PETITION FOR SETTLEMENT OF ESTATE
LESS THAN $2,500.00 AND CLAIM OF FAMILY EXEMPTION
TO THE HONORABLE P. V. MARINO,
PRESIDENT JUDGE OF SAID COURT:
The Petition of Alberta Cappelli respectfully represents
1. That the decedent is Dan Cappelli, who, during his
lifetime, resided in the Borough of Charleroi, Washington County,
Pennsylvania.
2. That the decedent died of natural causes on May 19,
1969, in the City of Pittsburgh, Allegheny County, Pennsylvania.
3. That the decedent, during his lifetime, was seized
of the following personal property, which compose the sole assets
of his estate:
(a) Share account of Macbeth Evans Division Employees
Federal Credit Union -$1,615.25.
(b) Share account of Charleroi Federal Savings and
Loan Association -$702.00.
4. The decedent died testate, married to your
Petitioner and leaving to survive him your· Petitioner, Alberta
Cappelli, and one (1) daughter, Patricia Ann Melenyzer.

5. Your Petitioner and the decedent were married on
March 14, 1935, and continuously resided together until
the date of the decedent's death both within and without the County
of Washington, the latest residence being the residence set forth
in Paragraph One (1) herein.
6. There are no outstanding debts of any nature due
and owing which have not been paid by your Petitioner, Alberta
Cappelli, and all of the expenses of the funeral have been paid
by your Petitioner totaling the sum of One Thousand Four Hundred
Ninety-One and 00/100 ($1,491.00) Dollars.
WHEREFORE, your Petitioner prays your Honorable Court
to direct distribution of the assets of the estate of the decedent
to your Petitioner under the authority of Sections 202 and 2ll"of
the Fiduciary Act of 1949, as amended.

AND NOW, the
DECREE

Petition being duly presented, the s ordered filed and upon
consideration thereof and upon motion of Melvin B. Bassi, Attorney
for Petitioner, it is hereby
ORDERED AND DECREED
by virtue of the authority vested in this Court by the Fiduciary
Act of April 18, 1949, P. L. 512, Article II, Section 211, as
amended and Section 202 as amended, that the personal estate of
Dan Cappelli, deceased, consisting of a share account of Macbeth
Evans Division Employees Federal Credit Union and valued at ,
$1,615.25 be distributed in kind to Alberta Cappelli as her family
exemption without administration arid =further that the sum of
$702.00 representing a share account of the Charleroi Federal
Savings and Loan Association be awarded to Alberta Cappelli
without administration or letters testamentary thereon being
taken out but with the same effect that a Decree of Distribution
would have after an accountimg by a personal representative.
