BRIEF ON BEHALF OF JAMES O.PRIGG,CLAIMANT Statement of Facts C.Elizabeth Prigg,the decedent,died March 9,1969,a resident of Canton Township,Washington County,Pennsylvania.She was a widow and lived on a farm which she owned.The Claimant,James O.Prigg,is the son of the decedent.He lived on the farm with decedent until his marriage approximately 11 years ago and then he and his wife lived on the farm with decedent,and when his daughter was born approximately 10 years ago she lived on the farm with them.For many years Claimant operated the farm and out of his own pocket purchased seed,feed and medicine for animals,materials for repairing and making capital improvements on the farm,paid for labor and did everything to operate the farm and maintained it as a working farm.At the same time Claimant was earning his own livelihood as an employee of Washington Steel Corporation.On the death of decedent Claimant filed a claim for out of pocket expenses as itemized and for labor on the farm.This claim is contested by other heirs and is now before the Court for hearing. Statement of Question Involved Can a son recover for out of pocket expenses and services from a decedent paren:b's estate: ANSWER -Yes. (2) Argument We have here a case where a son operated a farm for his mother, made repairs,cultivated,bought seed,bought feed and medicine for animals, harvested,made repairs and did everything to keep the farm productive and producing.There seems little question that he can recover for out of pocket expenses.However,a fundamental concept is that the law presumes that where a child renders services for a parent,they are rendered gratuitously.It is submitted that this presumption arises where the services are those ordinarily rendered such as board,lodging,care,etc.But in the instant case the services were extraordinary and beyond the scope of those covered by the presumption. This proposition is well stated in 34 Corpus Juris Secundum Sec.37la,page 107,as follows: "Although claimant and decedent lived together as a matter of mutual convenience,there is no presumption that services were rendered gratuitously,but instead a contract to pay therefore may be implied where they were extraordinary and extend over a long period of time,or were neither household work nor such personal services as are usually and ordinarily rendered by one member of a family or household to another.11 The cases where the proposition is presented of the child performing extraordinary services for the parent are few.However,in Raub1sEstate,67 Pa.Sup.Ct.33 (1917),the son took his father into his home and provided him both lodging and care and there was no question that recovery could not be had against the father's estate for this.But the father owned a horse which was used by him exclusively and the son boarded and cared for the horse.The Court held that for these extraordinary expenses the presumption of gratuitous services would not apply and recovery was allowed. Another case in point is In Re:Cramer's Estate,92 Pgh.Legal Journal 21,in which a man took a child into his care and reared her and considered her as a daughter and she considered him as her father.He owned a hotel which the claimant operated acting as manager,clerk,maid, etc.The Court held that even accepting the relationship as parent and child the claimant could still recover because of the extraordinary nature of the services. In New Jersey the same presumption of gratuitous services between parent and child is held to exist,a case on all fours with the instant case is Waker vs.Bergen;4 N.J.Misc.332,132 AU.669.There the son, his wife and child Iived with the s on I s father on the father's farm.The son ran the farm.The Court held that the presumption of gratuitous services by the son for the father did not apply to farm work. THEREFORE,it is submitted that in the instant case the presumption of gratuitous services does not apply and the claim should be considered the same as a claim by a stranger for similar services and payments.
