PETITION TO FIX BOND
TO THE HONORABLE P. V. MARINO, PRESIDENT JUDGE OF SAID COURT:
The Petition of George H. Hott, Jr., Admiriistrator c. T. l.
of the Estate of Alice Corbett Weimer, a/k/a Alice W. Weimer,
Deceased, respectfully represents:
1. That· Alice Corbett Weimer, a/k/a Alice w. Weimer, a
resident of and domiciled in the Borough of Charleroi, Washington
County, Pennsylvania, died.November 9, 1967, testate, and that
Letters of Administration; c. T. A. have been granted to your
Petitioner by the· Register of Wills of Washington County on
November 21, 1967.
2. That an Inventory and Appraisement of the real estate
and personal property of the decedent was filed of record; the
value· of the real estate included therein is the sum of $25,000.00;
the value of the. personal property included therein is the sum of.
$2,862.78, or a total of $27,862.78. A copy of said Inventory is
attached hereto.

3. That your Petit.ioner has filed his bond in the amount
of $1,000.00 with the Glens· Falls -Insur~nce·company, as surety
thereon.

4. That the description of the real estate of which the
decedent died seized is -as follows:
ALL that ce~tain lot of ground situate in the Borough
of Charleroi, Washington County, Pennsylvania, being Lot No. 580 in
the Plan of the Town of Charleroi, (now Borough of Charleroi) bound d

and described as follows; to wit:
FRONTING on Fallowfield Avenue 22 feet; on the South
by Lot No. 578; on the North by Lot No. 582 of said plan, and
extending back in equal width, 100 feet to an alley on the West
side.
5. That your Petitioner desires ·to sell said real estate
in·order that he may make distribution among the persons interested
in said estate.
6. That your Petitioner has entered into a contract to
sell said real estate for the sum of Nine Thousand an~00/100
($9,000.00) Dollars to William H. Brand and Christine L. Brand, his
wife, of the Borough of North Belle Vernon, Westmoreland County,
Pennsylvania, to be paid in cash upon delivery of deed. Your
Petitioner believes and therefore avers that the sum of $9,000.00
is a better price than can be obtained at a public sale of said
real estate. A copy of said agreement is hereto attached.

7. That all of the debts of the decedent have been paid I
and there are no liens of record known to your Petitioner.
8. The names and relationship of the parties in interest
all of whom are sui juris, are as follows:

John H. Weimer, 9011 Theysen Drive, Houston, Texas,

Notice of the proposed sale has been given to all persons in
interest. A copy of said nbtice is hereto attached.
9. That attached hereto are the affidavits of two
competent·persons setting forth that they have inspected the real
estate hereinabove described; that they are familiar with the value
' . of real estate in Charleroi ~orough, Washington County, Pennsylvani< i

that they are not personally interested_ in the proposed sale; and
that the proposed consideration ot ·$9,000.0Q is a better price thah
could be obtained at a· public sale of said property.
WHEREFORE, your Petitioner prays your Honorable Court to
enter a Decree directing that your Petitioner file an additional
se~urity in the amount of $/~ oo!) I 1212 ' with Glens Falls
Insurance Company as surety thereon, and upon the filing of the
same.with the Register of Wills of Washington County, Pennsylvania,
to receive the proceeds of the sale of the premises of the decedent
located in the Borough of Charleroi, Washington County, Pennsylvanic ,
and as described in the foregoing petition.

