No.63-69-799 PET I T ION FOR LEAVB OF COURT FOR EXECUT ION AND FOR SALE OF REAL ESTATE AND NOW,comes the Petitioner,Falconi Motor Company, Inc.,by its Attorneys,Bloom,Bloom,Rosenberg &Bloom,and res- pectfully represents as follows: 1.The Petitioner,Falconi Motor Company,Inc.,is a judgment creditor and holder of the first lien against all the rea estate of Margaret W.van Eman,a/k/a Margaret S.van Eman,a/k/a Margaret G.Van Eman,who died on October 29,1968. 2.The petitioner entered judgment on November 12,1964 on a certain qudgment Note dated January 3,1964,for the sum of $91,000.00,with interest at the rate of six per cent (6%)from January 3,1964,against the said Margaret W.Van Eman.The said Judgment Note was entered in the Court of Common PleaSI of Washing ton County,pennsylvania,at No.110 November Term,1964,D.S.B. 3.The petitioner commenced proceedings in the Court of Common Pleas of Washington County,Pennsylvania,on October 24, 1969,at No.542 september Term,1969,A.D.,for the purpose of reviving and continuing the lien of the judgment entered at No. 1 110 November Term,1964,D.S.B.In the said revival action a rule was issued upon Mary van Eman Soffel,to show cause why she should not be substituted as a party defendant to the action and an Order for Substitution was made on December 10,1969,whereby she was substituted as a party defendant in place and stead of the said decedent.Judgment was entered on December 11,1969,for the sum of $123,305.00. 4.The will of Margaret W.Van Eman,a/k/a Margaret S. van Eman,a/k/a Margaret G.Van Eman,was duly admitted to probate on July 7,1969,and Letters issued to Mary Van Eman Soffel,as Executrix.The estimated value of the Estate as shown on Appli- cation of Letters Testamentary filed in will Book 108,page 249, set forth as Personalty,$3,500.00,and Realty,$15,000.00.Said real estate being situate in the Second ward in the Borough of Canonsburg.The said Mary Van Eman Soffel is also designated as the sole legatee.No further proceedings have been filed by the Estate. 5.The said real estate in the above-captioned Estate has been continually listed for Tax Sale by the washington County Tax Claim Bureau for non-payment of taxes since 1966,and the Petitioner has continually made payments to the washington County Tax Claim Bureau to keep the real estate from proceeding to Tax Sale.The real estate had been set for the recent Tax sale of September 14,1970,and the same had been removed from the Tax Sale through the efforts of your Petitioner's attorneys. WHEREFORE,Petitioner prays that a citation issue directed to Mary van Eman Soffel,Executrix,of the Estate of Margaret W.Van Eman,alK/a Margaret S.Van Eman,a/k/a Margaret G.Van Eman,deceased,and to Mary Van Eman Soffel,as sale legatee under the Will of Margaret W.Van Eman,a/k/a Margaret S. VAN EMAN,Deceased. ). ). ) No.63-69-799 ANSWER TO CITATION AND PETITION AND NOW comes Mary Van Eman Soffel,Executrix of the Estate of Margaret W.Van Eman,a/k/a Margaret S.Van Eman,a/k/a Margaret G.Van Eman,Deceas.ed;and sole legatee under the Will of said decedent and makes the following answer to the citation and petition of Falconi Motor Company in the captioned matter: 1.The averments of paragraph No.1 of the Petition are admitted in part and denied in part.It is denied that Falconi Motor Company,Inc.is the holder of the first lien against all of the real estate of Margaret W.Van Eman,a/k/a Margaret S.Van Eman,a/k/a Margaret G.Van Eman,for the reason that the judgment entered at No.110 November Term,1964 D.S.B.was entered against, inter alia,Margaret E.Van Eman,as by reference to the record thereof .will more fully appear.The remaining averments of said paragraph are admitted. 2.The averments of paragraph No.2 of the Petition are admitted in part and denied in part.It is denied that the said judgment was entered against Margaret W.Van Eman and,on the contrary,it is averred that the judgment was entered against Margaret E.Van Eman,as stated above.The remaining averments of said paragraph are admitted. 3.The averments of paragraph No.3 are admitted in part and denied in part.It is denied that judgment was entered on December 11,1969,for the sum of $123,305.00,as by reference to the record thereof will more fully appear.The remaining aver- ments of said paragraph are admitted. 4.The averments of paragraph No.4 of the Petition are admitted. 5.The averments of paragraph No.5 of the Petition are neither admitted nor denied,and the answering parties believe, and therefore aver,that the same are not material or relevant to the matter in issue. 6.For further answer to the averments of said Petition, it is averred that an execution as prayed for by the petitioner, if approved by your Honorable Court,would substantially exhaust the assets of said estate to the detriment,loss and damage of claimants who,under the Decedents'Estates Laws of this Common- wealth,have preferred claims. 7.In further answer to the averments of said Petition, the answering parties,being informed,therefore believe and aver that the judgment,upon which execution is sought,arose out of a "confessed judgment"and that execution on such judgments by the Sheriff of Washington County has been restrained by an Order of the United States District Court for the Western District of Pennsylvania in a Civil Action at No.70-503 in said Federal Court. 