The proofs of publication are attached hereto as Exhibit B. 3.No creditors appeared except Richard Lee McPherson,father of your petitioner who presented a j~st claim for $2515.92 which is attached hereto as Exhibit C.(See Item 1 of the attached Last Will and Testament.) 4.The said Richard Lee McPherson assigned the above claim to his son,your petitioner,on June 22,1970,which assignment is attached hereto as Exhibit D. 5.The residuary legatees in said attached Will and Testament (see Exhibit A)are: Mary Martha McPherson & Rhea Carrie Schutt,Ceworth,daughters of the testatrix and Charles R.McPherson,your petitioner &Stephen J.Schuttleworth, grandsons of the testatrix. 6.Mary Martha McPherson,Rhea Carrie Schuttleworth,and Stephen J.Schuttleworth,by deed dated June 18,1970 which is attached hereto as Exhibit E and yet unrecorded,quit-claimed their interest in the subject property to your petitioner as assignee of the just claim which his father,Richard Lee McPherson, holds against the subject estate. •f 7.The appraiised value of the subject property is $1800,but your petitioner has obtained a buyer who is prepared to pay $2000 on an agreement of sale,and your petitioner will credit the estate with $2000 upon approval of transfer of the realty to himself by your honorable court.A copy of the appraisal is attached hereto as Exhibit F. 8.The subject estate cannot yet be wound-up because of an expectancy from the estate of Rose E.Slevinz deceased, currently under probate in California. 9.Your petitioner has sufficient assets to pay all required taxes and costs of administration. 10.Your petitioner therefore prays that your honorable court approve and direct the transfer of the subject real estate to your petitioner under the applicable seotions of the Fidu~iary Act of 1949, and has enclosed an Order to that effect.