1. In the Inventory and Inheritance Tax Return filed in

2. The Department of Revenue of the Commonwealth of
Pennsylvania has valued the said real estate at $25,000.00 on
April 16, 1969.
3. The Administrate~, C.T.A. after diligent effort has

1. At the time of the Inventory and Appraisement the
building was occupied under a lease with th~ United States Air
Force. They have terminated their lease and there are no occupant~
at all in the building.
' 2. A'fter the Inventory and Appraisement, a roof condi tic n
was discovered that would require extensive and expensive repair
as well as replaciing the gutters on the building.
3. The heirs in the estate are both now living in Texas
and persuaded the Administrator to place a higher value upon the
premises than is realistic. Since the heirs have left Washington
County years ago, there have been two sh6pping centers located
nearby that draw much of the commercial business from the Charleroj
business district and therefore, property values are depre&~ated.
4. There are numerous storeroom facilities in better
locations in Charleroi Borough than is this premises.
5~ This premises is not desirable for ~ost retail
establishments inasmuch as the floor is not level from the front
to the rear of the building and is not conduaive to a good retail
showroom and the higher appraisement was based on the premises beirg
suitable for a retail showroom establishment.
6. The Washington County Tax assessment is exaggerated
and the deceased owner had never made the effort to appeal the
assessment, although a reduction of the assessed valuation is in
order.
7. Since the original Inventory and Appraisement was
filed there are strong rumors in the Mon Valley of the location of
a third large shopping center within a five minute drive from the
downtown Charleroi ~hich has a depleting effect on property values
in Charleroi.
8. The Administrator, C.T.A. had received four offers
for the purchase of this premises, one offer at ~7,200.00; one
of $7,800.00; one of $8,000.00 an~ the· of~er t~at has been accepted
in the amount of $9,000.00, being the-bes·t offer made after diligert
search for a purchaser~

ORDER AND DECREE
The Administrator c. T .A. here entered a complaint~ under
Section 1001 of the Pennsylvania Inheritance and Estate Tax Act qf 1961,
. 72 P. S. 2485-1001, that he elected to have the correctness of the Common-
wealth's appraisement determined by this Court at the time of audit.
After a full a~d tho:rough consideration of all the testimony adduced
at a hearing held for the purpose, this Court makes the following
DECREE
And Now, August 19, 1969, it is Ordered, Adjudged and Decreed:
1. Appellant filed his appeal in the matter of the appraisement of
certain real estate, being Lot No .. 580, Charlero~ Plan of Lots, and a two-stm y
brick building ana garage~ The same is situate in the Borough of C")mrleroi,
on Fallowfield Avenue, the lot being approximately 22 by 100ft. and the
building occupying almost the entire lot. Decedent died November 9, 1967,
but the property was not agreed to be sold until1969. ·The Commonwealth
appraised this property at $25,000 and the Administrator c. T .A. originally

made an appraisement in the same amount. However, the Administrator C. T A., 1
George H. Hott, Jr., satisfactorily explained the reason he erred in making
the original appraisement and the Court is satisfied that it was, in error. The
appeal in this matter is sustained by the Court, and the appraisement of this
proper:ty.at $~5,-00~ i~ reduced to the sum-of $~5, 000; so that the proper

Dear Mr. Chaney:
We are in receipt of a copy of an Order and Decree of Court, dated
August 19, 1969, sustaining an inheritance tax appeal in the estate of the
above~entioned decedent.
The issue involved was one of fact as to the fair market value of
the real estate on the date of the decedent's death. Certain real estate was
erroneously returned by the estate at the value of $25,000.00 and appraised by
the COJIIID.Gnwealth at the same value. On appeal the estate's position was that
the value of the real estate was $9,000.00.
The order and Decree of the Court disposed of this appeal by finding:
(1) That the property could not be sold for more than $9,000.00.
(2) That the condition of the property was tmsuitable for retail
businesses and in need of extensive repair.
(3) That on an open market at the time of the decedent's death the
-Court's determination of $15,000.00 as the value of the property
approximates its actual market value on that date.
Accordingly, you are hereby authorized to adjust your records to conform
with the Order and Decree o,f Court by correcting the appraisement of April 16, 1969,
and by reducing the value of the subject real estate from $25,000.00 down to
$15,000.00. Giving effect thereto, the gross estate should correspondingly be re-
duced from $28,575.74 to $18,575.74.
