.OF FAMILY EXEMPTION
AND NOW comes Rose lagnemma,the petitioner herein,
and avers as fol lows:
I.Rose lagnemma,your petitioner herein,was
appointed guardian of the estate of Josephine Museo,an Incom-
petent,by a Decree handed down by your Honorable Court on
September 3,1969.
2.Josephine Museo,the alleged incompetent,is 57
years of age,having been bornon December 16,1911.The alleged
incompetent was married on October 3,1929 to Guil io Museo,
a/k/a Julius Museo,the decedent herein,and their residence
was 293 Beech Street,Muse,Cecil Township,Washington County,
Pennsy Ivan i a.By reason of mental illness or other mental

infirmities,the said incompetent was admitted to the Dixmont
State Hospital,Dixmont,Pennsylvania on April 28,1944,and
she continues to remain a patient at said institution;however,
her legal address is 293 Beech Street,Muse,Ceci I Township,
Washington County,Pennsylvania.
3.The said Gui I io Museo,alk/a Jul ius Museo,the
husband of the alleged incompetent,died testate on March 5,
1969,and by his Last Wil I and Testament dated March 12,1926,
the said Guilio Museo,devised and bequeathed his entire estate
to his mother,Mariantonia Museo,and he designated his uncle,
Pa~quale Simone,to be the Executor of his said Will.The afore-
said Will was probated by the Register of Wi lis of Washington
County,Pennsylvania,and the Same appears of record In the
Register of Wills Office in Wil I Book 107,page 367,and letters
testamentary on the said estate were Bsued on Maeh II,1969
to the aforesaid Pasquale Simone.A copy of the aforesaid Will
IS attached hereto as Exhibit "An and made a part hereof.
4.The said incompetent was the spouse and IS the
surviving widow of the said decedent.
5.The names,addresses,relationship and interests
of al I persons known to be interested in the Estate of Guilio
Museo,a/k/a Julius Museo,are as follQ6:

incompetent surviving spouse and the aforesaid decedent.
7.As of the date of the within Petition,no Inventory
and Appraisement has been filed In the Estate of Guil io Museo,
a/k/a Jul ius Museo,deceased.The Application for Probate of
the Wil I of the decedent in the said estate listed personalty
in the amount of $5,000 and realty in the amount of $3,500.
The realty referred to in the said Application was designated
as 293 Beech Street,Muse,Pennsylvania.
8.By a Decree handed down by your Honorable Court
on October 20,1969,in the Estate of Jos~ine Museo,an alleged
incompetent,at No.835 of 1969,your petitioner was authori%ed
to file in behalf of the said Josephine Museo,the within Petition

distribution,but which the Accountant believes to be correct.Ther is

in that there was an election on behalf of the widow through her guarc 'an

be awarded to the Commonwealth on account of the claim.

So whether she takes under the will or by reason of
Mr.Roney?
If the Court please,we enter our appearance
in behalf of Rose Iagnemma,the guardian of the estate of Josephine
Museo,an alleged incompetent,who is the surviving sp ouse in this
estate.I had written a letter to Mr.John McCreight,setting forth
my opinion that the surviving spouse would have been entitled to the
balance of the monies in the estate and should have been entitled

to the first $20,000.The decedent had prepared a will prior to his
marriage and in his will he had left everything to his widow.But in
view of everything Mr.McCreight had stated here in Court,tit appears
as though the state will get the balance in the estate on account of
keeping her then.

Yes.The guardian was appointed by Your Honor,
I'll say approximately a year ago.

MR.RONEY:
And did the guardian have Court approval to take
Yes,Your Honor,Yes,we got that approval.And
then we found out that the decedent had married after he had preparEd
the will and he had never changed it and we felt that under the cir-
cumstances that the (widow and not the decedent's mother would be
entitled to the balance in the es tate.

If the Court please,we have one other matter the t
we inquired about,an engagement ring and a wedding band and Mr.
John McCreight indicated that the Executor had in his possession
a wedding band and a small engagement ring which the guardian
would like to get for her sister.And actually,I don't think that woulj
be part of the estate.I don't even think it's listed in the Inventory.
MR.McCREIGHT:I have no knowledge of that.

and avers as fol lows:
I.Rose lagnemma,your petitioner herein,was
appointed guardian of the Estate of Josephine Museo,an Incom-
petent,by a Decree handed down by your Honorable Court on
September 3,1969.
2.Josephine Museo,the alleged incpmpetent,IS 57
years of age,having been born on December 16,1911.The alleged
incompetent was married on October 3,1929 to Gui I io Museo,
a/k/a Jul ius Museo,and their residence waS 293 Beech Street,
Muse,Ceci I Township,Washington County,Pennsylvania.By
reason of mental illness or other mental infirmities,the said
incompetent was admitted to the Dixmont State Hospital,Dixmont,
Pennsylvania,on Apri I 28,1944,and she continues to remain a
patient at the said State Institution.
3.The said Gui lio Museo,a/k/a Julius Museo,the
,',husband of the alleged incompetent,died testate on March 5,
1969,and by his Last Wi II and Testament dated March 12,1926,
the sa id Gu iii 0 Museo,'dev ised and bequeathed his ent i re es.tate
to his mother,Mariantonia Museo,and he designated his uncle,
Pasquale Simone,to be the Executor of his said Wi II.The
~foresaid Will was probated by the Register of Wi lis of Wash-
ington County,Pennsylvania and the Same appears of record in
the said Register of Wi lis Office in Will Book 107,page 367

