THE.ESTATE OF AN ALLEGED INCOMPETENT.
AND NOW comes ROSE IAG~MM~the petitioner herein,and
avers as fol lows;
I.Rose lagnemm'a,your ptitioner here·in,is an adult
"alleged incompetent".
2.Josephine Museo,the alleged incompetent,is 57'
years of age having been born on December 16,191 I.The aTleged
incompetent waS marr ied on Octob~r 3,1929 to Gu iii 0'·Museo al kl a
JU,I ius Museo,and their residence was 293 Beech Street,Muse,
Ceci I Township,Washington County,Pennsylvania.By reason of
mental illness and othernental infirmities,the alleged incom-
petent was admitted to the Dixmont State Hospital,Dixmont,
P.ennsylvania,on April 28,1944,and she continues to remain
a patient at this state institution.
3.The said Gui I io Museo,a/k/a Julius Museo,the
husband of the al leged inco~petent,died testate on March 5,
1969,and by his last Wil I and Testament dated March 12,1926,
the said Gui I io Museo,'a/k/E Julius Museo,devised and bequeathed
his entire estate to his mother,Mariantonia Museo,and he

designated his uncle,Pasquale Simone,to be·the Executor of his
said Wi II.The afores~id Wi I I was probated by the Register of
Wi I Is·.of Wash i ngton County','Pennsy Ivan i a,and the Same appears
~f record in the said Register of Wil Is Office in Wi I I Book

4.Because of her mental condition,the presence of
the alleged incompetent in court would be detrimental to her
we Ifare.
5.Because of her mental illness and other mental
disturbances,the said Josephine Museo,IS unable to manage
her property and is I iable to dissipate or become the victim
of designing persons.
6.A Petition for the Appointment of a Guardian for
the aforesaid incompetent was filed in the Orphans'Court of
Washington County,Pennsyl~n a on March 28,1960 at No.101
~f 1960 o.C.By a·Decree handed down October 20,1960,the said
court adjudged the said Josephine Museo to be an incompetent
and appointed Victor E.Riva as guarden of her estate which
consisted of certain stock of the Curtis Publishing Company of
Phi ladelphia,Pennsylvania a~d accrued dividends on said stock.
The said guardian fi led a Petition with the said court to settle
the estate of the alleged incompetent under provisions of the
appl icable law wherein the estate was under $2,500.The said
guardianship is terminated.
7.The alleged incompetent is entitled to a share of
her af.oresald deceased husband's estate and she needs a guardian

to be appointed in her behalf and to obtain court approval to
file an election in her behalf to take against the aforesaid
Wi I I of her deceased husband.The extent of or monetary interest
~f the alleged incompetent in her deceased husband's estate is
unknown at the present time.
It is presumed that the Commonwea Ith of Pennsy Ivan i a,
Department of Raenue,by reason of the alleged incompetent's
stay in the state institution,is or would be a creditor,and
it has or would have a claim against her estate for care and
maintenance of the alleged incompetent.
8.No guardian has been appointed for the estate of
the alleged incompetent by 3nother court and your petitioner
suggests that she be appoin~ed guardian of her estate.The
consent of the proposed guardian of the estate is attached
hereto as Exhibit "An.
9.That there IS attached hereto and made a part
hereof an affidavit duly cer,t~ied by the medical examiner in
charge of the said Dixmont State Hospital in accordance with
the Act of Assembly in such case made and provided setting forth
the condition of Josephine Museo,the alleged incompetent,
and marked Exhibit "8".
10.The proposed suardian of the estate has no
interest,adverse to the alleged incompetent and is not a
fiduciary of any estate in ~hich the alleged incompetent has
an interest.
II.Your petitioner requests the Court pursuant to
the Act of February 28,1966 P.l.(1955)1154,as amended by
the Act of July I I,1957,P.t.794,Section I,50 P.S.
Section 3301,to award a c~tation directed to the alleged
incompetent with notice to h3r next of kin residing within the
Commonwealth and to such oth~r persons as the court may direct
to show cause why,Josephine Museo should not be adjudged an
incompetent and why Rose lagnemmashould not be appointed guardian.
WHEREFORE,your pet;tioner prays that she be appointed
guardian of the Estate of Josephine Museo,an alleged incom-
petent,and she wil I ever pray.

since April 28,1944,with a dia~osis of Schizophrenic Reaction,Paranoid
Type.
She is unable to use !ood jud!ement"tel)understand financial matters,
to care for herself,to work or to coDlD1UBicate in a normal manner.She is
out of contact with reality and is psychotic.
I do no·t feel that she is competant to handle her financial affairs

