PETITION FOR THE APPOINTMENT OF A . ' -.
GUARDIAN FOR AN ALLEGED INCOMPETENT
To the Honorable P. V. MARINO, President Judge of said Court:
The petition of MARTIN J. HANNIGAN respectfully represents:
1. That your petitioner is the ·nephew of Beatrice Hanlon and resides at
1227 Country Club Road; Monongahela,, Washingt.dn County, Pennsylvania.

2. That the said Beatrice Hanlo~ is eighty-five (85) years of age, unmarried
.
whose domicile is 728 West Main Street, Monongahela, Washington County,
Pennsylvania; that she has been confined to Haven Crest, ·Inc. Nursing and
Convalescent Home, at 1277 Country Club Road, Monongahela, Washington
County, Pennsylvania.
3. That the said Beatrice Hanlon, because of mental and physical infirmi-
ties or old age, is unable to manage her property and is liable to dissipate
it or become the victim of designing persons.
4. That the known assets of the estate of said Beatrice Hanlon are set
forth on "Exhibit A" attached hereto and made a part hereof. This exhibit

shows an estimated gross value of her assets at approximately $100·;,000.00,
and, in addition, the said Beatrice Hanlon receives a teacher's pension check
in the amount of $262. 95 per month. ' ....
5. That the said Beatrice Hanlon was not a member of the armed services

of the United States and is not receiving benefits from the United States
Veterans Administration.
6. That the following is a list of all persons residing within. the Common-
wealth who would be entitled to share in the estate of the alleged incompe-

8. That the proposed guardian of the ·estate of Beatrice Hanlon, an alleged
incompetent, is the Pittsburgh National Bank, Washington County Office,
Washington, Pennsylvania, whose consent and joinder is attached hereto.
9. That the proposed guardian of the estate has no interest adverse to the
alleged incompetent and is not a fiduciary of any estate in which the alleged
incompetent has an interest.
10. That the said Beatrice Hari1on has no guardian of her estate and no
Court has ever assumed jurisdiction in any proceeding to determine the
; competency of the said Beatrice Hanlqn.
WHEREFORE, your petitioner prays your Honorable Court to
adjudicate Beatrice Hanlon to be an incompetent and to appoint a guardian
of her estate.

To the Honorable, the Judge of said Court:
The petition of PITTSBURGH NATIONAL BANK, Guardian,
respectfully represents:
1. · That your petitioner was duly appointed Guardian of the estate of
Beatrice Hanlon by Decree of this Court on April 22, 1969, at No. 424 of
1969, records of the Register of Wills Office, Washington County,
Pennsylvania.
2. That the said Beatrice Hanlon is a resident of Monongahela, Washtngton· -·
County, Pennsylvania but is presently residing at Haven Crest Nursing and
Convalescent Home, 1277 Country Club Road, Monongahela, Washington
County, Pennsylvania, and has resided there since April 30, 1967.
3. That the estate of said Beatrice Hanlon is presently composed of
various savings and checking accounts, stocks, U. S. Government bonds,
and real estate of a present gross value in excess of $100,000.00.
4. That the said Beatrice Hanlon.has no dependents and she is not a
veteran or the dependent of a veteran entitled to any benefits from the
United States Veterans Administration.
5. That there is a monthly charge for the care and maintenance of said
Beatrice Hanlon at the Haven Crest Nursing and Convalescent Home, to-
get her with incidental expenses appropriate thereto, the cost of which is
approximately $600.00 per month.
WHEREFORE, your petitioner prays the Court, pursuant to authority
vested therein by virtue of the Incompetents Estates Act of 1955, as amended,
for leave to pay the required sums to Haven Crest Nursing and Convalescent
Home and any expenses appropriate thereto for nursing, medical care,
clothing ,and other nE;cess~ries of the said Beatrice Hanlon.

