PETITION FOR PAYMENT OF CERTAIN
OIL AND GAS RENTS AND ROYALTIES
TO THE HONORABLE, THE JUDGES OF SAID COURT:
The petition of HARRY W. GRAY respectfully represents:
1. That your petitioner is the son of George K. Gray and
Florence Viola Gray, both now deceased.
2. That your petitioner is the Executor of the Estate of
Sara G. Herriott, deceased, who was the Administratrix of the
Estate of said George K. Gray, deceased, and who was also the
Administratrix of the Estate of Florence Viola Gray, deceased.

3. That said George K. Gray died, intestate, on January 11,'
1949, seized of certain interests in the Fordyce Lease, con-
trolled by Dunn-Mar Oil & Gas Company, and in the Eddy Lease,
controlled by Paul McClure, Agent, which interests are set forth j
in the Inventory and Appraisement filed in the Estate of
George K. Gray, deceased.
4. That thereafter, in the Estate of Florence Viola Gray,
deceased (widow of said George K. Gray), and in the Estate of
Ruth Gray Henry, deceased (a daughter of said George K. Gray),
said decedents' respective interests in said Fordyce Lease and

I Eddy Lease were included, inter alia, as assets in the partner-

1 ship known as "Geo. K. Gray & Son", as set forth in the Inven-
tory and Appraisement filed in each of the aforesaid Estates,
and distributed as such to the respective distributees in said
Estates, and all taxes paid thereon.

5. That since the death of said George K. Gray on January
1949, checks of Dunn-Mar Oil and Gas Company and checks of Paul

McClure, Agent, for payments on account of the aforesaid interests!
in the Fordyce Lease and the Eddy Lease, have been made payable
to "George K. Gray Estate", and Sara G. Herriott, Administratrix
of the Estate of George K. Gray, deceased, then endorsed such
checks, and same have been deposited in the partnership account of
"Geo. K. Gray & Son", owned by members of the family, the family
having agreed that said interests are properly assets of said
partnership.
6. That the said Sara G. Herriott died on November 7, 1968,
and there is no person legally qualified to endorse checks made
payable to "George K. Gray Estate".
WHEREFORE, your petitioner prays your Honorable Court to
authorize and direct Dunn-Mar Oil and Gas Company, to make checks
for all payments due after November 7, 1968, on account of said
interest formerly held by George K. Gray in the Fordyce Lease,
to the order of "Geo. K. Gray & Son"; and further, to authorize
and direct the Agent for the Eddy Lease, to make checks for all
payments due after November 7, 1968, on account of said interest
formerly held by George K. Gray in the Eddy Lease, to the order
of "Geo. K. Gray & Son".

HARRY W. GRAY, who, being duly sworn according to law, deposes
and says that the facts set forth in the foregoing Petition are

the only parties in interest in the Estate of George K. Gray,

mot1on of Alexander Mcilvaine, Esq., Attorney for
the Petitioner, and it appearing to the Court that the interests
in certain Leases, known as the Fordyce Lease and the Eddy Lease,
formerly held by George K. Gray, are properly assets-Df the
partnership known as "Geo. K. Gray & Son",
IT IS ORDERED AND DECREED that Dunn-Mar Oil and Gas Company
is hereby authorized and directed to make checks for all payments ,
due after November 7, 1968, on account of the interest formerly
held by George K. Gray in the Fordyce Lease, to the order of
"Geo. K. Gray & Son"; and further, the Agent for the Eddy Lease
is hereby authorized and directed to make checks for all payments
due after November 7, 1968, on account of the interest formerly
held by George K. Gray in the Eddy Lease, to the order of
"Geo. K. Gray & Son".
