grant these LETTERS TESTAMENTARY, unto the said

committing unto him the administration of all and singular the goods and
chattels, rights and credits, which were of said deceased, and requiring him

Somerset Township~ Washington County, Pennsylvania~ do hereby make my
Last Will and Testament, and revoke all wills by me at any time heretofore
made.
FIRST. I direct the payment out of my estate of the expenses
of my illness and funeral.
SECOND. All the rest, residue and remainder of my estate,
real. and personal, I give, devise and bequeath to my wife, ITALIANA FAVA,
for life with the power to consume so much of the principal as may be needed
for her maintenance and support.
THIRD. Upon the death of my wife, I give, devise and bequeath
the residue of my estate as follows:

MR. BARNA: Your Honor, when we got into this estate it was
because of a life estate that was---or a deed in which a life estate
w.as reserved by Joseph Fava. We became aware of a problem
with Inheritance Tax. Then we discovered that there was some stoc <.
But the Fava brothers, there's three of them who own this property
and they are in the dairy farm partnership out around Bentleyville,

through their brother Louis, they are advancing all expenses in
excess of the Unites States Steel stock that is. valued $2. 527. 50, ev n
to the extent that they will make the specific devises to their two
sisters and one brother that we have set forth in the Audit Petition.
under the will. If we would have taken all the expenses of the funeral
out of the stock. there would not have been enough money to pay--
~ they wish to pay them and have it made part of the Decree of Dis-

And we erroneously included that in the beginning as a receipt in
the Inventory and Appraisement. but we took a debit for that in our
account.
THE COURT: Is3that going to effect your Inheritance Tax?
MR. BARNA: No, because the Inheritance Tax is two percent
on the value. We have agreed \Oht· the value with the Dep?rtment.
But then we would also like the Court to decree the specific dis-
tribution or bequest to the one son for $500. 00 and the two daughte s
for $200.00 apiece. And then we will have him sign a receipt and
