Dear Mr.Hana:
We were unable to complete the audit in the
above estate at the audit hearing primarily because we had not
received a reply from the Federal Government pertaining to the
amount of interest that was paid and held by the Federal Govern-
ment on the Series H Bonds.All of this information prevented
us from filing the Federal Income Tax Returns.We were also
awaiting confirmation of the value of the stock of United Fund,
Inc~-United Science Fund,from the National Quotation Bureau.
We have now received the above information and the following
is a supplement to our Audit Petition:

Pennsylvania,declare this to be my Last Will and revoke any Will pre-
viously mBde by me.
FIRST:I direct that all my just debts and funeral expenses,
including my gravemarker,shall be paid from my estate as SOon as prac-
tical after my decease.
SECOND:All the rest,residue and remainder of my estate,
real and personal,I give,devise and bequeath to my husband,JOHN
BEDZYK,his heirs and assigns.
THIRD:If my husband,JOHN BEDZYK,should pre-decease me or
die at the same time as I do,I then give,devise and bequeath all of
the rest,residue and remainder of my estate to my sister,KATHERINE
DOLINSKI,and my nephew,JOSEPH DOLINSKI,their heirs and assigns to
share and share alike.However,if either Katherine Dolinski or
Joseph Dolinski should not be living at that time,I then give,devise
and bequeath such residue of my estate to the survivor of them.
FOURTH:I constitute and appoint my husband,JOHN BEDZYK,
as executor of this my Last Will.Should my husband,JOHN BEDZYK,
fail to qualify or cease to act as executor,I appoint my nephew,
JOSEPH DOLINSKI,as executor of this my Last Will.
FIFTH:I direct that my personal representative shall not
be required to give bond for the faithful performance of his duties
in any jurisdiction.

Your petitioner is Katherine'Do1inski of Ambridge,Pennsy1-
vania,who is an individual and makes the following claim against
the above estate:
1.The decedent,Agnes Bedzyk,was the Executrix of the
Estate of Katherine Fi1ipczak,late of ,the Borough of Ambridge,
Beaver County,Pennsylvania,who died on January 28,1936.
2.The said Katherine Fi1ipczak by her Will bequeathed
her estate to Agnes Bedzyk,the above decedent,and Katherine
Dolinski,the claimant,to share and share alike.
3.The said Katherine Dolinski and Agnes Bedzyk are
sisters.
4.The said estat~of Katherine Fi1ipczak was settled.

Dear Mr.Hana:
In pursuance to your telephone call of last week pertaining
to the claim of Mrs.Katherine Dolinski against Agnes Bedzyk,Executrix
of the Estate of Keterin Filipczak,I have done a little research and
have come up with the following conclusions:
1.The Statute of Limitations is not a bar to an action
against a fiduciary found upon a devastavit,Williams v.Friedman,7
W.&S.359.
2.There is a rule of presumption that after a lapse of
20 years legacees are presumed to be paid.
3.However,a delay which 1nJures no one does not preclude
the right of a litigant to recover his rightful property.Randall's
Estate,341 Pa.501.
"Enclosed are photostats of Internal Revenue forms 1099 of the
Economy Bank of Ambridge for the years 1961,1962 and 1963,showing that
the stock was still in Katherine Fillipczak's name and that the dividends
were payable to Agnes Bedzyk.We are also enclosing a copy of the Will
of Keterin Filipczak showing that the only heirs under her estate were
Agnes Bedzyk and Katherine Dolinski,the claimant.
The only devisees and legatees under the Estate of Agnes Bedzyk
are Katherine Dolinski and Joseph Dolinski.The said Joseph Dolinski

is also the Executor of the Estate of Agnes Bedzyk.The said Joseph
Dolinski has not objected to the claim of Katherine Dolinski,but in the
Audit Petition has admitted said claim.I therefore feel that the Court
should allow the said claim since none of the parties in interest have
objected to the claim but in fact have admitted the same.
We are also enclosing a photostatic copy of the Inventory and
Appraisement shewing that there were 22 shares of stock in the Economy
Bank of Ambridge in the Estate of Keterin Filipczak,which is the same
number of stock in the Estate of Agnes Bedzyk,thus showing that no
distribution'of the same was made.

In the case of securities of close or family corporations,the values reported are as far as
