Bane, Executor under the Last Will and Testament of Mike Wichol, respectfully sets forth: 1. That Mike Wichol of Somerset Township, Washington County, Pennsylvania, died testate on the 23rd day or March, 1969~ 2. That the Will of the said Mike Wichol was probated in the Office of the Register of Wills of Washington County, Pennsylvania, and recorded in Will Book 107, Page 448. 3.-That under Paragraph 2 in said Will, the said Mike Wichol devised all or his estate, real, personal and mixed,. unto Paul Corbett and Blanche Corbett, his wife. Q.. That in said Will he appointed. your Petitioner, James c. Bane, as the Executor or his Last Will and Testament. 5. That your Petitioner proceeded to have all of the personal property appraised and which appraisement amounted to $3,309.37 and that the real estate owned by the said Mike Wichol during his lifetime was appraised at $15,000.00. A copy of said Inventory and Appraisement is attached hereto and made a part hereof. 6. That the personal property in this estate is insuf- ficient to pay all debts and administration expenses of the estate. A copy of the debts. and deductions listing all of the debts and administration expenses is attached hereto and made a part hereof. 7. That Paul Corbett and Blanche Corbett, his wife, have '•\,,,.-· ,. r' I decided to retain the personal property and the real estate and 1 have agreed to pay to your Petitioner the sum of $3 ,950.54, being I the amount of the Debts and Administration Expenses in said estate! i 8. 'That in ·order to pay said Debts, Administration j l Expenses, and Inheritance Taxes in the estimated amount of $2150.00, , . I it is necessary that your Petitioner secure a Mortgage in the amount of $6,100.00. 9. That your Petitioner and Paul Corbett. and Blanche Corbett, his wife, made application to the Western Pennsylvania Production Credit Association of Uniontown for a loan of $6,100.00 and which said application has been approved. A copy of the pro- posed Collateral Mortgage and Bond is hereto attached and made a part hereof. 10. That your Petitioner will, upon receipt of the ftmds from said Mortgage, pay all of theDebts, Administration Ex- penses of the e.sta te and the Inheritance Tax, and will promptly file his First and Final Account and proceed to have the real estate described in said Mortgage awarded to the said Paul Corbett and Blanche Corbett, his wife. Sixth: That if at any time hereafter the said Mortgagee shall become a party to any suit or legal proceedings instituted by any third party involving the title of the land hereby conveyed, or in any way affecting the validity or integrity of the loan hereby secured, it is hereby covenanted and agreed that said Mortgagee shall have the right to employ attorneys to represent it in such suit or other legal proceedings, and to pay such attorneys reasonable fees for legal services rendered, not in excess of five per centum -of the principal of the loan hereby secured, and any sum so paid by the Mortgagee shall become a part of the debt hereby secured and shall be payable on demand; Seventh: That in the event Mortgagor fails to pay when due any taxes, liens, judgments or assessments lawfully assessed or constituting li~ns against the property herein conveyed, or fails to maintain insurance as hereinbefore provided, the Mortgagee may make such payment or provide such insurance and the amount paid therefor shall become a part of the indebtedness secured hereby and bear interest from the date of payment at the highest rate permitted by law; Eighth: That h~ will use the proceeds of the loans secured hereby solely for the purposes set forth in his application therefor; Ninth: That he hereby assigns to the Mortgagee as additional collateral all royalties or other monies due or to become due from any surface or subsurface rights or for any right or privilege other than for agricultural purposes in any way affecting or pertaining to the property hereby conveyed and all monies which may become due in any condemnation proceedings affecting the said premises and all sums received may be applied, at the option of the Mortgagee, to the discharge of any pirt-~r ~II of the indebtedness hereby secured, whether or not the same be due and payable or, at the option of the Mortgagee, such sums may be returned to the Mortgagor and the Mortgagor will not grant any surface or subsurface rights without the written consent of the Mortgagee; Tenth: That in the event the Mortgagee, upon default by the Mortgagor, shall take possession of the mortgaged premises as authorized by law, the Mortgagee may operate and manage or lease the same and make any reasonable and proper advances for the operation, maintenance and management of the premises and any sums so advanced shall become part of the debt hereby secured, payable immediately, with interest from the date of payment at the contract rate provided for in this mortgage; : 1 Eleventh: That, upon default in the· payment of the indebtedness secured hereby, or any part thereof, as the same shall become due and payable, or in the event of a breach of any of the terms, covenants and conditions of this mortgage or the bond secured hereby, or in the event the Mortgagor or any of them shall die, become insolvent or file any petition under the Bankruptcy Act,· the entire indebtedness secured by this mortgage shall, at the option of the Mortgagee, become immediately due and payable and, in addition to any other remedy provided by law, the Mortgagee may institute an action to foreclose this mortgage forthwith and prosecute the same to judgment, execution and sale for the collection of the whole amount of the indebtedness and interest remaining unpaid, including sums advanced by the Mortgagee for any of the purposes hereinbefore set forth, together with costs of such proceedings and an attorney's commission of ten percent (10%).
