I,Nesta TUday,of the Borough of California,Washington
County,Pennsylvania,being of sound mind,memory and understanding,
do hereby make,publish and declare this to be my last will and
testament,hereby revoking and making void any and all wills hereto-
fore made by me.
First.I.direct my executors and executrix hereinafter
named to pay all my just debts and.funeral expenses as soon as they
can conveniently do so after my decease.
Second.I give,.devise and bequeath all my pl'operty,
both real and personal,wheresoever situate,to my three children,
namely,John Roman Tuday,Alexander Tuday and Mary A.Kowalchick,
in equal shares.
I do hereby make,constitute and appoint John Roman
·Tuday,Alexander Tuday,executors,and Mary A.Kowalchick,execu-
trix,of this my last will and testament.

TO DECEDENT'S INTEREST IN REAL ESTATE
AND NOW,this ~day of ;11.~,1979,comes Alexander
Tuday,by his attorneys,PATRONO,CEISLER,EDWARDS &PETTIT and
submits this Petition for Determination of Title to Decedent's
Interest in Real Estate and in support thereof represents as
follows:
1.Nesta Tuday,a/k/a Anastasia Tuday died on the 23rd
day of January,1968.
2 On April 10,1969 letters testamentary were issued
to John Roman Tuday,Alexander Tuday,and Mary A.Kowalchick all
the interested parties in this estate.A copy of the will is
attached hereto,made a part hereof and marked Exhibit "A".
3.On February 28,1973 an inheritance tax return was
filed (RCC-118)setting forth the assets of the estate.A copy
of said inheritance tax return is attached hereto,made .a part
hereof and marked Exhibit "B".
4 The only asset of the estate was the following
described tract of real estate:
ALL that certain parcel of land situate in the
Borough of California,Washington County,Pennsylvania,
described as follows,to wit:

BEGINNING at the southeast corner of East Alley and
another alley running from said East Alley to the
Rothwell Plan of Lots,thence along the South side of
the last mentioned alley South 53°40'East 142 feet to
land now or formerly of John Underwood;thence,along
the said land now or formerly of John Underwood and land
now or formerly of Charles Winfield et ux.and land now
or formerly of William C.Wilson South 35°50'West
150.6 feet to a point in line of land now or formerly of
William Harris;thence,along land now or formerly of
the said William Harris North 55°50'West 68.30 feet to
a point in East Alley;thence along the East side of the
said East Alley 9°45'East 169.60 feet to the place of
BEGINNING.
5.The said estate contained no personalty.
6.All the debts and expenses of administration have
been paid in full by the executors.
7.The inheritance tax has been paid in full.
8.An account has not been filed by the personal
representatives.
WHEREFORE,your petitioner prays your Honorable Court to
issue a decree nisi adjudging that the title to decedent's
interest in the said real estate has passed to John Roman Tuday,
Alexander Tuday and Mary A.Kowalchick as tenants in common in
accordance with the provisions of paragraph SECOND of decedent's
Will and to further order that notice of the Decree Nisi shall be
given to creditors and other parties in interest by advertisement
per 20 Pa.C.S.A.§3546.
