the last Will and Testament of

late of North Franklin Township·, in the County aforesaid, deceased,
(a true copy whereof is to these presents annexed), was duly admitted to probate; and

the Executor in said Will and Testament named, having appeared before me and taken and subscribed
the oath of office prescribed by law;
NOW, THEREFORE, I, Russell Marino , Register as aforesaid, do
grant these LETTERS TESTAMENTARY, unto the said
VELMA C U P L E R MILLER
committing unto h e r the administration of all and singulM the goods and
chattels, rights and credits, which were of said deceased, and requiring h e r
to exhibit a true and perfect inventory thereof into the Register's Office, at Washington, within ninety
days from the date hereof, and to render a just and true account of said administration at the expiration
of six months from the date hereof, and to regard and comply wjth the provisions of the laws of this
Commonwealth relating to inheritance taxes.

I, WILLIAM E. MILLER., a resident of South Strabane Township, Wash-
ington County, Pennsylvania, being of sound mind, memory and understanding, do
make, publish and declare this my Last Will and Testament, hereby revoking any
and all Wills by me heretofore made.
ITEM I. I direct that all my just debts and funeral expenses be paid as
soon after my decease as may be found convenient.
ITEM II. I hereby give, devise and bequeath all of the real estate of which
I may die seized to my wife, Velma Cupler Miller, for life, with remainder over to
be distributed in accordance with the applicable sub -paragraphs of Item V. I further
authorize and empower my wife to make, execute and deliver a good and sufficient
deed or deeds therefore and do not require .the purchasers thereof to look to the
application of the purchase or consideration monies. In the event of the sale of all
or any part of the same, I direct that the trust as set forth in Item V become activated
and that the net proceeds of said sale, after paying the expenses thereof shall be de-
posited in said trust, and shall be subject to all the terms, covenants and conditions
and all the rights and privileges accorded in said trust and as set forth therein;

provided, however, that in the event she should sell our home and desire to purchase
another home, she shall have the right to use such portion of the consideration ~eceived \ ,

from the sale of our home or all of said consideration to purchase another home, title I

to the same to be taken in her for life with remainder under the terms of this Will.
ITEM III. I hereby give~ devise and bequeath all the rest, residue and
remainder of the property of which I may die seized, whether the same be real, per-
sonal or mixed, to my wife, Velma Cupler Miller.
ITEM IV. In the event my wife should predecease .me, I hereby give, devise
and bequeath all of the· property of which I may die seized to my stepson, C. Dean
Strosnider.

ITEM V. In the event both my wife and my stepson should predecease
me. I hereby give, devise and bequeath aU of the remainder of the property of which
I may die seized. whether the same be real, personal or mixed, to Pittsburgh
National Bank, a banking corporation with its principal office located in the City of
Pittsburgh, Allegheny County. Pennsylvania, in trust. nevertheless, for the following
uses and purposes:
(1) To pay the net income. after paying all expenses incident to
the ma~agement of the trust to the widow of my stepson, Edith B. Strosnider, for life
or so long as she remains unmarried.
(2) In the event of her remarriage. to pay one-half of the net in-
come to her 'for life. The remaining portion thereof shall be used for the comfort,
support. maintenance and education of the children of my stepson. together with such
portion of the principal thereof as shall be necessary for said purposes. I do not pro-
pose that it shall necessarily be in equal amounts payable for each child, but that it be
determined according to the needs of each child. It is my desire that the children be
cared for and given the comfort. support and education that would have been provided
for them if their father had been living, such as educational expenses or expenses of
illness or any other emergency. After such provision is so made I desire them to
be given equal treatment insofar as the same be possible.
(3) In the event the widow of my stepson be no longer remarried
the entire income shall again be distributable to her.
(4) In the event the widow of my stepson is not remarried, and the
income should be insufficient to provide for the education of the children of my stepson.
or should be necessary to provide for her own personal needs, including illnesses of
hers or her family. to use such portion of the principal of said fund as may be necessary
to provide for said purposes.
(5) I~ the event the widow of my stepson is remarried and the in-
come should be insufficient to provide for the education or illness of the children of
my stepson or to provide for the illness of the widow of my stepson if her husband
cannot provide the proper care, or to assist any of the children of my stepson or·
their families if their mother deems it necessary to use such portion of the principal
thereof as shall be necessaryto so provide, Upon the death of the widow of my step-·
son or if she should predecease me before the children of n1y stepson shall be entitled
to distribution hereunder~ to use the income from said funds for the comfort, support,
maintenance and education of the children of my stepson, together with such portion
of the principal thereof as shall be necessary for said pu~poses in accordance. with
the desires set forth in sub-paragraph (2) of this item.
· (6) In the event the children of my stepson are entitled to income
or any portion of the principal as set forth in the paragraph preceding, when they be-
come of age to care for their own needs said sums may be paid directly to them if it
is considered desirable at such time by my trustee, otherwise the income shall be
payable to the person or persons standing in loco parentis to them.
(7) In the event the children of my stepson shall be entitled to
inherit hereunder~ when the youngest of the children of my stepson shall reach the
age of twenty-fiv·e (25) years or shall have completed his formal education, whichever
is the last to occur, I direct that the said sum shall be divided into as many parts as
there are chi~dren of my stepson, and direct that one-fourth (1 I 4) of each of said parts
be distributed to each of the children of my stepson; when each of the children of my
stepson attains the age of thirty (30) years, I direct that one-third (1 I 3) of the balance
of each of said parts shall be distributed to each of the children of my stepson; and
when each of the children of my stepson attains the age of thirty-five (35) years, I
direct that the balance of each of said parts be distributed to each of the children of
my stepson.
(8) In the event of the marriage and death of any of the children
of my stepson before receiving all of his inheritance, his widow shall be entitled to
rece:lve it in the proporttons and at the ages set forth in sub-paragraph (7) hereof in

