PETITION FOR APPROVAL OF PRIVATE SALE
OF UNDIVIDED INTEREST IN REAL ESTATE
TO THE HONORABLE P. V. MARINO, PRESIDENT JUDGE OF SAID COURT:
The Petition of PITTSBURGH NATIONAL BANK respectfully
represents:
1. That a guardian was appointed for Mary Elizabeth
Warrick Pollock by the Court of Common Pleas of Washington County,
Pennsylvania, as appears at No. 3704 In Equity, and that Peoples
First National Bank and Trust Company was appointed Successor Fiduci-
ary at No. 13-320 of 1954, 0. C., and that your petitioner became
successor by consolidation of Fidelity Trust Company and Peoples
First National Bank and Trust Company by virtue of Decree dated
October 5, 1959, appearing of record at No. 437 of 1953 o. C.
2. That your petitioner has in its hands total invested
funds in the sum of $2,086.65, and uninvested cash in the amount of
$313.23.
3. That Mary Elizabeth Warrick Pollock is the owner of the
following undivided interest in real estate:
Undivided 1/3 interest in tract of land situate
in North Strabane Township, Washington County, Penna.,
containing 160.12 Acres adjoining Munce on the North,
Thorn on the East, Longstreth, formerly Martin, on the
South, and Willis Martin on the West and fully described
in Exhibit "A" attached hereto.
4. There are no obligations owing by the incompetent, except
the Order of Court providing for her maintenance at Mayview State
Hospital, which amounts to about $11.20 per day.
5. Your petitioner desires to sell the interest of the in-
competent in the tract above set forth, as fully described in
Exhibit "A".
6. The total rental value of the real estate is $500.00
per year and the taxes and insurance in 1968 amounted to $341.11.
The share of the incompetent is a 1/3 interest in the net proceeds.
7. Official certificate of the assessed value of the
property proposed to be sold is attached and marked Exhibit "B".
8. Your petitioner, as guardian of the estate of the
incompetent, has, with others, entered into an Agreement, under date
of June 16th , 1969, with Richard 0. Gilleland and Elva Ann
Gilleland, his wife, for the sale of the farm situate in North Strabane
Township, Washington County, Pennsylvania, for the price or sum of
$16,000.00, to be paid in the following manner: $1600.00 upon the
sighing of the Agreement, and the balance of $14,400.00 upon delivery
of the deed and approval of the Court, copy of which Agreement is
attached hereto and marked Exhibit "C".
9. Your petitioner believes the total price of $16,000.00
to be greater than could be obtained at public sale.
10. There is attached hereto an affidavit of two competent
persons as to the value of the real estate proposed to be sold.
11. Your petitioner believes that the sale of this property
will be for the best interests of the incompetent by reason of the
difficulty experienced in keeping a suitable tenant in the property,
which is in need of repair; by reason of the difficulties of adminis-
tration resulting from the several interests involved,and by reason
of the immediate need for major repairs to the buildings for which
no funds are available. At the current charge for maintenance it
is necessary to sell to provide for the incompetent's support.
12. All parties who would be heirs at law of the incompetent
under the Intestate Laws of Pennsylvania have indicated their approval
of the sale by signing the Agreement for sale, said parties also
owning undivided interests in the real estate which is the subject
of this petition.
WHEREFORE, your petitioner prays your Honorable Court
to approve the sale by your petitioner of the undivided interest
of the incompetent to Richard 0. Gilleland and Elva Ann Gilleland,
his wife.
And it will ever pray, etc.

