were of said deceased within this Commonwealth,you having taken and subscribed the oath of office

TO THE HONORABLE P.V.MARINO,President Judge of said Division:
The Petition of Maryland Casualty Company respectfully
represents:
1.That S.James Longo,-also known as Salvatore James
Longo,died intestate 'on April 16,1961,a resident of the Boroug
of Burgettstown,Washington County,Pennsylvania.
2.That application for Letters of Administration upon
said decedent's estate was made by his son,Anthony A.Longo,on
April 24,1961,and a bond offered with Maryland Casualty
Company as surety thereon in the amount of $8,000.00 and that
said bond was approved and Letters of Admini.stration granted to
the said Anthony A.Longo on April 26,1961.
3.That the said grant of letters was duly advertised
as required by law,the first complete advertisement thereof
having been made on May 4,1961.
4.That an Inventory and Appraisement was filed in the
Office of Register of Wills of Washington County,Pennsylvania,
on May 4,1961,and is of record therein in Inventory Book 72
at page 304,which Inventory and Appraisement listed personal
property of $4,570.26 and real estate,consisting of vacant lot
on Main Street in Burgettstown,Pennsylvania,at a value of
$500.00.

5.That more than six months have elapsed since the
first complete advertisement of the grant of Letters of Admin-
istration in said estate and no Account has yet been filed by
the said Anthony A.Longo as such administrator,although your
petitioner has made demand upon him for the filing hereof.
6.That there is no justification for such delay in
filing the Account in said estate and the consequent delay in
termination of the liability of your petitioner as surety on the
administration bond.
WHEREFORE,your petitioner prays your Honorable Court
to issue a citation,directed to the said Anthony A.Longo,to
show cause why he should not file an Account of his administratio
of the estate of the said S.James Longo,also known as Salvatore
James Longo,deceased.

personal property in the amount of approximately $4500.00 and a vacant
lot in the Borough of Burgettstown valued at $500.00 for total Inventc ry

been made to preferred creditors and to other creditors of the estate
wims e claims exceed the value of the estate.Later in the administrc tion
of the estate it is my understanding that Maryland Casualty Company
who carried the bond of the Administrator was seeking.was applying
pressure to the Administrator to file an account.The attorneys for

the accountant were also trying to apply pressure in order to gettthis
matter cleared up.Finally,an account w as filed and now we come fc r
audit showing an insolvent estate.However,we acknowledged receip "
:ig of the claim which Mr.McCreight,on behalf of Maryland Casualty,
CIziUl filed with Mr.!.C.Bloom on June 4,19'70,at least formally so,~
in which he set forth a claim of $80.00 on unpaid premiums for
Administrator's bond for a period beginning April 24,1969~and the
sum of $179.1.11.2 for legal fees and costs incurred tociat~at that num ber
and term in proceedings to compel the filing of the account.·
vi~~Now the estate is insolvent.When the Admjnistr:ator
~oII...~came to my office to sign the Audit Petition I advised him of this cla.m ...~:::l8 And I can report informally to the Court that he ac~nowledged the dept

U $ii:of the 80.00 premium.But he did not acknowledgea the debt of the

attorney's fees for the prcc eedings to com(3el the filing of the accourt.
Again.informally.is the only way I can speak.I believe that the
$80.00 claim would be admitted.although I have not formally ad-

became necessary to compel the filing of the account,and by this,we
imply no criticism of counsel for the Administrator because counsel
for theAdn inistrator were using their best efforts to try to get the
Administrator to account;an order was issued by Your Honorable
Court last August of 1969,requiring the account to be filed on or
before September 15,1969.The accountwasnot filed.And finally,thp
counsel for the estatehwas able to get the Administrator to prepare,
come in for preparation and filirig'fpf the account only after we had
prepared a .Petition for a Citation for Contempt.
Now our position is,Your Honor,tha:t of course,
the bond premium is an expense of administration and therefore,a
preferred claim.It appears to us also tba t the legal fees and costs,
and some'part of this is costs,should also be a preferred claim,
but part because it's also a necessary expense apparently in the ad '-
ministration of this estate.And furthe r,if the Administrator,as
appears from the account,has paid lower priority claims,it appears
to us that this is a question of surcharge.
THE COURT:Undoubtedly.it would be.But as I understand it
here,the preferred claims that were paid were probably all of the
same category.
MR.McCREIGHT:No,they were not,Your Honor.There we re bill

physician's services to the decedent during his last illness which
would be of a lower priority than costs of administration.And I
don't remember off-hand,but I think there we re others of the same

MR.GLADDEN:If the Court please,I would only poiIt out that
unfortunate ly,this matter has gone on for a long period of time.a
lot longer than necessary.Some of these preferred claims were paic
when there was money available to pay them.And the claim which
Mr.McCreight presents arose only last year:Now there is no quest"on
in my mind.at least that the Administrator is certainly responsible
personally if necessary to pay the bond premium.And I had so advis~d
hiJIl.The question of attorney's fees is a matter which I was not ablE
to advise him that he was obligated to pay.and therefore.will not
admit.
