Administrator CTA has executed an Article of Agreement for sale ::>
real estate.This audit had been scheduled in March and was postpc·d

to such time as the real estate was c.S:old.It is now sold by Article
of Agreement and the Ancillary Administrator accounts for that in t,
Audit Petition.There is a Will and a Codicil.The Codicil in the
decedent's handwriting which was found in a lock booc in Washington.
There is no contest of the Codicil,even though the Codicil is in her
handwriting and not witnessed.The estate is to be distributed to.at
least the Pennsylvania portion of the estate will be distributed to her
children,one of w hom is a minor.And we have asked that the father~
the natural guardian,'be awarded that share for the period of the
jj minority.Because the balance involved here is total $5300.00.,

set for audit on March 17,1970;at that time I asked for a continua ce
for the reason that the entire balance of the estate located in
Pennsylvania is real estate.This was an Ancillary proceeding.
However,we are in the prOcess of trying to 5~ell the real estate.
The property has been listed with a realtor,but unfortunately,hav
not been able to sell it.I have a further problem in that there is a
lack of communication from the Administrator,Ancillary Adminis-
trator.I have been in touch with him many times concerning this
estate.iill recent months and ha ve had no replies from him.
The only outstanding claim of which I am aware is for Pennsylvania
Inheritance Tax.Other than the claims of our firm fOr costs and
fees.I would like to ask the Cou rt for an additional continuance
in this matter until the real estate is sold so that the matter of

Inheritance Tax and costs could be straightened out .
There is another reason for asking for continuanoe
and that is that if the real estat e is awarded in kind,two of the
distribute:e:s are minors and there may be mOre problems trying
to sell it and conveying it with the minors as grantors in the
future than it would be if the Administrator himself made the deed.
So I v.o uld ask at this time that this matter be continued until such
whichever should first occur.
If it is disposed of before that time,of course,an aCeD unting can
time as the real estate could be sold Or until the next audit te~m,

If the Court please,I woold like to move at this
time for a continuance of the audit in this estate ..This is an
exemplification or rather an Ancillary proceedings from Portage
County,Ohio.I am having difficulty in communications with the
Administrator CTA.However,there is an additional problem.The
only asset remaining to be administered in Washington County is
a piece of real estate which has little value.And according to the

codicil to the will.this real estate would be devised to three childr-=n
of the decedent.two of whom are minors.The Administrator is

I in the process of trying to sell the real estat e and we would like to
have some additional time.We feel that we may be able to dispose
of it before the estate is closed if given the additional time.
THE COURT:Do the minors have guardians?

MR.POSA:Yes.We have filed a return for non-residents
inheritance tax.We have been billed for it and the Administrator
has not paid that.He has until April 15th,1970 to make payment.
I am having difficulty getting him to respond to my communication.
And I a~going to have to try to get him to get back to Washington here
so we can close this up.
THE COURT:It would seem to me that it would be proper to
continge this audit to the next regular audit period.I would suggest
that counsel again,just before the next audit period,send out
notices of that audit to all the parties involved.And then we will not
require re-advertisement again.