which the childret:J. of my stepson would ue entitled to inherit in the event the children
of my stepson has living or conceived issue and she has not remarried. In the event
the widow of any deceased children of my stepson shall have remarried and there is
living issue of the children of my stepson, the same shall remain in trust, the income
and principal to be used and distributed in accordance with the schedule herein provided
for the children of my stepson. In the event any of the children of my stepson should
die before receipt of the principal hereof without leaving any issue, living or conceived,
his interest shall be distributed to the surviving children of my stepson or in accordance
with this sub-paragraph to the widow or issue of any deceased children of my stepson,
per stirpes.
ITEM VI. I direct that my Trustee, in addition to and not in limitation of
any authority given by law, shall have the following powers:
(1) For the payment of debts or for any purpose of administration
or distribution, power to sell, mortgage, lease for any term or terms without limitation,
alter, improve,· partition and exchange all or any of my real estate, at any time during
the continuance in whole or in part of the trust under this my.Will and·at the termination
thereof for purposes of distribution, selling at public or private sale, for such prices
and upon such terms as to cash and credit as it may deem best, or upon the reserva-
tion of ground rents, and the said ground rents in turn to extinguish or assign, and to
grant and convey good and sufficient title, without liability on the part of the purchasers
or other persons so dealing with the Executor or Trustee, to see to the application of
the purchase or consideration monies r
(2) To purchase or otherwise acquire real estate and to exercise
the same powers thereover as hereinbefore provided with respect to the other real
estate of the estate.
(3) To retain all stocks, bonds and investments owned by me, and
to invest and reinvest the trust estate herein created or any part thereof in any kind of
property, real or personal, including, without limitation, mortgages or mortgage

participations, common trust funds, common stocks, preferred stocks, bonds, notes
and other securities, regardless of whether the same are legal investments for trust
funds as now or hereafter defined by .law, whethet' by statutory enactment, judical
decision or otherwise.
(4) To borrow money and pledge any stocks, bonds or other per-
sonal property of the estate as security therefor, without liability on the part of the
lender to see to the application of said money.
(5) To purchase securities at a premium, to amortiz<=: the premium
out of income, or to charge the same to principal or income, or partly to principal and
partly to income, at such times and in such amounts as it shall deem best.
(6) To exercise any option to subscribe for stocks, bonds or other
investments.
(7) To join in any plan of lease, mortgage,. consolidation, exchange,
reorganization or foreclosure of any corporation in which the estate may hold stocks,
bonds or other securities.
(8) To retain indefinitely any part of the trust estate, real or per-
sonal, which is or may become unproductive, or in the discretion of the Trustee to
make sale thereof. The Trustee, in its discretion, may pay the carrying charges
and expenses of property, during any year in which it is unproductive, out of other
principal of the trust estate, or out of the income of other principal, or partly out of
such principal or income, and it may from time to time reimburse such principal or
income for the whole or part of said charges and expenses. The Trustee may apportion
the proceeds of sale of unproductive property between principal and income according to
law, or in its discretion it may pay said proceeds into principal without apportionment.
(9) To co-mingle the assets of the trust herein granted with assets

coming into its possession from any other source for the benefit of the beneficiaries
hereof under like or sim'ilar provisions.

