PETITION FOR SETTLEMENT OF A SMALL ESTATE UNDER PROVISION OF SECTION 202 OF THE FIDUCIARIES ACT-.. ' OF 1949, AS AMENDED AND ORDER TO THE HONORABLE, THE JUDGES OF SAID COURT: The petition of Elizabeth C. Kramer respectfully represents: 1. That she is the daughter and executrix of Harry F. Carson, deceased, who died on March 7, 1969, a resident of Bentleyville, Washington County, Pennsylvania. 2. That Letters Testamentary, a copy of which is attached hereto as Exhibit "A", were issued to her on June 23, 1969 by the Register of Wills of Washington County, Pennsylvania. 3. That the said Harry F. Carson died testate, leaving a Will dated April 10 1 1964 1 a copy of which is attached hereto as Exhibit "B", wherein the said testa tory bequeathed all of his property to his wife, Sevilla C. Carson. 4. The only assets of the Estate of Harry F. Carson is the sum of $2, 000.00, which sum was recovered in a wrongful death action instituted by your said executrix in the Court of Common Pleas of Washington County I Pennsylvania at No. 36 March Term, 19701 A.D., trn said sum of money having been received by your executrix on September 25, 1970. Carson is the surviving spouse of your petitioner's decedent, who lived in a marital relationship with the said decedent until the time of his death, March 7, 1969. 6. The last debts and expenses of the said Harry F. Carsom. consist of a funeral bill of the Kenneth V. Thompson Funeral Home in the amount of $1241.00, attached hereto as Exhibit "C", attorney's fees in the amount of $666.00 in the recovery of the settlement proceeds, payable to Lawrence R. Zewe, Esquire. 7. All of the aforesaid debts and expenses which are properly due and owing by . .the Estate of Harry F. Carson have been paid by his widow, Sevilla C. Carson, and there are no outstanding claims against the aforesaid estate which have not been satisfied in full. WHEREFORE, your petitioner, Elizabeth C. Kramer, respectfully petitions your Honorable Court to enter a Decree directing the payment of $2, 000.00, the total assets of the above estate, to the legatee under the terms of the Will, Sevilla C. CARSON, DECEASED DECREE NO. _____ of 1970, O.C. ce_ AND NOW, this JQ_Cfay of -..a,..,P=:!!~f--F.:....JL____:,!!___, 19 70, upon consideratio, of the annexed petition and pursuant to the p visions of Section 202 of the Fiduciaries Act of 1949, as amended, the s urn of $2, 000.00, which is the total amount of the assets in the hands of the executrix in the Estate of Harry F. Carso.n I is directed to be paid to the legatee, Sevilla C. Carson, and it is further directed that the executrix, Elizabeth C. Kramer, be discharged from further duties and responsibilities as executrix of the Estate of Harry F. Carson, Deceased. BY -"' -l3 I, HARRY F. CARSON, of the Borough of Bentleyville, Washington County, Pennsylvania, being of sound mind and memory, do hereby make, publ~~h and declare this to be my Last Will and Testament, in the manner and form following, hereby revoking any will or wills heretofore made by me .. FIRST: I direct that all my just debts and funeral expenses be paid as soon as may be conveniently sone after my decease. I SECOND: I give, devise, and bequeath all of the rest, residue, and remainder of my estate, whatsoever in nature, and where-~ soever in nature, and wheresoever situate at the time of my death, to! my beloved wife, SEVILLA C. CARSON, absolutely, and in fee simple, l her heirs and assigns forever, if she shall survive me; but, if my I said wife shall predecease me, or if we both shall die as the result I of a common accident, then, and in such event, I give, devise, and bequeath all of the rest of my said residuary estate in the manner following: ( 1. I direct that my home in Bentleyville, Pennsylvania, shall be sold, and that the entire net proceeds thereof, exclusive of the transfer inheritance taxes pertaining thereto, be distributed to my beloved daughter, Grace I. Carson; I wish the said transfer inheritance taxes pertaining to this house to be paid by her. 2. I authorize and empower my Executrix, here- inafter named, to convert all of the other ·assets of my estate into cash as soon as is reasonably possible, and, thereupon, to m_ake the following distribution of my said residuary estate, in two equal shares, share and share alike, their heirs and assigns forever, to my beloved daughters: Elizabeth C. Kramer and Grace I. Carson. Should my Executrix deem it advisable,· they may elect to take in kind. -1- I I .. . I •. .... ... I. I •' THIRD: Should my beloved daughter, Grace I. Carson, predecease me, I direct that her entire share of my estate shall go to my beloved daughter, Elizabeth C. Kramer, her heirs and assigns, forever and abs~lutely. I do hereby nominate, constitute, and appoint. ELIZABETH C. KRAMER, to be the executrix of this, my Last Will and Testament.