8.The answering parties,being informed,believe and therefore aver,that your Honorable Court's approval of the petitioner's request would result in irreparable harm to numerous persons,who have had no notice of the Citation,the Petition or the relief sought and who have had no opportunity to appear and make answer thereto;and that,therefore,this Honorable Court,in the exercise of its equitable powers,should refuse the relief -2- sought by the petitioner. 9.In further answer to the averments of the Petition, the answering parties being informed,believe and aver that the Petition does not show sufficient cause nor the required necessity for approval by your Honorable Court under Section 607(a)of the Fiduciaries Act of 1949 (20 P.S.607). 10.In further answer to the averments of the Pe~ition, the answering parties,being informed,believe and aver that the provisiornof the Fiduciaries Act of 1949 fully,adequately and specifically set.forth,and provide~the proper and legal action in handling the claim of the petitioner and afford the petitioner the full and adequate relief,to which it may be entitled for and on account of the claim set forth in its Petition. Margaret Van Eman died on October 29,1968,and her husband,Samuel Van Eman,Sr.,died on December 5,1968.An inventory was filed for each estate on August 24,·1979,with appraisements filed in Margaret's estate on July 31,1980,and in Samuel's on August 1,1980.A statement of Debts and Deductions was filed in Samuel's estate on November 20,1980,which listed .$171,819.25 in debts.A statement of Debts and Deductions was .1; " filed in Margaret's estate on January.30,19B1,which listed .$169,613.23 in debts.Both statements of Debts and Deductions listed'$161,150.12,joint obligations of the husband and wife in the nature of judgments.On February.3,19.Bl,the Register of Wills of Washington county disallowed the entire'.$161,150.12 as to Margaret's estate on the basis that the total amount had been allowed to Samuel "s estate.This appeal,which contests the inheritance tax levied on Margaret Van Eman's estate due to the disallowed deductions,followed~ ..1 Appellant's brief argued that in accordance with .Kershaw Estate,352 Pa.205,42 A.2d 538(1945),one half of the joint judgment debt {$80,S75.06)should be considered a deduction from Margaret's estate.We agree •In''Ke'r'shaw the issue was whether, for inheritance tax purposes,an estate can deduct one half of the amount of a mortgage on real estate held by a decedent and his wife as tenants by the entireties,and passed to the wife by survivorship. The court decided that it was permissible."The controlling fact is that he,together with his wife,was personally liable on the bond;that liability continued after his death and therefore consti- tuted a debt of his estate.""Id.,at 206,'42 A.2d at 538.The 1.We have not had the benefit of the Commonwealth's brief.The attorney for the Commonwealth was directed on July 7,'1981,to file a reply brief by July 27,1981.On August 3,19.Bl,the attorney for the Commonwealth was again contacted and directed to file a brief.On A~gust 12,1981,a third message requesting a brief was conveyed to the office of theCornmonwealth attorney. - 2 - '/. court went on to state: "Hence,if collection on this bond were made from the estate,a right of contribution would automatically arise against the widow;if collection were made from the widow,she would have a similar right of contribution against the estate;therefore the ultimate liability of the estate is only for one half of the indebtedness.Or,viewing it from another angle,the right of the estate to enforce contribution may be regarded as a taxable asset which offsets,to the extent of one half,the full deduction to which the estate would otherWise be entitled." This principle was endorsed and extended in'D(:)w:ler I Est'ate,368 Pa.SI9,84A.2d 209 (1951},whichqgain dealt with a mortgage on entireties''property.Relying on'Kershaw,the same result,the surviving spouse being entitled to contribution,was reached.While Dowler,did not deal with inheritance tax,the court specifically stated that the same principle applied and ,granted the surviving spouse one half the balance due on the mort- 9age as a debt of decedent's estate.'Dowler went on to extend this principle to a judgment note signed by both 'spouses,holding l'this claim falls in the samecatagory as the bond and mortgage and must be allowed."'~.,at'523,84A.2d at 2l0.Therefore,in the instant case,it is of no moment that we are dealing with a jUd9'"" ment debt and not areal estate mortgage. In 'Kritz Est'ate,387 pa.223,'127 1\.2d 720 (1956},another Inheritance Tax case,the estate left no assets subject to admin- istration but separate parcels of real estate passed to the decedent's husband and sister by the entireties and by joint tenants with right - 3 - ..~ of survivorship,respectively.The one half of the joint tenancy subject to Inheritance Tax was allowed a deduction of one half of the mortgage on the entireties property which was not subject to the tax. "Decedent's liability on the bond accompanying the mortgage on Tyson Street ffintiretie§7 property was clearly a 'debt of the decedent;'had there been assets in the testamentary estate it would have been payable therefrom and clearly deductible;the fact that there were no assets thereto meet it does not make it any the "less a debt of the decedent." "Id.,at 226,"127 A.2d at 722. It is therefore clear that one half of the joint judg- ment debts of Margaret Van Eman and Samuel Van Eman,Sr.,should be allowed as a Debt and Deduction against Margaret Van Eman'sestate and should be utilized in the calculations of Inheritance Tax.