The petition of PITTSBURGH NATIONAL BANK, Guardian, of
BEATRICE HANLON, respectfully represents:
1. That your petitioner was duly appointed Guardian of the estate of
Beatrice Hanlon by Decree of this Court on April 22, 1969, at No. 424 of
1969, records of the Register of Wills Office, Washington County, Pennsyl-
vania.
2. That the said Beatrice Hanlon is a resident of Monongahela, Washington
County, Pennsylvania, but is presently residing at Haven Crest Nursing and
Convalescent Home, 1277 C,ountry Club Road, ·Monongahela, Washington
County, Pennsylvania, and has resided there since April 30, 1967. She is
8 7 years of age.
3. That the said Beatrice Hanlon is the owner, inter alia, of the following
des'cribed :real estate' which 'is the subject of this petition. All of her other
assets are in the form of personal property.
ALL that certain parcel ·of land, situate in the Third
Ward of Monongahela,. Washington County, Pennsylvania, and
described as follows:
BEGINNING at the corner of Main and Eighth Streets·
and running thence Eastwardly along said Main Street a
distance of 45 feet to a post; thence Southwardly on a parallel l:ine
with said Eighth Street a distance of 915 feet to a post; thence

Westwardly, a distance of. 45 feet to said Eighth Street and
thence Northwardly along. said Eighth Street a distance of 95 feet
to said Main Street at the place of beginning~ Upon which is
erected a two story brkk dwelling house and other ·out buildings
and said land being a part of Lot No. 61 in Plan of Addition to
Monongahela City as laid out by J. W. Lockhart & Company.

4. That your petitioner wished to make a private sale of the real estate
and on November 24, 1969, the petitioner and the Most Reverend Vincent M.
Leonard, Bishop of Diocese of Pittsburgh, Trustee for Transfiguration Chu
of Monongahela, Washington County, Pennsylvania; executed a contract
subject to the approval of the court for the private sale oLthe real estate by
the petitioner to the buyer for $6 J 500. oo·. A copy of the agr:eement of
sale is attached hereto as Exhibit ·"A".
5. That the property is now and has been vacant since December, 1966. It
is currently assessed for real estate tax purposes by the W.ashington County
in the amount of$ tfS ()D. 00
6. That the fair rental value of the property is not kno.wn but the expense of
putting the real estate in proper condition for rental purposes, together with
real estate taxes and proper insurance would not allow a proper return on
the investment.
7. That the cost ·of maintenance, needed repairs do not justify the retention
. of this .asset in kind .by the guardia'n .and therefore the guardian believes and

The petition of PITTSBURGH NATIONAL BANK, Guardian of
Beatrice Hanlon, respectfully represents:
1. That your petitioner was duly appointed Guardian of the estate of Beatrice
Hanlon by Decree of this Court on April 22, 1969, at No. 424 of 1969, records
of the Register of Wills Office, Washington County, Pennsylvania.
2. That the said Beatrice Hanlon is a resident of Monongahela, Washington
County, Pennsylvania, but is presently residing at Haven Crest Nursing and
Convalescent Home, 1277 Country Club Road, Monongahela, Washington Court
Pennsylvania, and has resided there since April 30, 196 7.
3. That your petitioner, as guardian, has been marshalling the assets of her
estate and it has come to their attention that said Beatrice Hanlon is the
registered owner, inter alia, of 520 share.s of Capital Stock of the Valley Camp
Coal Company, for which they have been unable to locate any certificates.
4. That the Cleveland Trust Company of Cleveland, Ohio is the Transfer
Agent for said stock.
5. That said Cleveland Trust Company has advised the petitioner that they
as guardians will be required to e~ecute an indemnity bond in order to have

Pennsylvania, for the sum of $6, 500. 00; it. further appearing, upon the date
and at the time fixed for the Court's final consideration of said petition, that,
in conformity with the Court rules, upon filing of the required proofs of . ,,
publication together with affidavits of notice to interested persons, there
being no one present in open Court interested in same, the sale is 'hereby
confirmed.
The guardian of the estate of Beatrice Hanlon is authorized~ upon
receipt of the balance of the purchase price, to execute and deliver to the said

Trustee for Transfiguration Church of Monongahela, Washington County,
Pennsylvania, its successors and assigns, a deed in fee simple for the
following described real estate:
ALL that certain parcel of land, situate in the Third Ward of
Mqnongahela, Washington County, Pennsylvania, and described as follows:

BEGINNING at the corner of Main and Eighth Streets and
running thence Eastwardly along said Main Street a distance of
45 feet to a post; thence Southwardly on a parallel line with said
