Paragraph 2 of the Will makes a specific bequest to daughter,Mary Ponce,of
$200.00,which is a charge upon real estate inParagraph 6.Mary Ponce died in
June,1958,leaving two sons,Vincent Ponce,and Michael Ponce,who died without
issue in August,1959.The Executor is unable to locate Vincent Ponce or Mary
Ponce's surviving husband.
The Commonwealth of Pennsylvania condemned the real estate,which was the
only asset of the estate,in April,1970.Therefore,additional time will be
needed'to,close the'estate."<

County,Pennsylvania,being of sound ~ind and memory,do hereby
make,publish and declare this to be my Last Will and Testament,
,in manner and form following,hereby revoking any Will or Wills
hereto made by me.
FIRST:I direct that all my just debts and funeral ex-
penses be fUlly paid and satisfied,as soon as conveniently may
be,after my decease.
SECOND:I give and bequeath to my daughter,Mary Ponce,
the sum of Two Hundred ($200.00)Dollars.
THIRD:I give and bequeath to my son,Joseph ZUbrik,
the sum of~wo Hundred ($200.00)Dollars in trust,however,for
the following uses and purposes,to-wit:-
Such Trustee shall pay to my grandchildren,Stephen
Zubrik Jr.and Mary Rose Z~brik,the children of my deceased son
Stephen Zubrik,the sum of One Hundred ($100.00)Dollars each :
when they arrive at the age of eighteen (18)years and the receipt:
of such grandchildren for such sums or money shall be a good and :
sufficient receipt for such money and shall discharge such Trusteel
and the real estate from the said obligation.I
IFOURTH:I give and bequeath all my shares of stock to my:
sons,Joseph Zubrik and Michael Zubrik,share and share alike.
FIFTH:All the rest"residue and remainder of my estate,:
whether real,personal or mixed,and wheresoever the same may be
situate at the time of my decease,I give,devise and bequeath unto
my two sons,Michael Zubrik and Joseph Zubrik,share and share i
alike.IIiSIXTH:I hereby declare that it is my intention that the i
specific bequeaths to my daughter,Mary Ponce,and my grandchildren,
Stephen Zubrik Jr.and Mary Rose Zubrik,shall be a charge on my
~eal estate and sh~uld be paid by my sons,Michael Zubrik and
Joseph Zubrik.Provided,however,that such charges on said real ;
estate may be satisf:i.ed a~.any.time upon payment by my said two
sons of the Two Hundred (~200.00)Dollars to mr daughter,Mary
Ponce,and by the payment of the One Hundred (;;;>100.00)Dollar be-
queaths to each grandchild upon their arrival at the age of eighteen
(18)years or upon depositing said sums in the Mellon National
Bank &Trust Company of Donora,Pennsylvania,or its successor.Con-
ditioned upon payment of said sums to the said grandchildren upon
their arrival at the age of eighteen (18)years.

As set forth in the Audit Petition,paragraph two of the
Will makes a specific devise of $200.00 to her daughter,Mary Ponc .
Subsequent to filing the Audit Petition,a death certificate was
received from the State of New York showing that Mary Ponce died
at Hornell,New York,on June 6,1958.She was survived by her
husband,Manuel Ponce,a/k/a Mic~:ael Ponce,who died on August 2,
1970,and three children,Michael Ponce,Jr.,Vincent Ponce,and
'----..--
Josephine Ponce Robinson.
Michael Ponce,Jr.,died on August 25,1959.His only -son
to his divorced wife was adopted by wife's husband of remarriage,
Robert Brown,in Allegheny County in October,1960.
Vincent Ponce left New York shortly after his mother died,
and Josephine Robinson states that neither she nor her late father
had heard from him since.
Josephine Ponce Robinson is handling her father's affairs
and has employed Attorney Nicholas Changose,of Six Broadway,
Hornell,New York,who advised the Executor's attorney that he
would cooperate with us as to this devise.
Executor therefore suggests the following:
(1)That $100.00 be awarded to Josephine Ponce
Robinson,heir of Mary fonce;and
(2)That the share of Vincent Ponce of $100.00 be
paid into Court until.such time as his whereabouts or death is
determined.

MR.BARNA:Your Honor.there's just one piece of property
in this estate.a piece of real estate,that since filing our account,h s
been dondemned by the Commonwealth of Pennsylvania.It was the
intention of the Executor to take it in kind but since these proceeding
are going on we'd like to keep the estate open until we conclude our
dealings with them.Secondly,there's a specific bequest to a daughter,

And we have been unable to locate her one surviving son.We did
