme,who has
neglected and refused and still neglects and refuses to produce
the Will for probate,although requested to do so by your Peti-
tioner.
WHEREFORE,your Petitioner prays that a Citation be
issued,directed to Felix Boehme at R.D.#1,Bentleyville,

1.That Your Petitioners,Margaret Wyder,Judith Hartman,
Sally Williams,and Kathy Thorsen,are the natural children of",'.~.
Bertha Schmidt,who was a surviving heir of Sarah Ellen Boehme,
now deceased.
2.That the Executor of the Estate,Felix L.Boehme,Jr.,
caused to be.prepared a fi~st and ~inal account_andla petition

for distribution in the above estate wherein he showed a net..

amount of Tw~thousand eight hundred eighty-thr~e ~ollars and
ninety-six cents ($2,883.96)for distributipn,to the distributees
in that estate.
3.That by order of the Presiding Judge of the Orphans'
Court,Charles G.Sweet,of February 8,'1973,Felix L.Boehme,Jr.,
was directed to make distribution of one-third of the residue to
the heirs of Bertha Schmidt,now deceased in the amount of Nine
hundred twenty-three dollars and ninety-nine cents ($923.99).
4.That the attorney for the estate,Gaylord W.Greenlee,
forwarded to Your Petitioners the total sum of Five hundred twent -