In the case of securities of close or family corporations,the values reported.are as far as
possible substantiated by financial statements of the corporations,showing the assets and liabilities
thereof as of the'date of death.The schedule also sets forth the interest of decedent at the time of
death in any co-partnership or business,and in support of the value of such interest there is annexed to
said schedule,financial statements showing the assets and liabilities of said co-partnership or business.
A copy of the co-partnership agreement,(if oral,a statement setting forth the nature of the agreement)
together with a statement setting forth the character of the business,its location,and such other facts
pertaining to the business as may be pertinent to a fair and just appraisal of the decedent's interest
therein must be submitted.·It should also set forth in itemized form,together with the fair market value
thereof,any other property owned or bequeathed by the decedent at the time of death.
The Schedule C attached hereto and made part hereof sets forth a true answer to each inquiry
contained therein and in the case of transfers ofproperty,real or personal,within two years of decedent's
death,in contemplation of decedent's death,or intended to take effect in possession or enjoyment at or
after death,said schedule sets forth the nature and value of such property,to whom transferred,the
relationship of the transferees to the decedent,the proportionate share received by.each transfe~ee and
all other facts of a pertinent nature regarding said transfers.In the cas~of transfers intended to
take effect in possession or enjoyment at or after death,there is also attached to the schedule a copy
of the deed,trust agreement or other instrument creating the trust.Therl~is also set forth in said

That Schedule D attached hereto and made part hereof sets forth the names and addresses of all
persons beneficially interested in this estate at the time of decedent's death,the nature of their res-
pective interests,their relationship,if any,to the decedent,together With the ages at the time of
decedent's death of all minors,annuitants and beneficiaries for life under decedent's Will.It also
contains a statement shOWing which of the beneficiaries named in the decedent's will,if any,died prior
to decedent,the dates of their death,their issue,andthe relationship of such issue to the beneficiary.
That Schedule E attached hereto .and made a part hereof sets forth all property,real and per-
sonal,owned by the decedent jointly with another or others,including intangible,standing in the name
of the decedent and others,plus the date and place of record of instruments effecting the vestiture of
real estate and the date of acquisition of personalty,plus the name,address and relationship,if any,
of co-owners to the decedent.
That Schedule F attached hereto and made a part hereof sets forth fully and in detail all debts
and deductions claimed f~r and on behalf of this decedent's estate,including funeral expenses paid;
family exemption,where applicable;costs of administration of this estate;counsel fees and fudiciary's
commissions paid or to be paid;cost expended for burial trusts,tombstones or gravemarkers,and reli-
gious services,in consequence of the death of the decedent;debts and claims OWing and unpaid at time of....
death;taxes accrued charge.able for period prior to decedent's death.(except,those.allowed under Section
651 of the Inheritance and Estate Tax Act);together with a statement of collateral pledged for obliga-
tions,if any.It is agreed that the fiduciary will present proof of said claimed obligations upon re-

We have your letter of June 5,1969,together with a.photocopy
ot an Official Inheritance Tax Appraisement (Form RCC-Z)issued on
MAy 14,1969,in the above l14IIed decedent's etJ1:ate.The RCC-2 Form
was erroneously issued out ot Allegheny County,since it has been
determined that the decedent was a resident ot Washington County at the
time of his death.
All records,inc1udin&any RCC-2 Forms that are required,must
be maintained in the county of the decedent'8 rcsidence-l'laah!ngton
County..Accordin&ly,'the RCC-2 'om on file in your office should be
marked void and stricken tront your records.
In add!tion to the fom.diSCUSSed above,you also advise
tha"t inheritance tax in the 81&of $383.87 Was erroneously paid to you
on May 5,1969,tor which you issued official receipt #AOO3591.Since,
as we have previously stated,all records on this estate must be
maintained in Washington County,Mrs.Mildred H.HoI.,Receipts and
Aecount!q Supervisor,advises that the COn'4)ct procedure to adjust

"When Inheritance Tax has been collected in one County,which
should.rightfully have been collec~cd in Ql'lOther,County,the Register
of Wills erroneously collecting the Tax must certify the 8ll1Ount collected
to the Register ot Wills of the COUllty in which the Tax should hn.ve
been paid.
It coumission bas been retained,.the Register of Wills must
send his personal check to the Register of Wills of the County in which
the Tax is rightfully collectible.
If no commission vas withheld by the Registor of Wills collecting
the Tax and there is comission duo the Register to whom tho Tu should
have been paid,the only recourse the Register of Wills would have vould
be to take up the mntter with tho Auditors at the Annual Audit by the
Department of the Auditor General."
The next step required in this case concorns tho Chief Appraiser
of Wash~ton County to whom we are sonding a copy of this letter.
InIDedil\tely upon receipt of the copy of this letter,the
Chief Appraiser of Washington COUDty,Mr.W1lllam R.Chnner,is requested
to prepare and file of record in the Office of the Register of Wills
of Washington County,an official appraisement of tho joint bank account
10-4553 in the Reliable Savings and Loan Association,which vas established
on September 10,1960,in the nnmes of Ciulio Museo,the decedent ond
Pasquale Simono.The account should be o.ppra1sed in the same manner as
was done in Allegheny County,i.e.,at 50',(the amount on deposit at the
time of dece~ent's death,or $2,891.79.
After the above procedure bas been followed and completed,
all records on this estate vUl be maintained in \lasbington County,being
the county of decedent's residence at tile time of death,March 5,1969,
AIry additional tax plyments or other activity in this estate as may be
required must hereafter be processed through the Office of the Register
of Wills of Wash1.ngton County.
