1. She is the daughter of Claude w. Holden, Sr. and resides at
6 Core Street, Washington, Washington County, Pennsylvania.
2. Claude w. Holden, Sr. is sixty-nine years old, a widower,
and is a domiciliary of Washington Co.un:_!;y, Pennsylvania.
3. Claude w. Holden, Sr. is currently a resident of lilll<rom's
Convalescent Home, 1198 West Wylie ~venue Extension, Washington, Pennsylvania,
having been admitted on May 12, 1969.
4. The names and addresses of all sui juris persons, who are th
next of kin of the alleged incompetent, Claude w. Holden, Sr. and who would be
entitled to share in his estate if he died intestate at this time are as

5. Claude w. Holden, Sr., because of mental illness which has
lessened his capacity to use customary self-control, judgment, and discretion
in the conduct of his affairs and social relations, is unable to manage his
property and/or is liable to dissipate it,or become the victim of designing
persons.
6. The estate of the said ClaudeW. Holden, Sr. consists of the
following:
a. A five room brick house and lot known as 4 Core Street,
Washington, Washington County, Pennsylvania, worth approximately $12,500.00.

b. Western Pennsylvania National Bank checking account
#M 66-2-701920 having a balance of $1,499.77 as of May 5, 1969.
c. First National Bank of Washington checking account
II 06-01323-6-06 having a balance of $267.98 as of May 14, 1969.
d. Check No. 1823 of s. W. Miller Agency payable to Claude
w. Holden in the amount of $1.45 dated ~pril 15, 1969.
e. Check No. A58-915l52 of Nationwide Mutual Insurance Com-
pany payable to Claude w. Holden in the amount of $13.05.
f. Claude w. Holden, Sr. is entitled to receive pension
benefits from West Penn Power Company.
g. Claude w. Holden, Sr. is entitled to receive Social
Security benefits monthly.
7. Claude w. Holden, Sr. receives no other income, except any
income which might be received from his real estate.

9. Claude w. Holden, Sr. has no guardian of his estate nor has
any other court ever assumed jurisdiction in any proceeding to determine his
competency.

10. Claude w. Holden, Sr. was a member of the ~med Services of
the United States during World War I but he is not receiving any Veterans Ad-
ministration benefits.
11. Your petitioner proposes that Charles w. Cunningham, the
brother of the alleged incompetent's late wife, be considered as the guardian of
the estate of the alleged incompetent, Claude W. Holden, Sr., because he is the
brother-in-law of the alleged incompetent and has maintained a close family
relationship with the alleged incompetent and his family, and generally has been
interested in the welfare of Claude w. Holden, Sr.
12. Charles w. Cunningham has no interest adverse to that of the
alleged incompetent and is not a fiduciary in any estate in which the alleged
incompetent has an interest.
13. If appointed Guardian of the Estate of Claude w. Holden, Sr.,
Charles w. Cunningham will faithfully perform the legal duties imposed upon him.
WHEREFORE, your petitioner prays that your Honorable Court:
1. ~ward, pursuant to Section 301 of the Incompetent's Estate
~ct of 1955, P.L. 1154, as amended, 50 P.S. 3301, a citation directed to the
alleged incompetent with notice to all his next of kin who have not s.igned the
attached waiver marked as Exhibit "A", and to such other persons as the Court ma~

MR. BECK: Actually, Your Honor, there was not. HoiA-
e·ver, we did make service on one of the children, Frank
W. Holden 651 Painter's Run Road. We sent him a copy of
the petition. I sent along with that a sheet for ~oinder
by Mr. Holden if he desired. Mr. HOlden returned the
Joinder signed, but he returned ~ after I had filed the
Petition. All of the other children have joined in the
Petition. I have, and I will make available for the
Court an Affidavit stating that service was made on Mr.
Holden.

A He's presently at the Ankrom Convalescent Home at 1198

A He is 69, will be 70 on the 17th of this month.
Q Now Mrs. Williams, you have pre sen ted a petition concerni g
your father and his estate. In that petition you have
named children of Claude W. Holden. Was Claude W. Holden,
Sr. married?
A He was married 51 years. And his wife passed away the first
of May of 1969.
Q Can you give us the names of the children of this marriag~?
A There's Claude w., Jr, and he lives at R. D. 5, Washingto~,
Pa. And there's myself, Manelva Holden Williams of 6 Core
Street. There's Susanna Holden Webb of 95 Homer :·Avenue.
There's Frank W. Holden of 651 Painter's Run Road, Pitts-
burgh, Pa.
Q That's Bridgeville, is that correct?

