The Petition of RuthS.Banner,surviving spouse of .
Elrn:!r J.Banner,deceased,respectfully represents:
1.The decedent,Elmer J.Banner,resided with his
wife,your Petitioner at 352.Ridge Avenue.Canonsburg,Washington
County,Pennsy.lvania at the time of his'death.
2.Elmer J.Banner died on December 14,1968 atthe
Washington Hospital,Washington,Pennsylvania,at the age of
~ixty-five (65).

3.The decedent died intestate ,and his entire estate
at the time of his death consisted of the :followi~g:
(a)Fifteen (15)shares of the Common Stock of
Chrysler Corporation,Certificate No.PSX2529
at 59 1/4 p~r share ••••••••••••••••••••••••••$888.75
(b)Four (4)shares of the Common Stock of
Continental Oil Company,Certificate No.PB3027
at 80 3/8 per share•••••••••••••.•••••••••••••$321I50 . .,
On or about March 4,1969,a two for one
stock split was declared,and four (·4)additional
shares of the Common Stock of Continental Oil
Company,Certificate No.M02139 was issued in the
name of the decedent.

4.Your Petitioner has paid from her own funds
in ~rder to maintain the assets in kind the following creditors
of the decedent,bei~g all of the claims against the Estate of

5.Two children were born of this marriage,James
E.Eanner of 1183 Cedar Boulevard,Pittsburgh,Pennsylvania and
Martha L.Porco of 29 Bluff street,Canonsburg,Pennsylvania.
However,your Petitioner,RuthS.Banner,Widow,is the only
person entitled to ,share in the distributi::mof the decedent's

estate by virtue of having advanced the af~resaid sum of

$1815.00 for payment of the funeral expens,:!s and grave monument
and further by reason of the fact that she was living in the

fam!1y relationship with the decedent at the time of his death

and is therefore entitled to the family exemption of $1,000.00.

Both of the foregoing children 0=the decedent and
Peti~ioner are 'adtilt,and have joined ,in amd consented to the
prop~sed distribution cif the decedent's es~ate to their mother,
Ruth S.Banner,your Petitioner.
6.In addition to the $1815.00 in expenses'asset
fortt..above,your Petitioner has claimed $],OOO~OO as her family
exemption out of the aforesaid shares of stock,the aforesaid
exper.ses·plus the exemption'being in the em,ount of $2815.00,
exceedi~g the value of'the estate,which is in the amount of
$·12H1'.,25',and no inheritance tax is due or payable on the

7.This Petition for Settlement.ismade pursuant to
the provisions of Article II,Section 202 of the Fiduciary's Act
of 1949 as.amended,,20 .P.S.Section'320.202,decedent having