BEGINNING at a white oak; thence by land now or formerly of
J. L. Thome and the James Thome Estate, South 17 1/2° East 3294 feet
to a point; thence South 66° East 330 feet to a point in line of land
now or formerly of James Martin; thence by James Martin, South 70 1/4°
West 1982 feet to a stone; thence by land now or formerly of William
Martin, North 26° 47' West 490 feet to a white oak; thence South 86°
30' West 449.7 feet to a stone; thence North 34° West 478 feet to a
stone; thence by land now or formerly of Andrew Bros., North 25° 10'
West 686.9 feet to a stake or dogwood; thence North 33° East 100 feet
to a hickory stump; thence North 26 3/4° West 423 feet to a stone;
thence North 39 1/2° West 276 feet to a peg; thence by land now or
formerly of William Munce, North 69° East 402.6 feet to fallen black

The cost of Pennsylvania Real Estate Transfer Stamps and local Real Estate Transfer Stamps shall be borne equally by the
seller and the buyer.

The seller will maintain it's present Fire and Extended Coverage Insurance in the amount of $ ... f.ODa:..t'KL ........... on the
within described property. It is understood and agreed that the within Agreement will not be cancelled by reason of
damage or destruction by reason of fire or other casualty. The net proceeds of any insurance collected by seller prior to
the settlement and all unpaid claims and rights in connection with losses under any policies will be assigned to the buyer at
settlement. The amount of such unpaid claims will not, however, be credited against the P..Urchase price. The buyer
hereby assumes the responsibility of paying for and securing any additional insurance coverage he may desire.
Should the buyer fail to make settlement .(or pay all7' additional deposit as herein provided), the aggregate sum or sums
paid on account 111ay be retained by the seller, either as liquidated damages or on account of the purchase price, as the seller
may elect. If the said moneys are retained as damages, the sale will be void 1and this Agreem~nt will be surrendered up to
the seller for cancellation.
If the buyer raises any objection to the title which the seller is unable or unwilling to remove and which the buyer does not
waive, then, notwithstanding any provisions in this Agreement or previous negotiations o~ communications in reference to
such objections, it is understood and agreed that the seller has the option of cancelling this Agreement; and in that case all
deposit money paid shall be returned to the buyer without interest, and the seller shall not be liable for any costs, com-
missions or other compensation, and this Agreement shall forthwith become void and of no effect.
It is understood and agreed that the above described property has been physically inspected by the buyer and is being
purchased by the buyer as a result of such inspection without reliance upon any representations made by the seller or its
agent or broker, and that the seller shall not be responsible for any agreement, condition or stipulation not specifically set
forth herein relating to or affecting the physicaLcondition of the property.

This Agreement shall not be recorded in the Office of the Recorder of Deeds or any other public office. If the buyer causes
it to be recorded he will be considered in default hereunder with the right of the seller forthwith to cancel this. Agreement
and to retain the hand money as damages or to exercise any other rights and remedies available by reason of the buyer's default.
"This document may not sell, convey, transfer, inClude or insure the title to the coal and right of support underneath the surface land described
or· referred to herein, anr./-the owner O!._OWners of such coal may hqve the complet~ legal right to:remove al(of such coal and, in that connection,
damage may result to the· surface 'of the land anq any house, ·building or other structure on or in such land. The inclusion of this notice_ does
not enlarge, restrict or modtjy any legal rights or estates otherwise-created, transferred, excepted or reserved by this instrument."
This Agreement shall extend to and be binding upon the heirs, executors, administrators and successors of the respective
parties hereto and shall not be assigned by the buyer without the written consent of the seller.
This Agreement, as written, contains all the terms and 'conditions of the agree,ments en~e~d int~ between the parties hereto
and there are no collateral agreements between the parties relating to any matter not contained herein, PROVIDED,
HOWEVER, that this agreement shall be of no force and effect unless-and.-until,it is executediby all parties h_ereto.

ALBERT E. DICKS and ERNEST R. WELTNER
who, being duly sworn according to law, depose and say that they
have inspectedfue real estate proposed to be sold by the Guardian
of the Estate of Mary Elizabeth Warrick Pollock and that they are
acquainted with the value of the real estate in the locality of
such real estate, and that they are not employees of the fiduciary
nor personally interested in the proposed sale, and that in their
opinion the overall price of $16,000.00 for the premises situate in
North Strabane Township, Washington County, Pennsylvania, to be paid
at the proposed private sale is greater than can be obtained at
public sale.

