corporation, having its p ri n c i p a 1 office in the City of Keene, State of New Hampshire, pursuant to Article II,

PROPERTY AT PUBLIC SALE UNDER
SECTION 543 OF THE FIDUCIARIES
ACT OF 1949, SAME TO HAVE THE
EFFECT OF A JUDICIAL SALE.
TO THE HONORABLE P. V. MARINO, PRESIDENT JUDGE OF SAID COURT:
The Petition of Stanley E. Beck, Administrator of the
Estate of Mary Prokell, deceased, respectfully represents:
1. That Mary Prokell died on May 23, 1968, residing at
200 Roosevelt Street, in the Borough of Bentleyville, Washington
County, Pennsylvania, intestate. Letters of Administration
were granted to your petitioner on April 28, 1969.
2. That the names and addresses of all parties interested
in decedent's estate are: (a) John Prokell, Sr., son, (1/4)
interest, 305 McCormick Avenue, Bentleyville, Pennsylvania;
(b) Pete Prokell, son, (1/4) interest, 806 Main Street,
Bentleyville, Pennsylvania; (c) Stanley Prokell, son, (1/4)
interest, Daisytown, R. D., Pennsylvania; and (d) Jay Prokell,
son, (1/4) interest, 131 Sheldon Avenue, Pittsburgh, Pennsyl-
vania.
All of the above parties are alive and sui juris.
3. The decedent died seized of real property, to-wit
the real estate herein petitioned to be sold, which real estate
is described as follows:

ALL those six certain lots or parcels of
land situate in the Borough of Bentleyville,
Washington County, Pennsylvania, known and designated
as Lots Nos. 89, 90, 91, 92, 93 and 94, in the
Addition to the McCormick Plan of Lots, which said
Plan is recorded in the Recorder's Office of
Washington County, Pennsylvania, in Plan Book No. 3,
pages 108 and 109, and being more particularly bounded
and described as follows:
LOTS NOS. 89, 90, 91, 92 and 93: BEGINNING at a
point on the West side of Park Avenue on the dividing
line between Lots No. 88 and 89 as shown in said plan;
thence along the West side of Park Avenue in a Southerly
direction, a distance of 200 feet to the North side
of Pittsburgh Street; thence along the North side of
Pittsburgh Street in a Westerly direction, 71.50
feet to the intersection of Monongahela Street;
thence along Monongahela Street continuing in a Westerly
direction, 60.14 feet to the intersection of the East
line of Cherry Alley; thence along the East line of
Cherry Alley in a Northerly direction, 164.44 feet to
the dividing line between Lots Nos. 88 and 89; thence
along said dividing line in an Easterly direction, a
distance of 120 feet to the West side of Park Avenue,
at the place of beginning.
LOT NO. 94: BEGINNING at the Southwest corner of
the intersection of Pittsburgh Street and Park
Avenue as shown in said plan; thence South along said
Park Avenue, 12.73 feet to Monongahela Street; thence
West along Monongahela Street, 21.54 feet to Pittspurgh
Street; thence East along said Pittsburgh Street,
17.36 feet to the place of beginning, being a
triangular shaped lot of ground.
EXCEPTING and RESERVING thereout and therefrom,
all the coal of the Pittsburgh seam or River vein
underlying the same, with mining rights as contained
in deed of Mary H. Leyda to John Simpson, dated
March 16, 1899 and recorded in Deed Book 222 page 304.
LOT NO. 89 BEING the same conveyed to Mary
Prokell by deed of Mary E. Holmes, unmarried, dated
July 28, 1920 and recorded in Deed Book 483 page 246.
LOTS NOS. 90, 91, 92, 93 and 94 BEING the same
conveyed to Mary Prokell by deed of Charles McCormick
et ux., dated May 8, 1918 and recorded in Deed Book
457 page 246.
4. That your petitioner, as such administrator, entered
bond in the sum of One Thousand ($1,000.00) Dollars, and that
such bond was entered on April 28, 1969, with National Grange
Mutual Insurance Company as surety thereon.
5. That none of the real estate described in Paragraph 3
has been heretofore sold.

6. That the real estate described in Paragraph 3 is
assessed for taxation as follows:

inventory filed in this estate; a list of decedent•s known debts.

Fiduciaries Act of 1949, because of the aforesaid debts of the
decedent and to complete the orderly administration of the
decedent•s estate.
WH~REFORE, your petitioner prays your Honorable Court,
under Section 543 of the Fiduciaries Act of 1949, to authorize
him to expose at public·sale, the premises at No. 200 Roosevelt
Street, Bentleyville, Washington County, Pennsylvania, and
fully described in Paragraph 3 of this petition.

judicial sale. By order of this Court dated July 3, 1969, Stanley
E. Beck, the Administrator, was directed to make a public sale
of that property as described in the petition on the premises after

sale was set for today, Monday. August 18, 1969, at 10:00 o'clock.
And pursuant to that order, the required public notice by advertisen ent
and handbills and in addition, certified mail notices were sent
to the interested parties, all of which are attached to the petition.

Lots 89, 90, 91, 92 and 93 .and.94 in the Addition to the McCormic
Plan of Lots, was offered for sale on August 2, 1969 and at that
time, Thomas Smith, Jr .• was the highest bidder, bidding: the total
sum of $4, 100.00, and at which time he deposited the required
ten percent deposit or the s_um of $410. 00, leaving a balance due
upon confirmation of $3,690. 00. The terms of that sale are
set forth on the last two pages of the petition for return or report o
public sale.