AND NOW comes ROSE IAGNEMMA,the petitioner herein,
and avers as follows:
I.Rose lagnemna,your petitioner herein,was
appointed guardian of the Estate of Josephine Museo,an incom-
petent,by a Decree handed down by your Honorable Court on
.September 3,1969.
2.Josephine Museo,the alleged incpmpetent,is 57
years of age,having beeo born on December 16,1911.The alleged
incompetent was married on October 3,1929 to Guilio Museo,
a/k/a Julius Museo,and their residence was 293 Beech Street,
Muse,Cecil Township,Washington County,Pennsylvania.·By
reason'of menta I ill ness or other menta I irtf i rm ities,the sa id
incompetent was admitted to the Dixmont State Hospital,Dixmont,
Pennsylvania,on April 28,1944,and she continues to remain a
patient at the said State Institution.
3.The said Guilio Museo,a/k/a Julius Museo,the
husband of the alleged incompetent,died testate on March 5,
1969,and by his Last Wi II ar~d Testament dated March 12,1926,

to his mother,M~riantonia Museo,and he designated his uncle,

the said Regist~r of Wills Office in Will Book 107,page 367
and Letters Testamentary on the said estate were issued on
March II,1969 to the aforesaid Pasquale Simone.A copy of the

I.Rose lagnemma,your petitioner herein,is an adult
individual who resides in Morgan,Allegheny County,Pennsylvania,
and she waS duly appointed gu€rdian of the Estate!tof Josephine
Museo,an incompetent,by a Decree handed down by your Honorable
Court on September 3,1969.
2.Josephine Museo,the alleged incompetent,IS
57 years of age,having been b~rn on December 16,1911.The
alleged incompetent was married on October 3,1929 to Guilio
Museo,a/k/a Julius Museo,and thei~residence was 293 Beech
Street,Muse,Ceci I Township,Washington County,Pennsy~nia.
By reason of mental illness or-other mental infir~ities,the,'
said incompetent was admitted to the Dixmont State Hospital,
Dixmont,Pennsylvania on Apri I 28,1944,and she continues to
remain a patient at the said institution;however,her legal
address is 293 Beech Street,Muse,Cecil Township,Washington
County,Pennsylvania.
3.The said Guilio Museo,a/k/a Julius Museo,the
husband of the alleged incompetent,died testate on March 5,
1969,and by his Last Will and Testament dated March 12,1926,
the said Guilio Museo,'devised and bequeathed his entire estate
to his mother,Mariantonia Musec,and he designated his uncle,
Pasquale Simone,to be the E~ecutor of his said Will.The
~foresaid Will waS probated by the Register of Wtlls of Wash-
ington County,Pennsyl~ia,and the same appears of record in
the Reg ister of"Wi II s Off ice in Wi II Book 107,page 367,and
Letters Testamentary on the said 'estate were issued on March II,
1969 to the aforesaid Pasqual,e Simone.A copy of the attresaid
Will IS attached heret~as Exhibit HA"and made a part hereof.
4.The said incompetent was the spouse and is the
surviving widow of the said dacedent.
5.Pursuant to a Decree handed down by your Honorable
Court on October 9,1969,your petitioner,pursuant to authority
granted in the said Decree,filed in behalf of the said Josephine
Museo,an incompetent,an Election to Take Against the Will of
Guilo Museo,a/k/a Julius Museo,the deceased husband o¥the

upon consideration of the averments contained in the Petition To Terminate
Guardianship on behalf of ROSE IAGNEM~A,Guardian of the Estate of JOSEPHINE
MUSEO and the Court Hearing held on t~e same,this case is being transferred
to the Orphan's Court of Allegheny County for the purpose of appointing a
successor Guardian of the said JOSEPHINE MUSEO.Until that appointmen~is
made,ROSE IAGNEMMA is to continue ~s Guardian of s~id Estate.Furthermore,
ROSE IAGNEMMA is to secure the servi~es of an Accountant for the purpose of
rendering a review/report of the books and accounts in her charge for the
past three (3)months,the same to be forwarded to the successor Guardian.
A copy of this Court Order shall be Eerved by ordinary mail to the follow-

personally appeared ROBERT 1.WITTIG,M.D.,who,being duly
sworn according to law,deposes and says:He is a duly licensed
medical doctor and psychiatrist in ~e.State of Pennsylvania;
that he IS a physician and psychiatrist at the Dixmont State
Hospital,a state-owned mental hospital,located at Glenfield,
Pennsylvania;that Josephine Museo has been a mental patient
at Dixmont State Hospital since Apri I 28,1944,with a diagnosis
of Schizophrenic R~action,Paranoid Type;that she is unable to
use good judgment,to understand financial matters,to care for
herself,to work or communicate In a normal manner;that she is
out of contact with real ity and IS psychotic;that because of her
mental condition her welfare would not be promoted by her presence
at a hearing in connection with the appointment of a guardian
for her estate;that he does not feel that she is competent
to handle her financial affairs and would be at the mercy
of designing persons;that as to prognosis,her condition wil I
remain the same for an indeterminate period of time.
