PETITION FOR FAMILY EXEMPTION AND PETITION IN AN
ESTATE OF LESS THAN TWENTY-FIVE HUNDRED ($2,500.00)
DOLLARS UNDER ART~ II, SEC. 202 OF THE FIDUCIARIES
ACT OF 1949, P. L. 512, 66, AS AMENDED
The Petition of Noreen F. Vicheck, now married to Barry
M. Kubincanek and now known as Noreen F. Kubincanek, by her
attorney, John Solomon, Esq.~ respectfully represents:
1. That your petitioner is the widow of James H.
Vicheck, Deceased.
2. That the residence of the decedent was Box 315,
,. ' J "'"t ·( Avella, Washington County, Pennsylvania.
3. That the decedent died August 19, 1965, at Pittsburgl,
Allegheny County, Pennsylvania, and was thirty;..two (32) years of
age. A family relationship was maintained between your petitioner·
and the deceased until the time of his death.
4. That Letters of Administration C.T.A. were granted
.to Virginia Gebhardt, April 20, 1966, to file Complaint in
Trespass at No. 66-747 in the United States District Court for
the Western District of Pennsyl~a~ia. ·No fu:.:ther administration
' I will be necessary since the estate is insolvent.
5. That the estate of the.decedent is composed entirely
of personal property in the amount of $1,508.48, being $1,000:00
recovered for the Estate in the above referred to Civil Action and
Mellon National Bank and Trust Company Simplified Savings Account
No. 210-24-0588 in the amount of $508.48.
6. That the decedent left to survive him, the following
heirs:

B. There are no unpAid creditors of the estate of the
decedent, the funeral bill in the amount of $1,152.00 having been
paid to Thompson Funeral Home, Avella, Pennsylvania.
9. That this petition for settlement is made pursuant
to the provisions of Art. II. Sec. 202 of the Fiduciaries Act of
1949, P. L. 512, as amended, as James H. Vicheck, deceased,
domiciled in the Commonwealth of Pennsylvania, in the County of
ashington, and leaving as estate composed of cash of a gross'·value
not exceeding Twenty-five Hundred ($2,500.00) Dollars.
10. That this Petition is also a Petition for Family
xemption, requesting that the exemption of $1,000.00 be paid to
etitioner.
WHEREFORE, your petitioner prays your Honorable Court

1969, the foregoing Petition for settlement of less

exemption,having been presented in open Court, and upon considera-
tion thereof, and upon motion of John Solomon, Attorneyfor
Petitioner, it is ORDERED, ADJUDGED and DECREED that The Hartford

Action recovery in Civil Act~on•Nol 66-747 in.the United Stat~s

as her family exemption af!d that the said .. Administratrix, Virgini
Gebhardt is requested and i~thorized 'to make'said payment to
Noree.n F. Vicheck, now known as Noreen F. Kubincanek; and that
the Mellon National Bank and Trust Company Simplified Savings
Account No. 210-24-0588 in the amount of $504.48 be awarded to
Noreen F. Vicheck, now known as Noreen F. Kubincanek,. in partial~
reimbursement of payment of funeral expense and that the said
Mellon National Bank and Trust Company is requested and authorize
to make said payment to Noreen F. Vicheck, now known as Noreen F.
Kubincanek.
