No. PETITION FOR SETTLEMENT OF SMALL ESTATE AND CLAIM FOR F AMILY EXEMPTION TO:THE HONORABLE P.V.MARINO,PRESIDENT JUDGE: The petition of Domenica Volcan respectfully represents: 1.That your petitioner is the widow of Joe Volcan,also known as Giuseppi Volcan,Deceased,and is,therefore,a party in interest in his estate. 2.That the Decedent,Joe Volcan,also known as Giuseppi Volcan,died, testate,on August 30,1942,a resident of Lawrence,Cecil Township,Washington County,Pennsylvania.A copy of said will is attached hereto as Exhibit "A",and incorporated herein by reference. 3.That decedent's entire estate at the time of his death consisted of th following assets: 1.Real Estate:Lot Number 1322 and part of Plat Number Four of the Salem Heights Allotment,situated in the Township of Perry,County of Columbiana, State of Ohio,said Allotment being of record in said Columbiana County Plat Records in Volume 7 page 55,conveyed to Joe Volcan and Domenica Volcan,his wife,by deed of Milton A.Mackay,dated August 11,1924,and recorded in said County Records in .'j Volume 495 page 30,having a market value of $250.00.', 2.Personalty:Two (2)shares of West Penn Power Company,4 I/"2 0/0 Preferred Stock,issued July 25,1939 in the name of Joe Volcan,evidenced by stock certificate No.TNO 4379,having a total value as of date of death of $229,50. 4.That the said Joe Volcan,also known as Giuseppi Volcan,Deceased, was survived by the following heirs,all being sui juris: Domenica Volcan Virginia Yankovich Catherine Lustin Henry Vulcan John Vulcan Don Valcan Raymond Vulcan Robert Vulcan Widow- Daughter Daughter Son Son Son Son Son 5.That by the terms of the Last Will and Testament of the Decedent,dated January 10,1941,he did provide as follows: "I bequeath all my lands,tenements and hereditaments and all household furniture,real money,securities for money,money secured by life insurance,goods and chattels and all other parts of my real and personal estate and effects whatsoever and wheresoever,unto my wife,Domenica Volcan,her heirs,administrators and assigns to and for her and their absolute use and benefit according to nature and quality thereof respectively,subject only to the payment of my just debts,funeral and testamentary expenses." '16.That by the terms of said Last Will and Testament,which is attached hereto,Decedent did make,constitute and appoint your petitioner to be the Executrix of said Will.Said Will has not been admitted to probate,and no administration has been raised in this or any other jurisdiction;nor is any administration anticipated. 7.That your petitioner was the spouse,and is the s urviving widow of the decedent,and the only person entitled to the Family Exemption,and hereby makes claim for the Family or Widow 's Exemption. 8.That all debts of the decedent have been paid. 9.That this petition for settlement and Widow's Exemption,is make pursuant to the provisions of Sections 12 (a)and 12 (f)of the Fiduciaries Act of June 7,1917,P.L. 447,as amended. WHEREFORE,your petitioner prays your Honorable Court to enter a Decree of Distribution,awarding the hereinabove enumerated shares of stock of West Penn Power l Company issued in the name of Joe Volcan,together with any interest or dividends accrued thereon,to your petitioner,and to direct the said West Penn Power Company to transfer the said shares to your petitioner.