DECREE APPROVING PRIVATE SALE
. AND NOW, July ;1~, 1969, a Petition for Approval of Private Sale of
an undivided interest of Mary Elizabeth Warrick Pollock, an incompetent, in cer-
tain real estate situate in North Strabane Township, washington County, Pennsyl-
vania, having been presented to the Court on June 23rd, 1969, and the Court having
fixed July 14th, 1969, at 10:00 o'clock A. M. as the time for approval of said sale
and at the time fixed to approve said sale, it appearing that notice of said pre-
sentation had been given pursuant to the Court Order, and another bidder being pre-
sent and bids being received for the same, and the highest price bid of $20,000.00
for the whole having been met by the original parties, the sale of the undivided in-
terest of the said Mary Elizabeth Warrick Pollock to Richard o. Gilleland and Elva
Ann Gilleland, his wife, for one-third of the purchase price of $20,000.00 is hereby
approved and confirmed, and the Pittsburgh National Bank, Guardian of the Estate of
Mary Elizabeth Warrick Pollock, an incompetent, is authorized and directed to join
with the other parties in interest in executing and delivering to the purchasers a
deed for

on August 20, 1934 at No. 3704 In Equity in the Court of Common Pleas of Washington County.
Jurisdiction of this Estate was transferred to No. 13 of 1954 of the Orphans' Court
of Washington County by Decree dated January 28, 1954~
Washington Union Trust Company, :J:aving elected to go into voluntary liquidation,
filed its First and Final Account ~o No~ 13-320 of 1954 0. C. and submitted its resignation;
whereupon, your Honorable Court accepted said resignation and, on June 9, 1954, at the
same number and term, appointed Peoples First National Bank & Trust Company (now Pittsburgh

of $16, 000. We have the Affidavit of Posting, Proof of Publication
in the Observer-Reporter, and the Washington County Reports for
two weeks as required by the Court's special Order. There was
to be no notice given to the other parties in interest, inasmuch as

MR. MORRISON: Harold Morrison, Eighty-Four, Pennsylvania.
THE COURT: Now Mr. Morrison, do you understand that the
bid on this is for the entire interest, not the one-third?
MR. MORRISON: Yes.
THE COURT: And are you wishing to bid on the entire intere?t?
MR. MORRISON: The entire interest, the entire tract of land.

must appear at the same time and we will have an auction in this
matter. Is there anyone else interested in this? If there is, please
come up to the Bar. All right, since we will have to conduct an
auction in this matter, Mr. Hana, will you kindly explain the way
in which our auction is conducted?
MR. CONTE: Your Honor, could we ascertain whether or
not Mr. Morrison is representing himself as the prospective
purchaser?
MR. MORRISON: I will clarify that. I am representing myself

and a man by the name of James T. Herron of Canonsburg, of which
the title I would want drawn to him. I am acting on his behalf
and my own.

THE COURT: All right, we willconduct the auction. Mr.
Hana, will you explain the manner in which we conduct our auction?
MR. HANA: In Orphans' Court, we have the original bid
price, and in order to have an up-set bid such as yours would be, IV r.
Morrison, we have to have the first bid either ten percent or $500. I 0,
whichever is the lesser. In this particular case, it would be
$500. 00 over and above the original bid price. That would mean w en
the property is taken, the $16, 000.00, as to the whole bid, we woul~
have the first bid, the up-set bid would have to be $16,500.00. ThEn
the original bidders in this particular case, Mr. ami Mrs. Gillel nd,
all they·have to do is to meet your bid,;· And in order to have the
property knocked down to them, all they have to do is to meet the
highest bid offered here today, after the original $500.00 bid.
Then the bidding can come in smaller increments, probably $50.00
or $100.00 to start out with to see where we go. Now as I under-
