PETITION FOR APFOINTMENT OF GUARDIAN
AND NOW,comes PATRICIA DiBACCO and respectfully represents:
1.She is the mother of the aforesaid minors.
2.Robin Renee DiBacco was born December 27,1955;
ichael Louis DiBacco,Jr.was horn October 9,1960;Mark Lane
iBacco was born August 18,1964;and Melissa Lynn DiBacco was born
pril 8,1969.
3.The aforesaid minors presently reside with,and are
sucppor te d by,their mother"the peti t ioner,in Ave lla,Washing ton
County,Pennsylvania,with theiT mailing address being Box 362,
vella,Pennsylvania.
4.The aforesaid min~rs are the children of Michael L.
iBacco who died November 24,1368 an~the petitioner.
5.The aforesaid Mic3ael L.DiBacco was killed in an

utomobile accident~on November 24,1968 and an action was brought
o enforce the Wrongful Death claim arising therefrom against Trent
iarrocchi and the Estate of Trent Ciarrocchi,Jr.in the Circuit

Court of Hancock County,West Virginia.
6.A settlement c.s.pproved by the aforesaid circuit court
awarded the minors a total of $27;197.93 or $6,799.48 each.
7.There is no guardi~n of the estate of the aforesaid
minors and a guardian must be appointed to handle the aforesaid
money.
8.The minors have rto estate aside from the ~foresaid
sum as ':to each.
9.The First National Bank &Trust Co.,Washington,
Pennsylvania is proposed as the,guardi~nof the estates of the
aforesaid minors.
10.The proposed guardian has no inte~est adverse to
!the said minors,and is not the fiduciary of an estate in which
any of the,minors has an interest,nor the surety of an officer or
employee of the,corporate surety of such fiduciary.'

Thereupon the Court,in the presence of the Guardian

Estate of Mtchael L.DiBacco,Deceased,heard thee
testimony of said Petitioner aDd others upon the matters'
set forth in the Petition and tound the facts to be as
follows:That on November 24,1968,the·p1&1Dti£f t s
decedent,·Michael L.DiBacco,who was at that time a
resident of Avella,Washington County,Pennsylvania,was
operating a 1964 Corvair automobile in a northerly
direction on Main"Street in the City of Weirton,Hancock
County,West Virginia,when the same collided with a
1965 Volkswagen automobile owned by the defendant Trent
Ciarrocchi And then and there operated by his son,the..
~defendant Trent Ciarrocchi,Jr.j that as a result of the
col11s10n,Michael L.DiBacco :received serious injuries
wh.lch resulted in h1s death on November 24,1968 J that a
medical bill in the amount of 113.00 and funeral expense.
in the amount of $1,690.10 were incurred.
The Court further finds that the Petitioner,Patrioia
J.DiBaoco ftS appointed and regularly qualified aB

on February 13,1969,by the Register ot Wills of
Wasbingtoll County,Pennsylvania,and i8 now acting as
the duly appointed AdDinistratrlx ot said Estate;that
the decedent,UtchaelL.DiBacco,lett surviving hi.as
his only heirs at law and dependent distrlbutees,his
Widow,Patricia J.DiBacco,an:l the following named
infants:Robin Renee DiBacoo,Michael Louis DiBacco,Jr.,
Mark Lane DiBacoo and Melissa ~ynn DiBacco,and that
said Widow and infants are the persons entitled to the,
distribution of the personal estate ot the said ~ichael
L ..DiBacco.
The Court further finds that the defendants,Trent
Ciarrocchi and the Estate of 'Trent Ciarrocchi,Jr.,while
denying liability for the death of Michael L.DiBacco,
"have now offered to pay to the said Patricia J.DiBacco,

any action or actions at law were instituted by
Petitioner to recover damages for the wrongful death
of Miohael L.DiBacco and a verdict for plaintiff was
rendered.such \"erd:Lct would be equal to or 1n exce••
of the amount now offered in compro~1$e and settlement
of these claims,and in further view of the expense
inoident to the institution of any such action or
actions or any trial or trials as the result thereat.

PETITION FOR DISCHARGE OF GUARDIAN
TO THE HONORABLE JUDGE OF SAID COURT:
The petition of the First National Bank &Trust Company,Washington,
Pennsylvania,respectfully represents:
1.That your petitioner was appointed guardian of the Estate of
Michael L.DiBacco,Jr.,a minor,by Order of Your Honorable Court dated July 18,
1969.
2.That your petitioner entered upon its duties and files herewith
its true accounting of said guardianship,which shows a balance of $4,803.48 for
distribution.
3.That the said Mic~ael L.DiBacco attained the age of eighteen
years on October 9,1978,and your petitioner has exhibited to him the accounting
of its guardianship of his estate and the said Michael L.DiBacco,Jr.,has
executed a Receipt and Release which is attached hereto releasing and discharging
Y9ur petitioner from all claims of any nature arising out of said guardianship.
WHEREFORE,Petitioner prays Your Honorable Court to approve the
accounting of its g1,1ardianship filed herewith,to direct payment of the balance
shown by said accounting,less the costs of this proceeding,unto Michael L.
DiBacco,Jr.,and to discharge your petitioner from further duties as guardian of