City, Illinois. And there's Earl 0. Holden, he's presenily
at Fort Sheridan, Illinois. He's with the Armed Service.
And there's Alma Jean Holden Salsberry of R. D. 6, Wash-

Q Now I believe, Mrs. Williams, that besides yourself, thrEe
of the other children of Claude W. Holden are present heJe

A That's right.

Mrs. Williams, did your father have a family doctor?
Yes, his family doctor is Dr. Grant E. Hess of Washington.
And at the time that your father was admitted to the
Ankrom's Convalescent Home, how did this come about?
Well, we consulted with Dr. Hess and our minister, Revere~d
Richard King, and we had a consultation with Dr. Benton.
And they all advised us to put our father in a nursing
home, being incompetent and not able to take care of hims~lf.
Now, Mrs. Williams, willy:m tell the Court what condition
and what actions of your father led you to consult with
these doctors and with your minister?
Well, he didn 1 t remember things and he would do odd thin@ s.
Things that a man of his age wouldn't do ordinarily.
Do you want me to state some of the things?
Yes. Can you give us an example of some of these things;
One morning he gets the shave, that he thinks he had plueged
in his electric razor, which he didn't and he said it
was broke. It wouldn't work. We showed him and he could , ee
that it worked all right and he would qhav_e himself. And everal
others.
The reason for this was that the razor wasn't plugged in
is thatcorrect?
A That's right. He had forgot to plug it in.
Q You said your father was living nextdoor to you.
A Yes.
Q Was he living alone?

And since that time, I would take it to be 1945, 1944,
you have been practicing private practice in Washington,
Pa. and associated with the Washington Hospital.

In the course of your practice, did you have occasion to
treat Claude W. Holden, Sr.?
Yes, I've treated him since 1954.
Q Can you tell us something about your treatment of Mr.
Holden, generally?
A Well, originally, Mr. Holden was depressed. And I treated

him for deprEfssion for several years. He developed some
hypertension later and he was treated for that. And for
three or four years he's. been going downhill mentally. A~d
I would say for the last six months he's been considerablv
worse mentally" tfian previously. His mental condition is
due to hardening of the arteries of the brain and he is
confused and disoriented. I went down to see Mr. H0 lden
this morning at the Ankrom Nursing Home. I find that he
is better in some respects in that he is more easily con-
trolled. He doesn't·have to be tied down or restrained in
any mannercat the present time.He goes and eats his meals
with the other patients at the nursing home. But this
morning I asked him my name, he couldn't answer that.
I asked him what month it was, he couldn't answer that.
He couldn't answer the day, what day it was. I asked him
what was yesterday and he couldn't answer that. I asked
him the year and he said 1933. ',
Dr. Hess, you stated that in the past six months he hqtS
gone downhill physically and mentally. And that for 1;he
last three or four years he has experienced this ment~· 1
deterioration. Has this mental deterioration manifeste1 d
itself in any other way other than the loss of memory
which you stated?
A Loss of memory chiefly. He couldn't remember things.
Q In your opinion, can you tell me the duration or the
expected duration of this particular condition?

A Well, I think this is a very_permanent condition and he
will not get any better. If anything, he will get worse.
Q Is this an unusual condition in a man of Mr. Holden's ageP.
A I think probably not.I would probably say it's unusual
this early, although we see a lot at his age, a lot of
mental confusion. But you are more apt to see it, of course,
in the older age group • .-
Q In your opinion, considering his present mental capacity,
and condition, would you say that Mr. Holden is in a condition
to manage his own affairs?
A No. I feel that he absolutely cannot manage his own affaj~s.
Q Would you say that it would be possible for him to be led
by somebody who intended to lead him?
A . Yes.
Q And controlled by an individual that wished to.do so?
A Absolutely.
Q That's all the questions I have. Does the Court have an)

A Mainly his arteriorsclerosis.

Well, for his mental condition.
I said before I don't feel that he will ever be any better.
I can say his prognosis is poor, but I don't know what
the would mean.
Yes. We are not trying to hold you to a case of trying
to determine the longevity of this individual, we are not.
His prognosis for life is good. He can go along like thjs

It's a brick home of five rooms and bath. And I don't

The purchase price was $12,500.00.

I understand he was in that service then. Approxima~ely
how long was he in the service?
He was in there a little over a year; he was on the other
side for a little over a year.
