hereby make this my last will.
It is my desire that all my personal property and holdings
continue in the name of the John V.McAninch estate untill such
time as the executrix uses her power of distribution.
I hereby appoint Elizabeth M.Masquelier to be executrix
to serve without bond.The executrix hasthe privilege at any
time in the future,to distribute my estate in any manner which
she deems best;namely,to my wife and two children.
The dividends of my estate are to be given to my wife;
and if further funds are needed by her,they may be drawn from
the estate.Some of my stocks and bonds are in the name of
John Vincent McAninch.

the following agreement is entered into by and between the'
parties whose signatures appear hereon.
WHEREAS,John Vincent McAninch,a/k/a John V.
McAninch,a/k/a J.V.McAninch,a/k/a Dr.John V.McAninch,
a/k/a Dr.J.V.McAninch died testate on July 22,1966,a
resident of the Borough of McDonald,Washington County,Pennsyl-
vania;and
WHEREAS,the said decedent left to survive him his
wife,Jane Davis McAninch,and two children,Elizabeth M.
Masquelier and David Lewis McAninch,all of whom are sui juris;
and
WHEREA~,a written instrument was probated as the
Last will and Testament of the decedent and Letters Testamentary
were issued thereon to Elizabeth M.Masquelier by the Register
of Wills of Washington County on the 2nd day of August,1966;
and
WHEREAS,the writing admitted to probate is not
precise and definite and may require interpretation;and
WHEREAS,the heirs of the decedent are in~omplete
t
and unanimous agreement as to the meaning of the instrument
and the intention of the decedent;and
WHEREAS,the parties to this agreement are the only
persons legally interested and.entitled to the estate of the
decedent;and
WHEREAS,the parties are desirous of having the
estate settled with the least possible delay and distribution
made of the assets of the estate in an equitable manner;and
WHEREAS,the parties desire that their agreement
regarding the distribution of the items be reduced to writing;
NOW THEREFORE in consideration of the mutual pro-
mises and covenants between the parties hereto,and further,
in consideration of the sum of $1.00 in hand paid,each party
to the other,and intending to be legally bound,the said Jane
Davis McAninch,Elizabeth M.Masquelier and David Lewis
McAninch hereby agree as follows:
1.The debts of the decedent,costs of administration
and all taxes which may be due on account of inheritance shall
be paid from the assets of the estate and the administration
of the estate shall proceed and be completed forthwith.
2.The following assets of the estate shall be
held in kind and shall be distributed to Elizabeth M.Masquelier
and David Lewis McAninch as joint tenants:

3.All cash assets of the estate at the time of
distribution shall be deposited in a savings account in the
Bank,McDonald/Office,McDonald,Pennsyl-
vania am.the account shall be titled "Elizabeth M.Masquelier
and David Lewis McAninch in trust for Jane Davis McAninch."
4.During the life time of Jane Davis McAninch,all
of the dividends and other income benefits which are paid or
may accrue on the shares of stock listed in Paragraph 3 herein-
above shall be paid over to Jane Davis McAninch for her use and
benefit.
5.During the life time of Jane Davis McAninch the
interest paid on the savings account referred to in Paragraph 4
hereinabove shall be paid over to Jane Davis McAninch for her
use and benefit.
6.Elizabeth M.Masquelier and David Lewis McAninch
agree that in the event Jane Davis McAninch has no funds of her
own and requires money,in addition to the income which she is
to receive under this agreement for her maintenance and care,
they will use whatever share of the principal which may be re-
quired to maintain her in a manner suitable to her station in
life,the principal to be used shall be at their sole discretion.
7.That Elizabeth M.Masquelier and David Lewis
McAninch shall be responsible for and pay~any Federal Income
Tax that may be due on dividends and interst which under the
terms of this agreement are paid over to Jane Davis McAninch.

their hands and seals the day and year aforesaid.