of this trust at the discretion of the Trustee; and either deduct capital losses from •.
income or charge them against the principal at the discretion of the Trustee.
(11) In the event any stocks forming a part of this trust be given
rights to subscribe for additional shares or should declare stock dividends, I hereby
authorize my Trustee to apply the same either to corpus or to income as in its
discretion it shall deem best.
ITEM VII. I direct that all legacies and all shares and interest in my estate
whether principal or income, while in the hands of my Executor or Trustee, shall not
be subject to attachment, execution or sequestration, for any debt, contract, obligation
or liability of any legatee or beneficiary, and shall not be subject to pledge, assign-
ment, conveyance, or anticipation, and tl!e personal receipt of such legatee or benefi-
ciary, shall be the sufficient and only discharge of my Executor or Trustee.
ITEM VIII. I hereby authorize my Executor hereinafter named at her
discretion to file a joint income tax return with my wife, Velma Cupler Miller.
ITEM IX. I hereby authorize and empower my Executor hereinafter
named to enter into any compromise which she deems to be proper on account of
any estate, in'come or other tax claims.
ITEM X. I hereby authorize and empower my Executor hereinafter named
to pay all inheritance, estate and succession taxes out of my residuary estate.
ITEM XI. I hereby nominate and appoint my wife, Velma Cupler Miller,
as Executrix of this my Last Will and Testament. In the event she is unable or un-
willing to serve, I hereby nominate and appoint m'y stepson, C. Dean Strosnider as
/ Executor of this my Last Will and Testament. I h~reby direct that my Executors shall
not be required to give bond or other security in any jurisdiction.

AND NOW comes Velma Cupler Miller and petitions this Honorable
Court as follows:
1. That she was the wife of William E. Miller and that they main-
tained the family relationship until the time of his death.
2. On the 24th day of May., A. D._, 1969, William E. Miller,
deceased., herein called ''decedent"., died domiciled at 971 Gabby Avenue"
North Franklin Township., Washington, Pennsylvania.
3. The petitioner was the spouse and is the surviving widow of
the said decedent.
4. On the 18th day of June, A. D._, 1969_, Letters Testamentary
were granted by the Register of Wills, Washington County_, Pennsylvania., to
your petitioner_, Velma Cupler Miller.
5. The estate of the decedent included the following property
valued in the Inventory and Appraisement as indicated: 18 shares_, Lucky
Stores_, Inc. at a value of 55 3 I 4 or a total value of $1, 003. 50.
6. That all claims against said estate have been fully paid and that
your petitioner is the c.nly person having an interest as distributee or creditor
therein.
7. That your petitioner, being the personal representative of the
said decedent,~ has knowledge in such capacity of the presentation of this
Petition along with the Audit Petition of his said estate.
8. The petitioner does not request the allowance of the family
exemption prior to the audit of the Account of the personal representative of
the estate of the decedent.
9. The petitioner requests the Court pursuant to Section 211 of
the Fiduciaries Act of April 18, 1949, P.L. 512 § 211, as amended., 20 P. S.
§ 320.211, to grant her permission to retain as payment of the family
exemption from the Estate of William E. Miller, decedent, the following pro~
perty: 18 shares, Lucky Stores, Inc. at a price or sum of $1, 003. 50 upon

at the time of death, whether in decedent's immediate possession, standing to decedent's credit in banks
of deposit, savings banks, trust companies, or otner inlStitutions, whether individually, or in trust for
any other person or persons giving also separately the accrued interest thereon, if any, down to the last

market value thereof; all bonds and mortga~es held by decedent and of all claims due and owing decedent
at the time of death, and all promissory notes or other instruments in writing for the payment of money
of which decedent died possessed, of whatsoever nature, with interest thereon, if any, giving the face
value and estimated fair market value thereof, and if such estimated fair market value be less than the
face value, it sets forth briefly the reasons for such depreciation-as to each item; all moneys payable
to the estate from life insurance polici'es carried by decedent; all annuity and endowment contracts the
proceeds of which were payable upon the death of the decedent; and all the corporate stocks and dividends
due thereon and unpaid as of the date of death, bonds and accrued interest thereon to the date of dece-
dent's death and other investment securities owned by the decedent ~t the time of death, with the market
value thereof at such time.

In the case of securities of close or family corporations, the values reported are as far as
possible substantiated by financial statements of the corporations, showing the assets and liabilities
thereof as of the· date of death. The schedule also sets forth the interest of decedent at the time of
death in any co-partnership or business, and in support of the value of such interest there is annexed to
said schedule, financial statements showing the assets and liabilities of said co-partnership or business.
A copy of the co-partnership agreement, (if oral, a statement setting forth the nature of the agreement)
together with a statement setting forth the character of the business, its location, and such other facts
pertaining to the business as may be pertinent to a fair and just appraisal of the decedent's interest
therein must be submitted., It should also set forth in itemized form, together with the fair market value
thereof, any other property owned or bequeathed by the decedent at the time of death;
The Schedule C attached hereto and made part hereof sets forth a true answer to each inquiry
contained therein and in the case of transfers ofproperty, real or personal, within two years of decedent's
death, in contemplation of decedent's death, or intended to take effect in possession or enjoyment at or
after death, said schedule sets forth the nature and value of such property, to whom transferred, the
relationship of the transferees to the decedent, the proportionate share received'by each transfe~ee and
all other facts of a pertinent nat~r~ reg~rging said ,transfers. In the case of transfers intended to
take effect in possession or enjoyment at or after death, there is also attached to the schedule a co~y
of the deed, trust agreement or other instrument creating the trust. Thero~ is also set forth in said
